More information on the Jessica Lunsford Act

We understand that the requirements of the Jessica Lunsford Act can be quite overwhelming; therefore, Florida Virtual School prepared the following guide as a quick reference to assist in answering questions. After reviewing the guide if you have additional questions pertaining to Jessica Lunsford compliance as it relates to Florida Virtual School, please contact Professional Standards at HRProfessionalStandards@flvs.net.

The Jessica Lunsford Act was enacted on September 1, 2005, in response to the tragic abduction and death of Jessica Lunsford. This law affects a vendors’ business operations and employees if they are under contract with Florida Virtual School.

Florida Virtual School requires that all contractual personnel who are permitted access on property while students are present, who have direct access to students, or who have access to, or control of school funds must meet the screening requirements of F.S. 1012.32. Contractors who have direct contact with students must, upon engagement to provide the services, have completed and met the background screening requirements as required under F.S. 435.12 as well as F.S. 1012.465 or F.S. 1012.56 (whichever is applicable).

Noninstructional contractors who are permitted access on property while students are present, whose performance of the contract with FLVS is not anticipated to result in direct contact with students, and for whom any unanticipated contact would be infrequent, and incidental shall be required to submit a fingerprint-based criminal history check using the process described in F.S. 1012.32(3).

Contractors intending to work with Florida Virtual School are required to undergo fingerprinting and must receive clearance following a thorough evaluation of both state and national FDLE/FBI Level 2 background checks. The initiation of their contract is contingent upon FLVS granting approval only after this clearance process. Employment commencement for a contractor is only permissible once Florida Virtual School has given the requisite clearance.

For this process to be as efficient and timely as possible, we ask that vendors, agencies, or internal staff specialists to provide Professional Standards the names of individuals requiring clearance. Professional Standards can be reached at HRProfessionalStandards@flvs.net.

Florida Virtual School requires all vendors/contractors, to pay up front for required drug testing (if applicable) and or fingerprinting services. Payment can be made at the time of scheduling fingerprints directly through Fieldprint. Drug testing payments can be made through Florida Virtual School online payment services. Please refer to the guide below for more information.

If, by chance, a contractor with a criminal background is recommended to Florida Virtual School, the referring vendor is accountable for acquiring the required information as requested by Florida Virtual School.
