 Art. 34 Constitution provides that the school is open to all

 Law 118/71, Art. 28, provided that the instruction of the obligation should take place in normal public school classes. In this sense, the law in question exceeds the model of special schools,       which however did not abolish, prescribing the inclusion children with disabilities, however at the initiative of the family, in the common classes.

 Law 517/77 establishes with clarity, conditions, tools and objectives for school integration of pupils with disabilities, to be implemented by taking charge of the project of integration by the entire Class Council and through the introduction of the specialist teacher for support activities

 Law 62/00, private school also welcome disabled students Territorial Centres of Support (CTS)  are established by the Regional school Office in agreement with the Minister of education to promote the Project New Techonologies and disabilities .

 With Law No. 18 of 3 March 2009, the Italian Parliament ratified the UN Convention on the Rights of Persons with Disabilities.

 In 2001, the WHO World Health Assembly approved the new International Classification of Functioning, Disability and Health (ICF)
