Welcome to CoMo Tech Solutions LLC ("CoMo Tech," "we," "us," or "our"). By requesting and accepting our technical support services—whether provided in your home or remotely over the internet—you ("Customer" or "you") agree to be bound by the following Terms of Service.
CoMo Tech provides in-home and remote technical support and troubleshooting for software, network, and account-related issues.
Included Services: Examples include, but are not limited to, resolving streaming device issues, network connectivity troubleshooting, software configuration, virus/malware removal, and account password resets.
Excluded Services: CoMo Tech does not perform physical hardware repair (e.g., replacing broken screens, soldering components, or repairing physically damaged hard drives). If our technicians determine your issue is hardware-related, we will advise you accordingly, but we will not perform the repair.
You are solely responsible for your data. Before a CoMo Tech technician arrives at your home, connects to your device remotely, or begins work, you must ensure that all critical files, personal data, software, and information are fully backed up to an external drive or cloud service.
CoMo Tech technicians will not back up your data prior to commencing work unless explicitly agreed upon in writing as a separate service.
Technology systems can be unpredictable. By utilizing our services, you expressly agree that CoMo Tech Solutions LLC shall not be held liable for any data loss, data corruption, or compromised data occurring at any time.
You specifically acknowledge that CoMo Tech is not responsible for data loss or device issues arising:
Before the Appointment: Due to pre-existing failing hardware, existing malware/viruses, or user actions taken prior to our engagement.
During the Appointment: As a result of the troubleshooting process, system crashes, or necessary software resets performed by our technicians.
After the Appointment (Customer Negligence): Due to user error, careless actions, subsequent malware infections, or failure to follow the security and operational recommendations provided by our technicians.
Under no circumstances will CoMo Tech be responsible for the cost of data recovery services, lost wages, or any incidental or consequential damages arising from lost data or temporary loss of device use.
Depending on the type of service you request, the following conditions apply:
Remote Access Support: For remote troubleshooting, you must explicitly consent to allow our technician to remotely access and take control of your device using third-party remote desktop software. You agree to follow the technician's instructions to initiate this connection. You may monitor the technician's actions at all times during the session and have the right to terminate the remote connection at any time.
In-Home Support: You agree to provide a safe, non-hazardous working environment for our technicians. An adult (18 years or older) must be present for the entire duration of the in-home service visit. CoMo Tech reserves the right to refuse or terminate service immediately if our technician feels unsafe or if the environment is deemed hazardous.
CoMo Tech provides its services on a "best-effort" basis. While we strive to resolve every technical issue, some problems may be unresolvable due to outdated hardware, proprietary software locks, or third-party service outages (e.g., your internet service provider). We do not guarantee that every issue can be fixed, and you acknowledge that you are paying for our technicians' time and expertise, not a guaranteed outcome.
You agree to indemnify, defend, and hold harmless CoMo Tech Solutions LLC, its owners, employees, and technicians from and against any claims, damages, liabilities, costs, or expenses (including reasonable attorneys' fees) arising from your use of our services, your violation of these Terms of Service, or your infringement of any third-party rights.
Furthermore, by requesting assistance with account recovery, password resets, or network configuration, you explicitly warrant that you are the legal owner or authorized user of the accounts, devices, and networks in question.
General Payment: Payment is due immediately upon completion of the service visit or remote session. Customers may pay with a credit or debit card, processed by our technician through our secure point-of-sale (POS) application at the time of service.
Invoicing: Alternatively, customers may request to be billed via invoice. Invoices will be sent via mail or email within 7 to 10 business days of the completed service. Invoiced amounts are due in full within thirty (30) days from the date the customer receives the invoice.
Diagnostic Time and Unresolved Issues: CoMo Tech charges for the time and expertise required to diagnose technical problems. If our technician spends one (1) hour or more attempting to diagnose or resolve your issue, you are fully responsible for paying the billed time at our standard rates, even if the issue ultimately cannot be resolved due to hardware failure, unrecoverable passwords, third-party limitations, or other factors outside of our control.
Late Fees: Any invoice not paid within the 30-day period will be considered past due. CoMo Tech reserves the right to apply a late payment fee of $5 per month on the outstanding balance until paid in full.
Chargeback Protection Policy: By paying with a credit or debit card, you agree not to initiate a chargeback or dispute with your card issuer for valid services rendered or for unresolved issues falling under our Diagnostic Time policy. If you have a billing issue, you must contact CoMo Tech directly to seek a resolution. If you initiate a chargeback that CoMo Tech successfully reverses or that is found to be in violation of these Terms, you agree to pay the original invoice amount plus a $35 chargeback administration fee. CoMo Tech reserves the right to send unpaid balances and chargeback fees to a third-party collection agency, which may negatively impact your credit score.
These Terms shall be governed by and construed in accordance with the laws of the State of Missouri, without regard to its conflict of law provisions. Any legal action or proceeding arising under these Terms will be brought exclusively in the state or federal courts located in Boone County, Missouri.
If any provision of these Terms is held to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions of these Terms will remain in full force and effect.
These Terms constitute the entire agreement between you and CoMo Tech Solutions LLC regarding our services and supersede and replace any prior agreements, oral or written, regarding the subject matter herein.
