The Board of Zoning Appeals, in 2021, heard 8 Development Standards Variance petitions, compared to 10 in 2020. In total, the Board of Zoning appeals heard requests for 11 different petitions, a decrease from 19 cases in 2020. This year the BZA also heard 3 Special Exception requests, which is half as many as 2020. Between all of the different petitions for Development Standards Variances, the board heard requests for a total of 14 variances.
The case for 1451 W McKay Road by Christian Investment LLC was heard on 2/09/2021 and received an Approval with Conditions from the Board of Zoning Appeals. Four variances were applied for- one from setback standards, one from bufferyard landscaping standards, one from multi-family planting standards, and one from density and intensity standards. This petition was part of a larger project that included PC 2021-01, which was denied, stopping the entire project.
The case for 1689 N Michigan Road by Al Berthouex was heard on 5/11/2021 and received approval from the Board of Zoning Appeals. Two variances were applied for- one from setback standards to allow a parking area to encroach into the setback area and one from loading standards to allow delivery vehicles to utilize a public right of way.

This case for 1312 S Harrison Street by David Johnson was heard on 6/8/2021 and was withdrawn from the Board of Zoning Appeals. One variance was applied for- from the home occupation standards to allow a commercial kitchen on a residential property in excess of 500 square feet.
This case for 45 W Washington Street by Rob Nolley was heard on 9/14/2021 and received approval from the Board of Zoning Appeals. One variance was applied for- from the height standards to allow for an increase in height from 15 to 16 feet.
This case for 500 Frank Street by Green Signs was heard on 9/14/2021 and received approval from the Board of Zoning Appeals. One special exception was applied for to install an electronic messaging center.
This case was also heard on 9/14/2021, and is an addition to BZA 2021-06 with this Development Standard Variance from sign standards to allow for an EMC to be installed in PK District, otherwise only permitted in IS, BC, BG, and BH. This case was at the Shelby County Fairgrounds and received approval from the Board of Zoning Appeals.

This case was applied for by Springfield Signs and was heard on 11/9/2021. It received approval with conditions from the Board of Zoning Appeals. One special exception was applied for to install a high rise sign.

This case for a new industrial use on Enterprise Drive by Trinity Alloys was heard on 12/14/2021 and received approval from the Board of Zoning Appeals. Two variances were applied for- one to reduce the driveway separation distance from another street and one to increase the maximum driveway width.
