McKinney-Vento Act and Assistance

The McKinney-Vento Assistance Act is the primary piece of federal legislation dealing with the education of children and youth experiencing homelessness because all children and youth have the right to a free, appropriate public education. It was authorized as Title X, Part C of the No Child Left Behind Act, which went into effect in January 2002.


The purpose of the McKinney-Vento Education Act is to ensure that students who qualify have equal access to the same free and appropriate public education provided to all children in South Carolina. The law requires that state and local educational agencies are required to develop, review, and revise policies to remove barriers to the enrollment, attendance, and success in school that homeless children and youth may experience. Under the McKinney-Vento Act, Barnwell School District 45 (BSD45) offers various services to children.
