Personal Service Contracts are defined as contracts for services of a professional or technical nature not available through the local health department merit system (902 KAR 8:170). The two types of Personal Service Contracts are listed below, and the 20 Common Law Factors are used in determining the proper contract classification.
Employment Contract: Under common-law rules, anyone who performs services is an employee if you can control what will be done and how it will be done. Those with an employment contract will be paid through NKY Health's payroll system.
Independent Contract: General rule of thumb is that an individual is an independent contractor if the payer has the right to control or direct only the result of the work, not the means and methods of accomplishing the result. Those with an independent contract will be paid through NKY Health's invoicing procedures.
