McKinney-Vento Educational Rights
Under the McKinney-Vento Act, eligible students in homeless situations have the right to:
· Go to school, no matter where they live or how long they have lived there.
· Attend either the school of origin, if this is in their best interest, or the district school. The school of origin is the school the child attended when he/she was permanently housed or the school in which the child was last enrolled. The school assignment decision may be reviewed periodically throughout the school year with consideration to student attendance, the age of the student, the distance of the commute and its impact on the student, personal safety issues, a student’s need for specialized instruction, the length of anticipated stay in a temporary shelter, and the time remaining in the school year.
· Enroll in school immediately, even if missing records and documents normally required for enrollment, such as a birth certificate, proof of residence, previous school records, or immunization/medical records.
· Enroll, attend classes, and participate fully in all school activities while the school gathers records.
· Have access to the same programs and services that are available to all other students, including transportation and supplemental educational services.
· Receive transportation to and from the school of origin until permanently housed, if requested by the parent (based on reasonableness/feasibility).
· Receive Title I services.
· Receive free meals at school.
· Attend school with children not experiencing homelessness; a school cannot segregate a student because he or she is homeless.
Derechos Educativos McKinney-Vento
Bajo el acta McKinney-Vento, los estudiantes elegibles que no tienen una situación de vivienda estable tienen derecho a:
• Ir a la escuela, no importa donde vivan o por cuanto tiempo tienen que vivir allí.
• Asistir a cualquier escuela de origen, si esto es lo más conveniente, o la escuela de distrito. La escuela de origen es la escuela donde el niño/a ha estado asistiendo cuando el/ella tenía casa permanente o la escuela donde el niño/a había sido matriculado. La decisión de la escuela asignada puede ser revisada periódicamente a través del año escolar considerando la asistencia del estudiante, la edad del estudiante, la distancia que viaja diariamente y su impacto en el estudiante, asuntos personales de seguridad, la necesidad del estudiante de instrucción especializada, la longitud de estancia anticipada en un refugio temporal y el tiempo restante del año escolar.
• Matricular en la escuela inmediatamente, aún si algunos documentos se han perdido los cuales se requieren para matricula, como certificado de nacimiento, prueba de residencia/ contrato de renta o vacunas/información médica.
• Matricular, asistir a clases y participar completamente en todas las actividades mientras se consiguen todos los documentos.
• Tener acceso a los mismos programas y servicios que están disponibles para todos los estudiantes, incluyendo transporte y servicios educativos suplementarios.
• Recibir transporte para la escuela y desde la escuela de origen hasta que tengan una residencia permanente , si el padre lo requiere (basado en moderación/viabilidad).
• Recibe servicios de Título I .
• Recibir almuerzo gratis en la escuela.
• Asistir a la escuela con niños que no experimentan falta de vivienda; las escuelas no pueden separar a un estudiante por la razón de que el/ella no tiene vivienda.
