Consistent with the privacy protections delineated in the National Child Protection Act of 1993 (42 U.S.C. 5119 et seq.) now 34 U.S.C. 40101 et seq., the National Center for Missing and Exploited Children may make a determination whether the criminal history record information received in response to the criminal history background checks conducted under this paragraph indicates that the provider or volunteer has a criminal history record that renders the provider or volunteer unfit to provide care to children based upon criteria established jointly by, the National Center for Missing and Exploited Children, the Boys and Girls Clubs of America, the National Mentoring Partnership, and the National Council of Youth Sports. House Bill 1276 was drafted to clarify and make more explicit provisions” about which employees and adult volunteers, who work or volunteer with children, must obtain criminal background check clearances and child abuse clearances.” The bill was intended to clear up ambiguous aspects of the statute and to address concerns expressed by numerous volunteer-based organizations and other entities from across the Commonwealth that are affected by the new law.” Legislators were seeking to make the background check requirements less onerous for adult volunteers who work with children” so that an appropriate balance” is struck between protecting children and not making the requirements for volunteers so onerous that the result is losing both volunteers and consequently programs that are beneficial to children.” Starting July 25, 2015, fees for a child abuse clearance and state police criminal background check required by the Child Protective Services Law will be waived for volunteers who work with children.

Limits the cost of criminal history record checks so that "fees to nonprofit entities for background checks do not discourage volunteers from participating in child care programs."

All volunteers and paid workers are required to undergo a national criminal background check and complete a volunteer application process in accordance with Child Evangelism Fellowship's Child Protection Policy. The administrator of the program is responsible for obtaining Program Participant Form and Authorization for Background and Sex Offender Registry Checks form from employees and then verifying with Human Resources' Employment staff that faculty, administrators, and support staff working with children have been background checked within the past five years for the criminal background check and within one year for the sex offender registry check. University sponsored programs must ensure that all University employees, students and volunteers who will work with children have been subject to a criminal background check within the last five years.

Other family services agencies required by state law, licensing regulations, or DHHR policy or contract language to complete protective services background checks on potential/current employees or volunteers. - In each State, an authorized criminal justice agency of the State shall report child abuse crime information to, or index child abuse crime information in, the national criminal history background check system. According to the Policy on the Protection of Children/Young People and the Prevention of Sexual Misconduct and/or Child Abuse, all employees of the Catholic Diocese of Arlington-all direct employees of any parish, diocesan school or diocesan office-regardless of contact with children must complete a background check.
