Is the work being used for nonprofit, educational use OR as part of a commentary, criticism, or news reporting?
Is the work factual or creative? Is it published or unpublished? (Out of print is not the same as unpublished.)
What amount of the work is being used?
What effect is there of the use on the market or value of the work?
ALL 4 TESTS must be considered for fair use compliance!
Any work created by state or federal government entities
Works published before 1925 (musical recordings, film adaptations, and accompanying illustrations also must have been published before 1925)
Works whose copyright has not been renewed, or whose creator has designated them to the public domain
