Fair Use - The Four Factor Test

1. Is the material for a face 2 face class? (Online classrooms are face 2 face) Part of your curriculum?

2. Purpose of use: Are you doing something different? Transformative with the material?

3. Amount use. Is the amount you're using appropriate? Do you have to use the whole work?

4. Is anyone making or losing money?


Fair Use Analysis: You be the Judge!

Below are some scenarios. Apply Columbia's fair use checklist (HERE) and determine if the scenario favors fair use. (Assume that no special permission has been given or sought in each scenario)

The English Teacher:

A high school English teacher created a unit plan to sell via Teachers Pay Teachers. In her plan, she includes a copy of Shakespeare's Hamlet in its entirety. Her plan also includes several PowerPoint presentations containing images that she gleaned from the public domain, popular museum collections, and various other websites. The teacher provides attribution for all of the resources used in the lesson plan.

Movie Night!

As a fundraiser, a school hosts a family movie night. The school charges admission and shows a movie that is available in the public domain.

The Coach:

A school football coach likes to motivate his players by playing pop music during practice. Sometimes he plays music popular music that his students bring in and other times he streams music from his iTunes account.

The Principal:

Throughout the year, a student photographed and videotaped a variety of school events and activities. The student then compiled them into a presentation, adding popular music in the background, and saved this in DVD format. The principal plans to make copies of this DVD (with the student's permission) and sell them to the student body.
