These Terms of Use are provided by YingDeng, and questions concerning these Terms may be sent to subphavette@gmail.com.
These Terms govern your installation and use of our file recovery, photo recovery, video recovery, document recovery, and storage-scanning application, collectively referred to as the “App.”
By installing or using the App, you confirm that you have read and accepted these Terms. If you do not agree, you must not use the App.
1. App Purpose
The App is a general consumer utility designed to scan supported device storage and identify files that may still be accessible or recoverable.
Depending on your device and granted permissions, the App may search for photos, videos, audio files, documents, downloads, cached files, thumbnails, temporary data, and other supported file types.
2. License
We grant you a limited, personal, revocable, non-exclusive, non-transferable, and non-sublicensable license to install and use the App on a compatible device that you own or are legally authorized to manage.
The App is licensed rather than sold. No ownership rights in its software, design, interface, branding, or underlying technology are transferred to you.
3. Storage Permissions
The App may require permission to access photos, videos, audio, files, media, or device storage.
On supported Android versions, broad file access may be necessary to scan storage locations that cannot be examined through limited media permissions.
You are responsible for reviewing each permission request. If you deny or revoke a required permission, some scanning or recovery functions may be unavailable.
4. No Guarantee of Recovery
Successful recovery depends on factors outside our control, including:
- Whether storage areas have been overwritten.
- The time elapsed since deletion.
- Device-manufacturer restrictions.
- Android storage and permission rules.
- Storage encryption.
- File-system structure.
- Damage to the device or storage medium.
- Actions performed by other applications.
- Factory resets, formatting, or system-cleaning operations.
- Whether only a thumbnail or cached copy remains.
We do not guarantee that any particular deleted file can be found, restored, opened, or returned in its original quality.
5. Nature of Scan Results
A displayed result may be:
- An existing file that was not deleted.
- A duplicate.
- A cached or temporary file.
- A thumbnail or lower-resolution preview.
- An incomplete or corrupted fragment.
- An application resource.
- A file with inaccurate metadata.
File names, dates, sizes, paths, and previews may be incomplete or incorrect. You must inspect recovered files before relying on them.
6. Authorized Use
You may scan or recover files only from a device or storage location that you own or are authorized to access.
You must not use the App to:
- Recover another person’s files without permission.
- Obtain confidential or private information unlawfully.
- Circumvent device security, encryption, or authentication.
- Violate copyright, privacy, confidentiality, or contractual rights.
- Recover or distribute unlawful or harmful content.
- Interfere with a legal investigation or preservation obligation.
- Misrepresent your authority over a device or file.
You are responsible for the content you recover and for how you store, use, transfer, or disclose it.
7. Avoiding Additional Data Loss
Saving recovered files writes new data to storage and may reduce the possibility of recovering other deleted files.
Where possible, you should:
- Limit unnecessary device activity before recovery is complete.
- Avoid installing additional applications.
- Save recovered files to a different folder or storage location.
- Maintain independent backups of important content.
- Confirm sufficient storage space before recovery.
- Verify recovered files before deleting any source information.
We are not responsible for data overwritten through continued device use or for loss caused by device failure, insufficient storage, user actions, or third-party applications.
8. Restrictions
You must not:
- Use the App for unlawful, fraudulent, deceptive, or harmful purposes.
- Introduce malware, viruses, or destructive code.
- Disrupt or overload the App or related services.
- Bypass advertising, security, or technical controls.
- Reverse engineer, decompile, or extract source code except where permitted by law.
- Copy, sell, rent, sublicense, or redistribute the App.
- Remove copyright, trademark, or ownership notices.
- Use automated tools to reproduce or commercially exploit App functionality.
We may restrict connected functions where necessary to prevent misuse or protect security.
9. Advertising
The App may display advertisements provided by independent advertising networks.
We do not control every advertisement and do not guarantee the accuracy, legality, quality, or safety of advertised products or services.
Displaying an advertisement does not constitute an endorsement. Any communication, registration, transaction, or dispute involving an advertiser is between you and that third party.
10. Third-Party Services
The App may rely on Android functions, Google services, advertising networks, analytics providers, or other third-party technology.
Third-party services are governed by their own terms and policies. We are not responsible for their availability, security, conduct, content, or data practices.
11. Intellectual Property
The App and its source code, interface, graphics, icons, text, branding, documentation, and original technology are owned by or licensed to us and are protected by applicable intellectual-property laws.
You may not reproduce, modify, distribute, or commercially exploit these materials without authorization.
Third-party names and trademarks remain the property of their respective owners.
12. Updates and Compatibility
We may update the App to improve scanning, recovery, performance, security, compatibility, or legal compliance.
Updates may add, change, or remove features. We do not guarantee permanent compatibility with every device, Android version, storage system, or file format.
13. No Forensic or Professional Service
The App is not a professional forensic, evidence-preservation, cybersecurity, law-enforcement, or legal-discovery tool.
Recovered files and metadata may not meet forensic standards and should not be treated as authenticated evidence.
If information is required for legal proceedings, criminal investigations, regulatory matters, or critical business recovery, you should consult a qualified professional before using the device further.
14. Disclaimer of Warranties
To the maximum extent permitted by law, the App is provided on an “as is” and “as available” basis.
We do not guarantee:
- That deleted files will be found or recovered.
- That recovered files will be complete, accurate, or readable.
- That scan results will exclude duplicates, thumbnails, or existing files.
- That all storage locations or file formats will be supported.
- That the App will operate continuously or without errors.
- That use of the App will not affect the recoverability of other data.
- That every technical problem will be corrected.
Mandatory consumer rights that cannot legally be excluded remain unaffected.
15. Limitation of Liability
To the maximum extent permitted by applicable law, we are not liable for indirect, incidental, special, consequential, exemplary, or punitive losses connected with the App.
This includes losses arising from:
- Files that cannot be recovered.
- Corrupted, incomplete, or incorrectly identified results.
- Overwritten or permanently deleted data.
- Loss of photos, videos, audio, documents, or other content.
- Device or storage failure.
- Unauthorized access to a device.
- Reliance on recovery results.
- Third-party advertisements or services.
- Lost revenue, business, opportunity, or expected savings.
Where liability cannot be excluded, it will be limited to the minimum extent permitted by law.
16. Indemnification
Where legally permitted, you agree to indemnify us against third-party claims, losses, liabilities, and reasonable expenses resulting from:
- Your unlawful use of the App.
- Recovery of files without authorization.
- Violation of another person’s privacy or intellectual-property rights.
- Distribution or misuse of recovered content.
- Your material breach of these Terms.
This provision does not apply where prohibited by mandatory consumer law.
17. Ending Use of the App
You may stop using and uninstall the App at any time.
We may suspend, restrict, or discontinue all or part of the App for security, maintenance, technical, operational, or legal reasons.
Terms concerning intellectual property, user responsibility, warranties, indemnification, and liability will continue where their nature requires it.
18. Changes to These Terms
We may revise these Terms when the App, applicable law, platform requirements, security practices, or third-party services change.
The current version will be published through the App or an associated webpage. If you do not agree with a revised version, you should stop using the App.
19. Applicable Law and Disputes
These Terms are governed by applicable law without limiting mandatory consumer protections available in your jurisdiction.
You are encouraged to contact us first to seek an informal resolution. Nothing in these Terms prevents either party from using a court, regulator, consumer authority, or dispute-resolution process with lawful jurisdiction.
20. Severability
If any provision is found invalid or unenforceable, it will be limited or removed only to the extent necessary. The remaining provisions will continue in effect.
21. Entire Agreement
These Terms, together with the applicable Privacy Policy and notices displayed within the App, constitute the agreement governing your use of the App.
A failure to enforce any provision does not waive that provision or any other legal right.
