THIS END USER AGREEMENT CONTAINS A LEGALLY BINDING MANDATORY ARBITRATION AND WAIVER OF JURY TRIALS AND CLASS ACTIONS CLAUSE GOVERNING DISPUTES ARISING FROM YOUR USE OF xPDF Pro: Edit, Scan & Convert SERVICES. THIS AFFECTS YOUR LEGAL RIGHTS AS OUTLINED IN SECTION 14 BELOW. PLEASE READ THIS AGREEMENT CAREFULLY BEFORE USING THE SERVICES.
This xPDF Pro: Edit, Scan & Convert End User Agreement (the “Agreement”), including any addenda, order forms, exhibits, schedules, appendices, and amendments thereto, constitutes a legally binding agreement between you (the “User” or “you”) and xPDF Pro: Edit, Scan & Convert and its affiliates (“we,” “our,” or “us”) governing your access to and use of the xPDF Pro: Edit, Scan & Convert app, website, software, and related services (collectively, the “Services”).

By activating, accessing, or using xPDF Pro: Edit, Scan & Convert, you represent that:
• You are at least 13 years old or have reached the legal age of majority in your jurisdiction.
• You have the authority to enter into legally binding agreements.
• You accept and agree to comply with this Agreement.
If you do not agree to these terms, please do not use the Services.
We may update or modify this Agreement from time to time due to legal requirements or improvements to the Services. Updates will be reflected in the “Last Updated” date above.
Your continued use of the Services after any changes indicates your acceptance of the updated terms.
We may offer a free trial period (for example, 3 days). To avoid being charged, you must cancel the subscription at least 24 hours before the trial period ends. Otherwise, the selected subscription will automatically renew.
Subscriptions automatically renew unless auto renewal is turned off at least 24 hours before the end of the current billing period.
You may manage or disable auto renewal through your App Store account settings.
Access to premium features will remain available until the current billing period ends.
Basic features of the app may be available for free.
Premium features require a paid subscription. All pricing details are shown in the App Store at the time of purchase.
Applicable taxes may be included where required by law.
Electronic invoices may be provided upon request.
Refund requests must be submitted through the platform where the purchase was made, such as the Apple App Store or Google Play Store.
Eligibility for refunds is subject to the policies of the respective platform.
By using the Services, you agree to:
• Conduct transactions electronically
• Receive notices and communications electronically
• Accept that electronic communications are legally valid
All intellectual property rights related to the Services remain the exclusive property of xPDF Pro: Edit, Scan & Convert.
This Agreement does not grant you any ownership rights beyond the limited right to use the Services.
If you upload or share content through the Services, you grant us a worldwide, royalty free license to use such content solely for the purpose of operating and improving the Services.
You are responsible for ensuring that your content is lawful and secure.
To the fullest extent permitted by law, we are not responsible for:
• Loss of data
• Damages resulting from misuse of the Services
• Service interruptions or technical issues
Use of the Services is at your own risk.
Your use of the Services is also governed by our Privacy Policy, which forms part of this Agreement.
To the maximum extent permitted by applicable law, we shall not be liable for any indirect, incidental, special, or consequential damages arising from the use of the Services.
This Agreement shall be governed by the applicable laws of your jurisdiction, subject to the arbitration clause described below.
Any dispute arising from or related to the Services shall be resolved through binding arbitration.
By agreeing to this clause, you waive the right to:
• Jury trials
• Participation in class action lawsuits
except where such waivers are prohibited by applicable law.
