Terms of Service

Welcome to the Terms of Service (TOS) for Woodpile Works. Please review the following terms carefully. By commissioning Woodpile Works, you agree to the TOS, regardless of if you have read them. A commission is a legally binding contract for a service. You must be 18 or older to enter an agreement as such.

General Terms of Service

• All rights are reserved first and foremost.

• I reserve the right to refuse service to anyone.

• I reserve the right to post the work you purchase from me in my galleries, and use it for portfolio, personal, and commercial uses. This can be negotiated in private.

• You MUST have an up-to-date reference of your character – unless commissioning me for a reference sheet.

• I cannot be held responsible for any inaccuracies or mistakes resulting from an inadequately constructed reference sheet.

• I will not accept any artificial intelligence (AI) generated image as a reference.

• Commission slots are not first come, first served.

• Any deadlines must be requested in advance, though I reserve the right to decline if I am unable to offer a rush service – an additional fee of 25-50% of total cost of service.

• If I have any questions regarding your order, all work will be halted until I receive a response from you. I forfeit any liability for delays as a result of waiting for you to reply.

• Payments are to be paid in full via PayPal or Square. No money is to be sent until your order is accepted and payment is agreed upon. Any money sent before an agreement is in place will be considered a donation.

• Claiming the work as your own is strictly prohibited and will be considered theft. Credit to me will be required for any uses.

• You are not to upload my work into any AI chatbot or image generator. Doing so will result in you being blacklisted.

• You understand that you are ordering a one of a kind, handmade piece of art made by an artist that may and can contain imperfections, flaws, and inconsistencies. I am not a machine. 

Fursuits

• Please be advised that I work out of my home and own animals. I do not allow my animals to enter the workspace, however, I do not guarantee any work done by me will be free of any contamination. If you have severe pet allergies, I would suggest finding another maker.

• I will require a Duct Tape Dummy (DTD) if you are ordering a fullsuit. You will be responsible for the supplies needed to make the DTD, as well as shipping the DTD to me and any fees required to do so.

• I will only work directly with a client. This means that I will not make a suit if I cannot have direct contact with the intended receiver of the suit. If you intend on commissioning me to make a suit as a gift for another person, you may instead gift a slot.

• For pre-made suits:

  • All sales are final!

  • Any payment plans will require a non-refundable deposit equally 50% of the total cost of the suit, and the other 50% to be paid no later than two months of the first payment. 

  • Once the suit is fully paid off and in your possession, it is 100% yours to do what you want with it. I want you to connect with the character!

Art

• Only one re-sketch will be approved if the first was not to your liking at your request. Any further re-sketches will be an additional fee. The original sketch will not be available for your use once you forfeit it.

• In the event your piece does not turn out exactly how you wanted it after approved work in progress pictures, there will be no refund. Minor edits are okay, but otherwise my time and effort must be paid for. 

  • This includes when working with written descriptions rather than a visual reference.

• Removal of watermarks and/or signatures is strictly prohibited.

• Edits to the work is strictly prohibited unless given permission to do so.

• You have the right to share the piece to your online galleries so long as you credit me with a link back to myself or the original submission, as well as any non-commercial printing. You are not allowed to post the work on any site that would retain commercial rights to the image as a result of uploading to their servers.

• You are not to sell prints or merchandise of the work without consulting me prior. Any prints for personal use is permitted.

• What You Will Receive

  • A full-sized digital file of the work upon completion. This will be done via attachments in email or telegram.

  • If it is a traditional piece, you will receive a digital scan as well as the option to have the piece shipped to you if shipping costs are paid for.

Contract Termination

Termination of contract prior to completion:

In the event that you wish to cancel your services with me, or you breach the rules stated in the TOS, the contract will be terminated and a partial refund will be issued. I will keep a base of 50% of the price of my services. If the contract is broken during the progress of your work, an additional percentage that I feel necessary may be taken relative to the amount of work completed.

Should I initiate contract termination without violation of the TOS, a full refund will be issued.

Termination or voiding of contract after completion:

Should you break rules stated in the TOS after completion of the work, a warning will be issued in order to resolve the issue peacefully. Continuing to violate the rules will forfeit any and all rights to the artwork image and legal action will be taken.
