At WishTo App, we try to give you access of our services for 24 hour on every 7 days of a week. The website may not be available to you from time to time, for reasons including but not limited to unavoidable circumstances or for maintenance purpose. WishTo reserves the right to amend/modify these Terms and Conditions at any time, as it may deem necessary or desirable. Such changes shall be applicable as it would be available on the website. You are requested to read these terms every time you visits the website for usage or transaction.
Privacy Policy
When you purchase something from our mobile app, as part of the buying and selling process, we collect the personal information you give us such as your name, address and email address.

We also share your personal data with the delivery partner to process and deliver your products.

Our App Service
We agree to provide you Our App Service. The Service includes all of the products, features, applications, services, technologies and software that to bring you closer to the people and things that you love. The Service is made up of the following aspects:

2) Connecting you with people/users : We collect user’s information in form of their contact details and Date of Birth. So users can get to know the auspicious day of other user’s. With this we help users to connect with another user’s and wish them accordingly. By accepting this terms and conditions you provide your permission or attestation to see your Birthday details to others contacts stored in your phone. The users who are registered in our App and your stored contacts will be able to see you birthday (Date and Month).You agree to send and receive the amount from your stored contacts in your phone. We use secured UPI payments to send the amounts to your friends,family and loved ones .By accepting this terms and conditions you provide your permission or attestation to send and receive the amount from from your friends, family and the users who are your stored contacts in your phone.
3) Creating safe environment and services: We collect user’s information and provide service to Recharge their wallet and use their wallet amount to purchase and place the orders. User’s can not transfer this wallet amount to their bank account or to any other users it can only be used for purchasing the products which is listed in our app. Once orders are placed it might take another 2 to 5 days to deliver the orders based on the location.
Limitation Of Liability
To the maximum extent permitted by applicable law, in no event shall the Company or its stakeholders be liable for any special, incidental, indirect, punitive or consequential damages whatsoever (including, but not limited to, damages for loss of income, loss of profits, loss of data or other information, for business interruption, for personal injury, loss of privacy, loss of or damage to property and claims of third parties or other pecuniary loss arising out of or in any way related to the use of or inability to use the Service, third-party software and/or third-party hardware used with the Service, or otherwise in connection with any provision of this Terms), even if the Company or any supplier has been advised of the possibility of such damages and even if the remedy fails of its essential purpose.
There are some orders which are we unable to accept and can be cancelled by our side. We reserve the right to cancel any order for any reason, like under any unforeseen circumstances that may come in the way of your order that may be limitations on quantity available of purchase, error in product(s) or pricing information, or limitations of our credit department. Before cancelling any order, we will contact/ notify you. However, If the order has not been prepared or is not out for delivery, we will try to modify/cancel the order for you. If the order has already been prepared/dispatched, it cannot be cancelled/modified and you will be charged for the order.
Signup bonus and Wallet Amount Clause:
Signup bonus and wallet amount balance which is there in the app is not transferable, redeemable or cannot be shared or sent to other users/peoples wallet. It can be only used to purchase the products in the WishTo app. By accepting this terms and conditions you are giving your attestation on the sighup bonus and Wallet amount clause.
Online Ordering through and App
(i) Where any reward, offer or promotion results in or involves the issue of a gift card or voucher, you agree and acknowledge that we may attach any conditions or limitations that we deem appropriate (including but not limited to expiry dates) that are not contrary to law.
(ii) Where you have requested delivery of an order, you agree and acknowledge that we may share your personal details with our third party delivery partners to the extent necessary for your order to be fulfilled. You will be deemed to have accepted these Terms and Conditions and any other applicable terms and conditions relevant to your order at the time of payment through our nominated payment gateway.
(iii) Where you have requested your order to be made available for pick u. you will be deemed to have accepted these Terms and Conditions and any other applicable terms and conditions relevant to your order at the time of payment through our nominated payment gateway.
(iv) You agree and acknowledge that once an order is placed through the Website or App and payment is made through our nominated payment gateway and ordering process through wallet deduction that you will have no right to cancel or amend your order, or request a refund if you simply change your mind.
(v) Any orders through our online ordering service will If payment cannot be made then your order cannot be accepted. We does not store your full credit card or debit card details. You can save your preferred payment method through your online ordering account, but our third party provider will store these details for future retrieval. You expressly consent to us sharing your personal information to any third party payment provider we engage from time to time here any reward, offer or promotion results in or involves the issue of a gift card or voucher, you agree and acknowledge that we may attach any conditions or limitations that we deem appropriate (including but not limited to expiry dates)
(Vi) Returns and Refund : Due to any foreseen issue you wish to return the orders, we will not accept the returns of the orders. We will only accept the exchange of the orders and the courier/delivery charge for the return should be paid by the user or you. By accepting this terms and conditions you provide your permission or attestation on the return/refund/exchange policy set by WishTo.
Acceptable use
(i) You must not use the Website or App in any way that causes, or may cause, damage to the Website or App or impairment of the availability or accessibility of the Website or App; or in any way which is unlawful, illegal, fraudulent or harmful, or in connection with any unlawful, illegal, fraudulent or harmful purpose or activity.
(ii) You must not use the Website or App to copy, store, host, transmit, send, use, publish or distribute any material which consists of (or is linked to) any spyware, computer virus, Trojan horse, worm, keystroke logger, rootkit or other malicious computer software.
(iii) You must not conduct any systematic or automated data collection activities (including without limitation scraping, data mining, data extraction and data harvesting) on or in relation to this Website or App without our express written consent.
(iv) You must not use the Website or App to transmit or send unsolicited commercial communications.
(v) You must not use the Website or App for any purposes related to marketing without express written consent.
Returns and Replace Policy
You can mail us at info@wishsquad.in (7:00 AM to 1:00 AM, Monday-Sunday). Our representative will contact you and may ask for some details about the product delivered or defaults therein. We expect your co-operation and support in completing the process and that will allow us to resolve your complaint expediently.

We are not responsible and does not guarantee replace for cases where:
(i) gift products and preserved items are delivered to incorrect address provided by the sender.
(ii) Unsuccessful deliveries arising from the recipient not being present at the time of delivery at the address provided by the sender or the recipient refusing to accept the delivery.
(iii)Product quality problems caused by improper handling of the product by the recipient.
In the event we are unable to supply all or part of your order (the product or any substitute product to you at all), we will notify you on the delay.
The product colors and designs are sent on the basis of availability. There may be different shared in each color. The color shade of the products are shipped on the basis of availability. There is no replacement for the color issue. The size of the Men’s T-shirt and Sweatshirts\Hoodie will be shipped on the basis of the details provided by the user. If the size does not fit, we will replace the products, but the users have to bear the courier charges.
If user want to replace the products due to size mismatch can courier to us with original bill/invoice at Wishsquad Technologies, 270/222, Kamakshamma Layout, Yelahanka old town, Bangalore- 560064,Karnataka,India.
We will reship your products before 7 days once we received you products.
Deemed Delivery
Under any class or category of orders, selected by Customer, we will attempt delivery only once. In the event the delivery is not executed, due to following reasons, you shall still be charged for the order and no re-delivery will be possible. We will consider the order executed in the below cases (Deemed Delivery):
(i) Wrong shipping/delivery address.
(ii) Recipient not available.
(iii) Premises locked.
(iv) Recipient refusing to accept the delivery.
In case the recipient is not available at given address, our delivery boy will try to contact User and User can inform the delivery person to deliver the product to the gate/reception/neighbor of Recipient. As it would be a surprise for Recipient, we avoid to contact recipient in such circumstances. No request of cancellation or modification would be entertained by us, in such cases. So we request you to be sure about the details of recipient and his/her availability before placing the order.
On successful delivery, our representative or delivery personnel will request Recipient for an acknowledgement of delivery. In case of refusal by Recipient either to accept delivery or provide acknowledgment, the e-mail issued by us to User/Customer on delivery or deemed delivery of Product shall be a sufficient Proof of delivery in case of any dispute with customer.
Fraudulent Transactions
If we found any User involved in any fraudulent transaction on the website/APP, it may recover the cost of Products, collection charges and lawyers fees from persons using the Site fraudulently. Such recovery shall not prejudice the rights with us to initiate legal proceeding against such User for his/her unlawful activities.
Communications
Subject to terms of use and your registration on our website/App, you agree to receive communications from us by e-mail, SMS or any other communication made electronically, verbally or physically through post. You agree that all agreements, notices, disclosures and other communications that we provides to you by e-mail or in any other aforementioned mediums satisfy any legal requirement that such communications be in writing.
In some cases, we will be contacting the recipient before delivery. If you wish we do not contact the recipient, please call our Customer Care Number and notify them about the same.
Since we are in an occasion based gifting business, we would like to remind you in future year(s) for the same occasion. You give your consent for us to contact you through SMS, phone call and email on your registered phone number and email id, to assist you with our free Occasion Reminder Service.
Suggestion For User
Our website/APP can be used by a person who can be legally bound to contract under the Indian Contract Act, 1872. If you are a minor i.e. under the age of 18 years, you may use website/App only with the involvement of your parent or guardian. User has been referred to as “You” / “User” / “Your” in these terms and conditions.
Damaged/Defective Products
We allow exchange of products in genuine cases. However, in case if a wrong or a defective product has been delivered, do let us know at the earliest. You can reach out to us at info@wishsquad.in (7:00 AM to 6:00 PM, Monday-Sunday) within 48 hours of receiving the product. Our representative will contact you and may ask for some details about the product delivered or defaults therein. We expect your co-operation and support in completing the process and that will allow us to resolve your complaint expediently.
We will not refund the amount in any cases and only allow exchange of products. Reach out to us before 48 hours of order delivery and the cost of courier has to be borne by the customers and can be couriered back to us on the address mentioned in the invoice.
Warranties
(i) You agree and acknowledge that this Website and App has not made any and excludes all warranties, terms, conditions or undertakings, whether express or implied, written or oral, statutory or otherwise including any implied warranty of merchantability or of fitness for a particular purpose in respect of the Website and App.
