Application Name: WhichBeach Malta
Operator / Company: Seaasa Private Limited ("we", "our", or "us")
Primary Contact: connect@seaasa.com
Data Protection & Deletion Contact: connect@seaasa.com
WhichBeach Malta provides automated informational telemetry and estimates only. Never rely solely on this application to make swimming, boating, diving, or water-safety decisions.
Conditions Change Instantly: Coastal waters around the Maltese Archipelago (Malta, Gozo, and Comino) are subject to sudden shifts in currents, squalls, undertows, and swell.
Derived Estimations: Safety color codes (Green, Yellow, Orange, Red), calm water recommendations, and wind/swell exposure indices are algorithmically generated models. A "Green", "Calm", or high safety score does NOT guarantee safe swimming conditions.
Primary Authority: Always obey official on-site red/yellow flags, physical warning boards, and lifeguards (such as the Malta Red Cross and Emergency Response and Rescue Corps - ERRC). Never enter the sea where red flags are hoisted or during active maritime weather warnings.
To the maximum extent permitted under applicable law, WhichBeach Malta, Seaasa Private Limited, its directors, developers, and data partners accept NO LIABILITY whatsoever for:
Loss of life, drowning, secondary drowning, bodily injury, or physical trauma.
Marine life injuries, including jellyfish stings, sea urchin punctures, or weaver fish stings.
Illness or waterborne infections arising from bathing water quality.
Personal property damage, loss of watercraft, or salvage expenses.
You enter the sea entirely at your own risk and accept full personal responsibility for your safety and any minors or dependants in your care.
Weather & Waves: Swell, wave height, air/sea temperature, and wind data are retrieved from public sector APIs and external stations (including the Malta Met Office, ERA, and Copernicus Marine). They are subject to transmission delays, instrument failure, and localized micro-climates.
Community Reports: User-pinned reports (such as jellyfish sightings, flags, or seaweed) are crowdsourced and unverified by authorities. We do not warrant the timeliness, completeness, or accuracy of any user submission.
Amenities & Regulations: Information regarding wheelchair ramps, dog-friendly designations, Blue Flag certifications, restrooms, and local council BBQ permits may change without notice.
Billing: Upgrades to the "Go Ad-Free" version are processed securely via the Google Play Billing system. We do not receive, store, or process your credit card numbers or financial credentials.
Scope: The "Go Ad-Free" purchase removes third-party banner and interstitial advertisements served via Google AdMob. It does not alter, guarantee, or enhance the underlying meteorological data accuracy.
Refunds: All refund inquiries are governed by standard Google Play Store refund policies.
By submitting a report, observation, or pin, you grant us a perpetual, worldwide, royalty-free license to display that report to other users. You warrant that you will not post deliberately fraudulent hazard warnings, spam, abusive content, or misleading safety reports. We reserve the right to remove any pinned report without notice.
A. Governing Law: These Terms and any dispute or claim arising out of or in connection with them or their subject matter shall be governed by and construed in accordance with the laws of India, without giving effect to any conflict of law principles.
B. Dispute Resolution: Any dispute, controversy, or claim arising out of, relating to, or in connection with these Terms, including any question regarding its existence, validity, or termination, shall be referred to and finally resolved by binding arbitration under the Arbitration and Conciliation Act, 1996 of India.
C. Seat & Language: The seat and venue of arbitration shall be in Kerala, India. The proceedings shall be conducted in English.
D. Exclusive Jurisdiction: Subject to the arbitration clause above, the courts in Kerala, India shall have exclusive jurisdiction over any proceedings permitted under the Arbitration and Conciliation Act.
A. Location Information
Precise & Coarse Location (ACCESS_FINE_LOCATION, ACCESS_COARSE_LOCATION): Accessed only with your explicit permission to determine your distance to nearby bays, orient the compass, and suggest the nearest calm beaches.
No Continuous Tracking: Location coordinates are processed locally on your device to query nearby bay coordinates. We do not record historical travel paths, track your movements in the background, or sell your location data.
B. Account & Authentication Data (Optional)
Google Sign-In: If you sign in using Google, we collect your basic authentication token, public profile name, avatar URL, and email address.
Guest Mode: You may use WhichBeach Malta entirely as an anonymous guest without creating an account or providing your name or email.
C. User Hazard Reports & Media
When you submit a community report (e.g., jellyfish warning), we store the selected beach location, report type, time of report, and your optional text note.
Pinned community reports are automatically purged after 7 days to maintain live map freshness.
D. Device & Diagnostic Data
Standard technical parameters such as device model, OS build, screen resolution, locale, crash logs, and anonymized advertising identifiers (Google Advertising ID / GAID) for ad delivery.
We partner with third-party service providers that process data under strict privacy standards:
Google Mobile Ads (AdMob): Displays banner and interstitial ads for free-tier users. AdMob uses device identifiers and cookies to serve ads according to Google's Privacy & Terms.
Google Play In-App Billing: Manages purchases and entitlements for the "Go Ad-Free" premium tier.
Google Play Services & Firebase Authentication: Powers core Android functionality and secure token-based user sign-in.
Google Maps Platform: Renders satellite, hybrid, and vector map views of the Maltese Archipelago.
Cloudflare: Provides edge networking, TLS encryption, and secure API routing for community reports and weather syndication.
Public Environmental Feeds: Retrieves open environmental data from the Malta Meteorological Office, Environment & Resources Authority (ERA), European Environment Agency (EEA), and Copernicus Marine Service.
Your information is used exclusively to:
Display wind conditions, safety indices, and directions to nearby bays.
Render community-pinned reports and notify users of local jellyfish activity.
Authenticate your account for community posting.
Verify your "Go Ad-Free" purchase status across device reinstalls.
Deliver advertisements via Google AdMob (unless "Go Ad-Free" is purchased).
We do not sell, rent, or monetize your personal information to third-party data aggregators or brokers.
