WHACKAPEST (PTY) LTD*
*TERMS AND CONDITIONS OF SERVICE*
1. *Definitions*:
- "The Company" refers to WHACKAPEST (PTY) LTD, its employees, agents, and subcontractors.
- "The Customer" refers to the person or entity requesting pest control services.
- "Services" refers to the pest control treatments and related work performed by The Company.
2. *Acceptance*:
- By requesting Services from The Company, The Customer acknowledges that they have read, understood, and agreed to these Terms and Conditions.
3. *Payment Terms*:
- *Integrated Pest Management (IPM) Services*:
- 80% of the total invoice value is due upon acceptance of this quotation.
- The remaining 20% is due upon completion of the IPM services for the day.
- *Other Services*:
- The Customer shall pay The Company's invoices upon completion of service.
- A late payment fee of 10% per month shall be applied to overdue accounts.
- The Company reserves the right to suspend or terminate Services due to non-payment.
4. *Service Guarantee*:
- The Company guarantees to provide professional and effective pest control services.
- If The Customer is not satisfied with the Services, they must notify The Company within 14 days.
- The Company will re-treat the affected area at no additional cost.
5. *Liability*:
- The Company shall not be liable for any damages or losses arising from:
- Failure to follow instructions or recommendations provided by The Company.
- Pre-existing conditions or damage to property.
- Unforeseen circumstances beyond The Company's control.
- The Company's liability shall be limited to the value of the Services provided.
6. *Warranty*:
- The Company warrants that the Services will be performed with reasonable care and skill.
- The warranty shall expire 3 months from the date of the last Service.
7. *Cancellation*:
- The Customer may cancel the Services with at least 8 hours' notice.
- Failure to provide adequate notice shall result in a cancellation fee of 50% of the scheduled Service.
8. *Force Majeure*:
- The Company shall not be liable for any failure or delay in performing the Services due to unforeseen circumstances, including but not limited to:
- Natural disasters
- War or civil unrest
- Government regulations or restrictions
9. *Governing Law*:
- These Terms and Conditions shall be governed by and construed in accordance with the laws of South Africa.
10. *Dispute Resolution*:
- Any disputes arising from these Terms and Conditions shall be resolved through mediation or arbitration, as agreed upon by the parties.
By accepting these Terms and Conditions, The Customer acknowledges that they have read, understood, and agreed to be bound by them.
