It is unclear whether or not we will be able to have our voices heard during the next meeting. We are reaching out to Council member Buffkin and city staff to learn more.
As we understand things right now- June 16 is NOT a public hearing. The public hearing was closed last night. The deferral may be an another attempt to further SILENCE PUBLIC OPPOSITION TO THE REZONING.
Deferring this highly contested rezoning case makes sense given its many issues that will negatively impact the forested neighborhoods that surround Shelley Lake Park and its many park visitors each day AND growing public outcry against the rezoning.

Opposition to this rezoning has been expressed since the beginning, July 30, 2019 when ONLY residents 500 feet from the subject site were informed. The number of concerned citizens over this rezoning continues to grow as awareness about the rezoning grows.

the last remaining portion of viewshed around the lake from being severely altered due to inappropriate development,
the transitional forested and vegetative buffer that exists along the corners of West Millbrook Road and North Hills Drive that provide an aesthetically pleasing transition from residential to green/ open space ON THE PARK SIDE for motorists, pedestrians, cyclists, and non-motorized vehicles AND wildlife habitat,
the existing character of the surrounding, established forested neighborhoods which provide diverse and affordable housing choices for the residents of Raleigh.

We suggest watching three rezoning cases: Strickland Road, North Rogers Lane, and Oberlin Road. They are back-to-back and begin at -11:13:05 . Of great importance is Council member Knight’s comments regarding the level of organized opposition to the Oberlin case located at -10:05:46 . Here he states that the level of organized opposition was not sufficient (at 160 opposed).

The virtual meeting format for rezoning cases that have opposition should be deferred until a physical public hearing can be provided without fear of COVID-19 spread.

Z-41-19 was discussed first thing in the afternoon session. Disheartening to see our District A Council Member, Patrick Buffkin, NOT mention that he had received and continues to receive emails from his constituents opposed to and concerned about this rezoning case and conducting a virtual public hearing on this case.
Also disturbing is the way Z-44-19 Gresham/ Litchford Road west of Nichols Road was handled when opposition speakers were unable to be reached. We thought the right thing would be done and the case be deferred. Shockingly, the rezoning was approved without citizen input, something we fear will happen if a virtual meeting format for our rezoning case is used.

This item was deferred during the March 3, 2020 and March 17, 202 City Council meetings to allow the applicant to revise zoning conditions. A previously offered zoning condition proposed a street restriping that violated the minimum requirements of the UDO and Street Design Manual. This zoning condition has since been removed from the request and replaced with a similar condition that satisfies the minimum requirements of the UDO.
Z-41-19 Millbrook and North Hills is located at the northwest quadrant of the Millbrook Road and North Hills Drive intersection and includes a parcel at in the southwest quadrant of that intersection, being Wake County PINS 1706173253, 1706-173349, 1706171294, 1706163731, and 1706175188. Approximately 7.51 acres are requested by Beatrice Johnson, Lisa and Kirk Anderson, and Belinda and Bret Watkins to be rezoned from Residential-4 (R-4) and Residential-6 (R-6) to Residential Mixed Use-4 stories-Parking Limited-Conditional Use (RX-4-PL-CU) and Residential Mixed Use-3 stories-Parking Limited-Conditional Use (RX-3-PL-CU).
Proposed zoning conditions dated March 4, 2020, limit residential density 15 units per acre, prohibit commercial uses, provide a tree preservation area south of Millbrook Road, limit building height, provide a tree planting to buffer property to the north and along North Hills Drive, a 215-foot primary building setback from Shelly Lake Park, and propose a restriping plan that satisfies the minimum requirements of the UDO and provides for an additional left turn lane on North Hills Drive to serve Mill Greens Court.
Current Zoning: R-4 and R-6
Proposed Zoning: RX-4-PL-CU and RX-3-PL-CU
The request is consistent with the Future Land Use Map.
The request is consistent with the 2030 Comprehensive Plan overall.

Therefore, registering to speak does not guarantee the opportunity to speak, due to these limitations. If you want to make sure that your position is communicated to the City Council, proponents and opponents are encouraged to choose one or two spokespersons and/or present their concerns in writing prior to the hearing.
