Lovibe — Terms of Use

Please read these Terms of Use ("Terms") carefully before using the Lovibe mobile application ("App"). By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.

1. Acceptance of Terms

These Terms constitute a legally binding agreement between you ("User," "you") and Lovibe ("we," "us," "our"). These Terms govern your access to and use of the App and all associated services. We reserve the right to update these Terms at any time, and your continued use of the App after any changes constitutes your acceptance.

2. Eligibility

You must be at least 13 years of age to use Lovibe. By using the App, you represent and warrant that:

• You are at least 13 years old (or 16 years old if you are in the European Economic Area)

• You have the legal capacity to enter into a binding agreement

• Your use of the App does not violate any applicable laws or regulations

• If using on behalf of an organisation, you have authority to bind that organisation to these Terms

3. Account Registration

To access the full features of Lovibe, you must create an account. You agree to:

• Provide accurate, current, and complete information during registration

• Keep your account credentials confidential and not share them with others

• Notify us immediately at appsbysukhman@gmail.com if you suspect unauthorised access to your account

• Be responsible for all activity that occurs under your account

We reserve the right to suspend or terminate accounts that violate these Terms or engage in fraudulent activity.

4. Subscription and Payments

4.1 Free Plan

Lovibe offers a free tier with limited features and usage credits. The free tier is subject to change at any time at our discretion.

4.2 Paid Subscriptions

Paid plans are available on a monthly or annual subscription basis. By subscribing, you authorise us to charge your payment method through Apple's In-App Purchase system on a recurring basis.

4.3 Billing

• Subscriptions automatically renew unless cancelled at least 24 hours before the renewal date

• You can manage and cancel your subscription through your Apple ID settings

• We do not offer refunds for partial billing periods, except where required by law

• Prices may change with at least 30 days' prior notice

4.4 Apple In-App Purchases

All payments are processed by Apple through the App Store. Apple's payment terms apply. Lovibe does not directly handle your payment card information.

5. Acceptable Use

You agree to use Lovibe only for lawful purposes. You must not use the App to:

• Build, host, or distribute apps that are illegal, harmful, or infringe on third-party rights

• Create malware, spyware, phishing tools, or any malicious software

• Generate or distribute content that is defamatory, obscene, hateful, or threatening

• Infringe any intellectual property rights, including patents, trademarks, or copyrights

• Collect or harvest personal data of others without their consent

• Attempt to gain unauthorised access to our systems or other users' accounts

• Reverse engineer, decompile, or attempt to extract source code from the App

• Use the App in a way that exceeds usage limits or abuses the credit system

• Resell, sublicense, or commercially exploit access to the Lovibe platform without authorisation

We reserve the right to suspend or terminate your account if you violate these rules.

6. Your Content

6.1 Ownership

You retain all intellectual property rights to the content, projects, and apps you create using Lovibe. We do not claim ownership over your work.

6.2 Licence to Lovibe

By using the App, you grant Lovibe a limited, non-exclusive, royalty-free licence to host, store, process, and display your content solely for the purpose of providing and improving the App's services.

6.3 Generated Code

Code generated by Lovibe's AI is provided for your use. You are responsible for reviewing generated code before deploying it. Lovibe does not guarantee that generated code is free from errors, security vulnerabilities, or third-party licence obligations.

6.4 Content Standards

You are solely responsible for the apps and content you build and deploy using Lovibe. You must ensure your projects comply with all applicable laws, including data protection laws, consumer protection laws, and intellectual property laws.

7. Intellectual Property

The Lovibe name, logo, App design, and all underlying technology are the exclusive property of Lovibe and are protected by intellectual property laws. You may not use our trademarks, trade names, or branding without our prior written consent.

8. Third-Party Services

Lovibe integrates with third-party services including Stripe (payments), Supabase (database), and GitHub (code repositories). Your use of these services is governed by their respective terms and privacy policies. Lovibe is not responsible for the practices of third-party providers.

9. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, Lovibe DISCLAIMS ALL WARRANTIES, INCLUDING:

• Implied warranties of merchantability, fitness for a particular purpose, and non-infringement

• Warranties that the App will be uninterrupted, error-free, or secure

• Warranties regarding the accuracy, completeness, or reliability of AI-generated content or code

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, Lovibe SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES, ARISING FROM YOUR USE OF OR INABILITY TO USE THE APP.

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM THESE TERMS OR YOUR USE OF THE APP SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 3 MONTHS PRECEDING THE CLAIM, OR $50 USD, WHICHEVER IS GREATER.

11. Indemnification

You agree to indemnify, defend, and hold harmless Lovibe and its officers, employees, and agents from any claims, damages, losses, or expenses (including reasonable legal fees) arising from: (a) your use of the App; (b) content you create or deploy; (c) your violation of these Terms; or (d) your violation of any third-party rights.

13. Governing Law and Disputes

These Terms are governed by applicable law. Any disputes arising from these Terms or your use of the App shall be resolved through good-faith negotiation first. If unresolved, disputes shall be submitted to binding arbitration or the courts of competent jurisdiction.

14. Changes to the App

We reserve the right to modify, suspend, or discontinue any aspect of the App at any time, including features, pricing, or availability. We will provide reasonable notice of material changes where possible.
