## 2. Description of Service
Wake is an AI voice and text assistant designed to provide conversational support and coaching. The App is intended for informational and self-help purposes only and is not a substitute for professional mental health services.
## 3. User Eligibility
You must be at least 13 years of age to use the App. If you are under 18, you should review these Terms with a parent or guardian to ensure you both understand them.
## 4. User Accounts
When you create an account with Wake:
- You are responsible for maintaining the confidentiality of your account information
- You agree to provide accurate and complete information
- You are solely responsible for all activities that occur under your account
## 5. Subscription Services
Wake offers both free and premium subscription services:
- Free tier includes limited daily messaging and calls
- Premium subscriptions provide unlimited messaging and calls, conversation history, and an ad-free experience
- Subscription fees are charged through your Apple App Store account
- Subscriptions automatically renew unless canceled at least 24 hours before the current period ends
- You can manage and cancel subscriptions through your App Store account settings
## 6. Privacy
Your use of the App is also governed by our Privacy Policy, which can be found at https://sites.google.com/view/wakeai/privacy-policy
## 7. User Content
You retain ownership of any content you provide to the App during conversations. By using the App, you grant Wake a worldwide, non-exclusive license to use, store, and process your content solely for the purpose of providing and improving the Services.
## 8. Prohibited Uses
You agree not to:
- Use the App for any illegal purpose
- Upload or transmit harmful content or malware
- Attempt to gain unauthorized access to the App or its systems
- Use the App to harass, abuse, or harm others
- Interfere with or disrupt the App or servers

Wake is powered by AI technology and:
- Is not a substitute for professional medical, psychological, legal, or financial advice
- May occasionally generate inaccurate information
- Should not be relied upon in emergency situations
- Is designed as a supportive tool, not a diagnostic or treatment solution

The App, including all content, features, and functionality, is owned by Wake and is protected by intellectual property laws. You may not reproduce, distribute, modify, create derivative works of, publicly display, or exploit any portion of the App without prior written consent.

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
## 12. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL WAKE, ITS AFFILIATES, OR THEIR LICENSORS, SERVICE PROVIDERS, EMPLOYEES, AGENTS, OFFICERS, OR DIRECTORS BE LIABLE FOR DAMAGES OF ANY KIND ARISING OUT OF OR IN CONNECTION WITH THE USE OF THE APP.

You agree to defend, indemnify, and hold harmless Wake and its affiliates from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees arising out of your violation of these Terms.
## 14. Term and Termination
These Terms remain in effect while you use the App. Wake reserves the right to terminate or suspend your access to the App at any time without notice for any reason.

Wake reserves the right to modify these Terms at any time. We will notify users of material changes by posting the updated Terms on the App or via email.
