Terms & Conditions for Vyclo

Please read these Terms and Conditions ("Terms", "Terms and Conditions") carefully before using the Vyclo mobile application (the "Service" or "Licensed Application") operated by [Oskar Telker] ("Developer", "us", "we", or "our").

1. Acceptance of Terms

By accessing or using the Service, you ("End-User" or "you") agree to be bound by these Terms. If you disagree with any part of the terms, then you may not access the Service.

2. Acknowledgement

You and the Developer acknowledge that these Terms constitute an agreement between you and the Developer only, and not with Apple Inc. ("Apple"). The Developer, not Apple, is solely responsible for the Licensed Application and its content.

3. Scope of License

The Developer grants you a non-transferable license to use the Licensed Application on any Apple-branded products that you own or control, as permitted by the Usage Rules set forth in the Apple Media Services Terms and Conditions. This Licensed Application may be accessed and used by other accounts associated with you via Family Sharing or volume purchasing.

4. Description of Service

Vyclo is a mobile fashion app that lets user virtually try on clothes and get ideas & inspiration for outfits. 

5. Maintenance and Support

The Developer is solely responsible for providing maintenance and support for the Licensed Application. Apple has no obligation to furnish any maintenance and support services with respect to the Licensed Application.

6. User Content

Our Service allows you to take photos and videos. You are responsible for the content you capture and share. We do not tolerate any content that is:

- Abusive, harassing, or offensive

- Illegal or infringing on third-party rights

- Explicit or otherwise objectionable

We may block, remove, or disable content that violates these Terms, and accounts may be suspended or terminated for repeated violations.

7. Subscription & Credits

The App offers a monthly subscription (Vyclo Pro Monthly - $7.99) that provides users with 100 Credits per Month to use for Outfit Generations, Analysis and the Virtual Wardrobe.

The App also offers a yearly subscription (Vyclo Pro Yearly - $79.99) that provides users with 1200 Credits per Year to use for Outfit Generations, Analysis and the Virtual Wardrobe..

• The subscription will automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period.

• You can cancel your subscription at any time through the Subscriptions section of the App Store.

• Payment will be charged to your App Store account at confirmation of purchase.

• Additionally bought Credit Packages are one-time purchases & non-refundable. 

• Local Prices may apply 

8. Warranty

The Developer is solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. In the event of any failure of the Licensed Application to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the Licensed Application to you. To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the Licensed Application, and any other claims, losses, liabilities, damages, costs, or expenses attributable to any failure to conform to any warranty will be the Developer's sole responsibility.

9. Product Claims

You and the Developer acknowledge that the Developer, not Apple, is responsible for addressing any claims by you or any third party relating to the Licensed Application or your possession and/or use of the Licensed Application, including, but not limited to: (i) product liability claims; (ii) any claim that the Licensed Application fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy, or similar legislation.

10. Intellectual Property Rights

You and the Developer acknowledge that, in the event of any third-party claim that the Licensed Application or your possession and use of that Licensed Application infringes that third party's intellectual property rights, the Developer, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of any such intellectual property infringement claim.

11. Legal Compliance

You represent and warrant that (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.

13. Third Party Terms of Agreement

You must comply with applicable third-party terms of agreement when using the Licensed Application.

14. Third Party Beneficiary

You and the Developer acknowledge and agree that Apple, and Apple's subsidiaries, are third-party beneficiaries of these Terms, and that, upon your acceptance of the terms and conditions of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary thereof.

15. Refunds and Right of Withdrawal

If the App doesn't work as intended or if you experience problems with our App that prevent you from adequately using the App, you may have the right to withdraw from your purchase. If we are unable to resolve these issues, you may request a refund through the App Store.

16. Limitations of Liability

To the maximum extent permitted by applicable law, in no event shall the Developer be liable for any indirect, punitive, incidental, special, consequential or exemplary damages, including without limitation, damages for loss of profits, goodwill, use, data or other intangible losses, arising out of or relating to the use of, or inability to use, the Service.

17. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect.

18. Governing Law

These Terms shall be governed and construed in accordance with the laws of Germany, without regard to its conflict of law provisions.
