These Terms govern your access to and use of the Voki mobile application (the “App”) and any related features, content, and services provided by Voki (collectively, the “Service”).
By downloading, installing, accessing, or using the Service in any manner, you acknowledge that you have read, understood, and agree to be bound by these Terms.
If you do not agree to any part of these Terms, you must immediately stop using the Service and uninstall the App.
These Terms were originally written in English. In the event of any inconsistency between the English version and any translated version, the English version shall prevail.
Changes to the Terms and the Service
We may update or revise these Terms from time to time to reflect changes to the Service, legal or regulatory requirements, or other legitimate business needs.
If we make material changes, we will notify you through reasonable means, such as in-app notices or updating the “Last Updated” date. Unless otherwise stated, the revised Terms will become effective when posted.
By continuing to use the Service after the updated Terms take effect, you agree to be bound by the revised Terms. If you do not agree, you must stop using the Service and uninstall the App.
To the extent permitted by law, Voki reserves the right to modify, suspend, or discontinue any part of the Service at any time.
Eligibility
The Service is available only to individuals who are at least 13 years old, or such higher minimum age as required by applicable law in your jurisdiction.
If you have not reached the age of legal majority where you live, you may use the Service only with the consent and supervision of a parent or legal guardian, who agrees to be bound by these Terms.
You may not access or use the Service if:
You do not agree to these Terms;
Applicable law prohibits your use of the Service; or
Your access has been suspended or terminated by Voki.
Prohibited Conduct
You agree not to misuse the Service and not to permit others to do so through your account or device. In particular, you agree not to:
Use the Service in any manner not expressly permitted by these Terms;
Violate any applicable laws, regulations, or third-party rights;
Upload or provide any content that is unlawful, fraudulent, misleading, defamatory, abusive, obscene, pornographic, sexually suggestive, hateful, violent, harassing, or discriminatory;
Upload or provide content involving the exploitation or endangerment of minors;
Infringe intellectual property, privacy, or publicity rights;
Copy, reverse engineer, modify, or create derivative works of the Service;
Circumvent or interfere with security features, content filters, or technical safeguards;
Scrape, collect, or extract data from the Service without authorization;
Disrupt or interfere with the integrity, security, or performance of the Service.
Intellectual Property
Except as expressly stated otherwise, all rights, title, and interest in and to the Service, including all related software, technology, designs, interfaces, features, branding, and content, are owned by or licensed to Voki and are protected by applicable intellectual property laws.
Subject to your compliance with these Terms, Voki grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Service solely for your personal, non-commercial purposes.
All rights not expressly granted are reserved by Voki.
User-Provided Content (Not User-Generated Content)
The Service may allow you to upload or provide text, images, videos, audio, or other materials solely as input for your personal use of the Service and its AI features (“User-Provided Content”).
Important clarifications:
The Service does not provide any content sharing, public posting, community, or social networking features;
Your User-Provided Content and any results generated from it are visible only to you;
Voki does not display, distribute, or make your content available to other users.
You retain ownership of your User-Provided Content.
To provide the Service, you grant Voki a limited, non-exclusive, royalty-free license to process, generate, and display your User-Provided Content only during your active use of the Service.
You represent and warrant that:
You own or have obtained all necessary rights to use and provide such content;
Your content does not violate any applicable laws or third-party rights.
Generative Artificial Intelligence Features
The Service may include features powered by artificial intelligence (“Generative AI Features”) that allow you to submit User-Provided Content as input and receive generated results as output.
You acknowledge and agree that:
Output is generated automatically and may not be unique;
Output may contain inaccuracies, biases, or unintended results;
You are solely responsible for how you use any generated output.
You may not use the Generative AI Features to generate or use content that:
Exploits, harms, or involves minors;
Is sexually explicit, pornographic, or sexually suggestive;
Promotes violence, hatred, discrimination, or extremism;
Encourages illegal, dangerous, or harmful activities;
Attempts to bypass safeguards or misuse the AI systems.
Disclaimer of Warranties
The Service is provided on an “AS IS” and “AS AVAILABLE” basis.
To the maximum extent permitted by law, Voki disclaims all warranties, whether express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, reliability, and non-infringement.
Voki does not warrant that the Service will be uninterrupted, secure, error-free, or meet your expectations.
Termination
You may stop using the Service at any time.
Voki may suspend or terminate your access to the Service if you violate these Terms or if necessary to protect the Service, users, or comply with legal obligations.
Upon termination, you must immediately cease all use of the Service.
Limitation of Liability
To the maximum extent permitted by law, Voki shall not be liable for any indirect, incidental, consequential, or special damages arising out of or related to your use of the Service.
Where liability cannot be excluded, it shall be limited to the minimum extent permitted by applicable law.
Governing Law
These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict-of-law principles and without prejudice to mandatory consumer protection laws.
