1. Acceptance of Terms

These Terms of Service ("Terms") govern your access to and use of the VoiceCaster mobile application ("App"), operated by Kello Solutions ("Company", "we", "our", or "us").

By downloading, installing, accessing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the App.

2. Description of the Service

VoiceCaster is a mobile application that enables users to:

• Connect to compatible Bluetooth audio devices.

• Use a mobile device microphone with connected audio devices.

• Apply voice filters and audio effects.

• Record and save audio recordings.

• Play back and manage recordings.

• Use equalizer presets and audio enhancement features.

Features may be modified, updated, limited, or discontinued at any time.

3. Eligibility

You must be at least 13 years old to use the App.

If you are under the age of majority in your jurisdiction, you may use the App only with the involvement and consent of a parent or legal guardian.

4. License to Use the App

Subject to these Terms, Kello Solutions grants you a limited, non-exclusive, non-transferable, revocable license to use the App for personal and lawful purposes.

You may not:

• Reverse engineer or attempt to extract source code.

• Modify, reproduce, distribute, or resell the App.

• Use the App in violation of applicable laws.

• Circumvent security or technical restrictions.

All rights not expressly granted remain the property of Kello Solutions.

5. User Content

Audio recordings created using the App remain your property.

You are solely responsible for:

• The content you record.

• Compliance with applicable laws.

• Obtaining any necessary permissions from individuals whose voices are recorded.

You represent and warrant that your use of the App and any recordings created through it do not violate the rights of any person or entity.

6. Prohibited Uses

You agree not to use the App to:

• Violate any applicable law or regulation.

• Infringe intellectual property rights.

• Harass, threaten, or impersonate others.

• Record individuals without authorization where required by law.

• Distribute unlawful, defamatory, or harmful content.

• Attempt unauthorized access to systems or networks.

Kello Solutions reserves the right to restrict access to users who violate these Terms.

7. Bluetooth and Device Compatibility

VoiceCaster relies on third-party hardware and operating system functionality.

We do not guarantee:

• Compatibility with all Bluetooth devices.

• Continuous connectivity.

• Specific audio quality.

• Latency-free performance.

• Availability of all features on all devices.

Performance may vary depending on hardware, operating system, and Bluetooth implementation.

8. Recordings and Data Storage

Unless otherwise stated:

• Audio recordings are stored locally on your device.

• You are responsible for managing and backing up recordings.

• Kello Solutions is not responsible for lost recordings or data.

Deleting the App may result in the loss of recordings stored on the device.

9. Intellectual Property

The App, including its design, branding, software, graphics, and content, is owned by Kello Solutions and protected by applicable intellectual property laws.

You may not use our trademarks, logos, or branding without prior written permission.

10. Third-Party Services

The App may include or interact with third-party services, operating systems, Bluetooth technologies, or software components.

Kello Solutions is not responsible for the availability, performance, or content of third-party services.

Your use of such services may be subject to separate terms and conditions.

11. Disclaimer of Warranties

The App is provided on an "as is" and "as available" basis.

To the fullest extent permitted by law, Kello Solutions disclaims all warranties, whether express, implied, statutory, or otherwise, including warranties of:

• Merchantability

• Fitness for a particular purpose

• Non-infringement

• Availability

• Reliability

We do not guarantee that the App will be uninterrupted, error-free, or free from defects.

12. Limitation of Liability

To the maximum extent permitted by law, Kello Solutions shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising from or related to:

• Use of the App.

• Inability to use the App.

• Data loss.

• Device incompatibility.

• Audio quality issues.

• Bluetooth connectivity issues.

In no event shall our total liability exceed the amount paid by you for the App, if any, during the twelve months preceding the claim.

13. Indemnification

You agree to indemnify and hold harmless Kello Solutions, its officers, employees, and affiliates from any claims, damages, losses, liabilities, and expenses arising from:

• Your use of the App.

• Your recordings or content.

• Violation of these Terms.

• Violation of applicable laws or third-party rights.

14. Termination

We may suspend or terminate access to the App at any time if we believe you have violated these Terms or applicable laws.

You may stop using the App at any time by uninstalling it from your device.

15. Changes to These Terms

We may update these Terms from time to time.

Updated versions will become effective upon publication within the App or through other appropriate notice.

Continued use of the App after changes become effective constitutes acceptance of the revised Terms.

16. Governing Law

These Terms shall be governed by and interpreted in accordance with the laws applicable to Kello Solutions, without regard to conflict of law principles.

Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the competent courts in the applicable jurisdiction.
