To finish my ditch meeting.

1. I pay my ditch dues. Have an excel spreadsheet from Former Graves Atteberry Ditch Secretary Virginia Lendberg showing

Neither Brent Hamilton His son nor his father were paying ditch dues.

2. If they are not cleaning or repairing their portion of the ditch which has an easement and right of way through their property that can cause leaks or restrictions to the rest of the users water. If mine leaks or overflows I have to sod it in shovel some dirt or clean the portion with a shovel until I can make better repairs. I have pictures going back 15yrs of their shutting off the ditch or turning it down with time date and GPS location stamps.

Restrictions Brent used to have a ypipe with a ball in it where the ditch originates on the property from the headgate. Once I can remember he took the checkball out of the ditch and left for a week leaving the other 10 users of the ditch without water. On holidays or when it used to rain he would shut ditch down or off. I have several pictures of this over the years time date and location stamped.

3. Brent is not the mayor or an elected official of Cedar Hill New Mexico nor does he have any official capacity on the ditch (Graves Atteberry or OUR lateral) to control or interfere with it.

4. Their negligence or BS excuses for turning the ditch off or down Interferes with 10 peoples water rights damages property and equipment. I had to have my pump repaired due to them turning the ditch down my pond went too low and the seals and bearings were damaged in my pump. Cost $1300

5. If they are not using the ditch, paying ditch dues, making lies excuses for turning the ditch down and or off, are not officials of the graves-atteberry ditch nor OUR lateral then their only interest in the ditch is to CONTROL our water and water rights for ego Power Trip or Criminal reason.

6. Their son bragged about fouring me and was aggressive toward me. I recorded everything with VA Voice Activated Recorder on my 5g Phone and it was uploaded to a safe cloud server. This is legal under the single party consent rule In New Mexico as I was part of the recording.

7. Did ya know when my dad was alive they were shutting off the ditch on us so I went up and chained the headgate open with a magnetic padlock so we could water and they cut it off with bolt cutters and took it?

hmm also remember when my father was alive having trouble getting water shut down or off in the ditch and pond so I went up put a chain and magnetic padlock on the ditch so he could water. Next day they used bolt cutters and took the lock and chain.

8. Linda Digeria and Brent Hamilton are friends or family. Used car hauler to bring backhoe and car back for her and Dominic.

They shut the ditch down to put in pipe in hot part of season instead of waiting until season over then doing it.

9. Wendel Lau was the only one that told me honestly what had been going on Don Woods and his son Don Jr were harassing squeezing them to try to get them to sell their place to them so they could subdivide and sell their place like they did sell to Loy Hilton Richard Ray and Dominic Digeria the leftover lot from this was given to their son JR Wood. Don Jo Ann and Jr all died within 2weeks of thanksgiving 5 years ago. I have cleaned shoveled weedeated the ditch and taken car of reducing fire hazards on their place and they were running around complaining and shooting shot gun with blanks to harass my father and me to heart attack. I spend my money time and equipment on this no one says thanks reimburse for anything. And everyone harass me for entertainment.

10. Richard Ray kind of henchman for Don Wood. Helped them install Some of the pipe in the ditch on the railroad trellis and to the highway 550 pipe. He was the 1st person to harass me with watering on the place 2003 walked over climbed under barbed wire fence claimed wasn't getting water so I thought we were both working to clean ditch and find out why no water. Then he started hollering I better get some water down here. I asked him to please leave the place. He called the sheriff department and had a Deputy come over to talk to me. He was trying to intimidate me to keep me from watering and played a victim. My cousin Cindy Russel Gene Russel and Lillian Russel lived in Aztec all my life Cindy when I was in college worked as dispatcher for Sheriffs office. Lillians last job was sample server at SAMS Club. Gene Drove truck for Plateau Gas. The Deputy they sent had known Cindy and gave me a card and home number to call if any more problems. I finished watering.

11. Gold king mine spill caused irrigation Problems.

12. Millers Wash had some damage washout that caused some irrigation problems during repairs.

13. Don and Jo Ann Woods place had no visable ditch from Highway 550 to the driveway. I asked Ricky Herrera to backhoe some of the ditch he did but I had to clean up the piles along the ditch. It silted in 1st year after. I used a squarepoint shovel and spadepoint and my hands to make a nice ditch so it would not be running all over the place and people down below wouldn't complain to me about water also less mosquitos and less evaporation. For free several pairs of ripped pants and arthritis. Everyone would complain to me in prior years about water I owned 3 to 7 times as much land to water dragging big guns by hand to water 23 years. My 81 year old mother cannot water even a pitcher for flowers.

14. People use the Woods place to harass me. Come out there trespass and pretend to be buyers of place they cannot afford and aggrevate me with playing dumb questions or BS stories while I need to be working or watching my mother and animals. One such was New Mexico Militia Leader Johnny Horton JR from Flora Vista NM he was going to buy have tour busses helicopter pad blah blah

Latest Aholes Memorial day at the fence done my homework blah blah blah trespassing for hour and half delaying me from my watering. 2 weeks later the lady with little girl pulled up and put stopper in the ditch and left the place blocking everyones watering no water rights or property ownership just BS upset my mother. I pulled the stopper out and dealt with ahole on phone FU blah blah blah was cussed out BSed and harassed in one of the hottest driest drought years.

All so everone could water and I would not be complained to.

15. Everyone harasses me for entertainment.

16. No one has cleaned or helped clean the Ditch from my fence to the next road since I cleaned and shoveled it out after Wendel Lau died in ~ 2006. After Wendel died his wife Jill tried to take care of the place she had my father help take out some of the russian olive trees with our kubota tractor removed the barn installed North Star water and bought a new electric pump to irrigate with. People around here seem to attack widows and or rip them off. One night someone on purpose turned up the ditch flooded and shorted out ruined the new pump.
