These Terms of Service ("Terms") constitute a legally binding agreement between you ("you" or "user") and VidGlow ("we," "our," or "us"). These Terms govern your access to and use of the VidGlow mobile applications (the "App"), websites, and related services, including AI image/video generation features (collectively, the "Service").
By downloading, installing, accessing, or using the Service, you agree to be bound by these Terms. IF YOU DO NOT AGREE TO THESE TERMS, DO NOT ACCESS OR USE THE SERVICE, AND IMMEDIATELY UNINSTALL THE APP FROM YOUR DEVICE.
1. ELIGIBILITY AND AUTHORITY
1.1 Age Requirement The Service is not intended for individuals under the age of 18 (or 13 in certain jurisdictions where local law permits, subject to parent/guardian consent). By using the Service, you represent that you are at least 18 years old.
1.2 Minors If you are between the legal age of majority and 16, your parent or legal guardian must review and accept these Terms on your behalf prior to your use of the Service.
2. CHANGES TO TERMS AND SERVICES
We reserve the right to modify these Terms or update the Service at any time (e.g., to reflect changes in functionality, laws, or regulatory requirements).
2.1 Notice of Changes We will notify you of material changes by updating the "Last Updated" date, sending an in-app notification, or via email.
2.2 Continued Use Your continued use of the Service after the updated Terms become effective constitutes your acceptance of the revised Terms.
3. LICENSE AND INTELLECTUAL PROPERTY RIGHTS
3.1 Our Rights We and our licensors retain all rights, title, and interest (including all intellectual property rights) in and to the Service, App design, underlying software, and proprietary AI models.
3.2 Limited License Subject to these Terms, we grant you a personal, non-exclusive, non-transferable, revocable license to download and use the App on your personal mobile device solely for non-commercial purposes.
4. USER-GENERATED CONTENT (UGC) AND GENERATIVE AI
The Service allows you to upload text, images, or media ("Input") and generate AI outputs ("Output"). Input and Output are collectively referred to as "User-Generated Content" or "UGC."
4.1 Ownership As between you and VidGlow, you retain ownership of your Input and Output, subject to applicable law and third-party rights.
4.2 License to VidGlow You grant us a worldwide, royalty-free, non-exclusive license to process, host, reproduce, and use your UGC solely to operate, deliver, and maintain the Service. We will never use your private UGC to train underlying AI models without your explicit consent.
4.3 User Responsibility You are solely responsible for your UGC and represent that you have all necessary rights to upload and generate such content without infringing third-party rights.
5. PROHIBITED USES AND CONTENT RULES
To comply with Google Play Developer Policies and maintain platform safety, you strictly agree NOT to use the Service to upload, generate, or distribute content that:
(a) Child Sexual Abuse Material (CSAM): Exploits, abuses, or endangers minors in any way. (b) Sexually Explicit Material: Depicts explicit nudity, sexual acts, or pornography intended for sexual gratification. (c) Non-Consensual Imagery: Creates intimate images or deepfakes of real individuals without their explicit authorization. (d) Hate Speech & Violence: Promotes discrimination, incites violence, or glorifies self-harm against individuals or protected groups. (e) Illegal Activities & IP Infringement: Violates any local law, defrauds others, impersonates real entities, or infringes on copyrights/trademarks. (f) Platform Abuse: Attempts to bypass safety filters, scrape data, reverse-engineer the App, or disrupt server infrastructure.
6. SUBSCRIPTIONS, PURCHASES, AND REFUND POLICY
6.1 In-App Purchases & Subscriptions All digital products, virtual credits, and premium subscriptions offered through the App are processed via Google Play Billing. Payment will be charged to your Google Play Account upon confirmation of purchase.
6.2 Auto-Renewal and Cancellation (a) Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current subscription period. (b) You can manage or cancel your subscription at any time in your Google Play Account Settings (Google Play Store -> Menu -> Subscriptions). (c) Uninstalling the App does NOT automatically cancel your active subscription. You must cancel it through Google Play.
6.3 Refund Policy (a) All financial transactions and refunds are governed by Google Play’s Refund Policies. (b) To request a refund, please submit your request directly through Google Play Order History within the eligibility window provided by Google Play (typically within 48 hours of purchase). (c) For exceptional billing inquiries or verified system errors, you may contact our support team at service@vidglowai.com with your Google Play Order ID.
7. ACCOUNT TERMINATION AND ENFORCEMENT
7.1 By You You may terminate these Terms at any time by deleting your account within the App settings and uninstalling the App.
7.2 By Us We reserve the right to suspend or permanently terminate your access to the Service immediately without notice if you violate these Terms, Google Play Policies, or applicable laws.
7.3 Safety Logs Upon termination due to policy violations, safety logs may be retained as permitted by applicable law to prevent further abuse.
8. DISCLAIMER OF WARRANTIES
THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT AI-GENERATED OUTPUTS WILL BE ACCURATE OR RELIABLE.
9. LIMITATION OF LIABILITY
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, VIDGLOW SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
10. GOVERNING LAW AND DISPUTE RESOLUTION
These Terms shall be governed by and construed in accordance with the laws of Hong Kong, without regard to its conflict of law principles. Any dispute arising from these Terms shall be resolved through good-faith negotiation or competent courts in Hong Kong.
