1. Acceptance of Terms

By downloading, installing, accessing, or using US Citizenship Test (the “App”), you agree to be bound by these Terms of Use (the “Terms”) and our Privacy Policy. If you do not agree to these Terms, do not use the App.

You must be at least 13 years old to use the App, or at least 16 years old if you are located in the European Economic Area. If you are under the age of majority in your jurisdiction, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.

2. Description of Service

US Citizenship Test is a study and practice app designed to help users prepare for the civics and interview portions of the U.S. naturalization process. The App may allow users to:

- Review civics questions and answers based on publicly available USCIS study materials

- Take practice quizzes and mock test sessions

- Use flashcards, study guides, explanations, and progress tools

- Receive study reminders and notifications

- Access premium features, including broader content access and an ad-free experience where available

- Share the App with friends or family

The App does not provide AI-generated answers, legal advice, immigration advice, or official government determinations. The App is provided for educational and informational purposes only.

The App is not affiliated with, endorsed by, or sponsored by USCIS, the U.S. Department of Homeland Security, or any government agency. Official naturalization requirements, accepted answers, and procedures may change over time.

The App is provided on an “as is” and “as available” basis. Availability, speed, and feature access may vary based on device compatibility, operating system, network conditions, app store services, third-party providers, and other factors.

3. Accounts, Devices, and Access

The App may use device-based identifiers, app-instance data, or marketplace purchase records to manage subscription status, feature access, usage limits, restore purchases, and abuse prevention.

You are responsible for:

- Maintaining the security of your device

- All use of the App from your device

- Using the App only in compliance with applicable laws and app store rules

- Reviewing official USCIS resources when accuracy matters

We may suspend, restrict, or terminate access if we detect abuse, fraud, unauthorized automation, attempts to bypass limits, or violations of these Terms.

4. User Conduct and Prohibited Uses

You agree to use the App only for lawful, personal, and non-commercial purposes unless expressly permitted by us in writing.

You may not use the App to:

- Violate any law, regulation, or third-party right

- Reverse engineer, decompile, scrape, copy at scale, or attempt to extract source logic or protected app content except as permitted by law

- Bypass paywalls, feature gates, usage limits, restore controls, or subscription restrictions

- Use bots, scripts, or automated systems to access the Service at scale

- Resell, repackage, or offer the App’s study materials, explanations, or outputs as a standalone paid service

- Misrepresent the App as an official USCIS or government product

- Use the App to provide legal, immigration, or other regulated professional services without appropriate qualifications

- Interfere with the App’s normal operation, security, or payment flows

Violations may result in immediate suspension, restriction, or termination of access.

5. Intellectual Property and Licensing

5.1 Ownership

JanoGroup LLC, its affiliates, licensors, and service providers retain all rights, title, and interest in and to the App, including its software, design, interfaces, branding, study tools, compilations, and original materials, except for third-party or public-source materials that remain subject to their respective rights.

5.2 Free Tier License

Free access grants you a limited, revocable, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes only, subject to any feature restrictions, preview limits, practice limits, or advertising-supported access shown in the App.

5.3 Paid Subscription License

If you purchase or activate a paid subscription or trial, you receive a limited, personal, non-exclusive, non-transferable license to use premium App features during the active subscription period.

Premium access may include broader access to questions, explanations, flashcards, interview-prep tools, progress features, and ad-free use where offered.

Paid access does not grant you the right to:

- Resell App content commercially

- Build a competing study product from App content or outputs

- Perform automated bulk export, scraping, or republication

- Represent the App as an official or government-approved training or certification service

5.4 Accuracy Disclaimer

Study materials, explanations, reminders, scores, and progress indicators may be incomplete, inaccurate, outdated, or unavailable. In particular:

- Civics answers may change due to elections, appointments, legislation, or government updates

- Practice scores in the App do not guarantee interview or naturalization outcomes

- The App may simplify or summarize information for study purposes

- The App is not a substitute for official USCIS instructions, legal advice, or professional immigration guidance

Always consult official USCIS resources, current government materials, or qualified professionals when accuracy matters.

5.5 Third-Party Providers

Parts of the App rely on third-party providers, including app marketplaces, payment processors, subscription platforms, analytics providers, notification services, advertising services, hosting providers, and infrastructure providers.

We are not responsible for outages, policy changes, pricing changes, service interruptions, or other issues caused by third-party providers.

5.6 Copyright Complaints

If you believe content or materials in the App infringe your copyright, contact us at janogroupllc@gmail.com with:

- Your contact information

- Identification of the copyrighted work

- Identification of the allegedly infringing material

- A good-faith statement that the use is unauthorized

- A statement that the information you provide is accurate

We may remove or restrict access to content in appropriate circumstances.

6. Subscriptions, Usage Limits, and Billing

Usage and features may vary by plan, app version, offer, platform, country, or marketplace.

Current access may include:

Free Tier:

- Practice Access: Limited practice sessions, feature previews, or reduced question access

- Features: Core study content, reminders, and advertising-supported access where applicable

- Notes: Some flows may be capped by time, question count, or waiting periods

Trial or Promotional Plan:

- Practice Access: Temporary premium access where offered

- Features: Premium content and reduced or removed gating during the offer period

- Notes: Availability may vary by offer, marketplace, or eligibility

Paid Premium:

- Practice Access: Broader or full access to premium study content and tools during the active subscription period

- Features: Premium explanations, premium study tools, higher access limits, and an ad-free experience where offered

- Notes: Auto-renews unless canceled

Additional terms:

- Billing, renewals, cancellation rights, and refunds are handled by Apple, Google, or another applicable app marketplace, except where otherwise required by law.

- Prices, offer availability, subscription names, trial length, and usage limits shown in the App or app store listing control over any examples in these Terms.

- Unused access does not roll over unless expressly stated in the App.

- We may update pricing, plan structure, or limits at any time to reflect operational costs, service changes, legal requirements, or provider changes.

7. Technology and Service Limitations

The App uses software-based study tools, locally stored content, device settings, and third-party platform services. Results and features may:

- Vary by platform, operating system version, device performance, or region

- Be interrupted by app store, subscription, network, notification, or advertising-service issues

- Change over time as content, study materials, or feature sets are updated

- Depend on permissions you grant, such as notification or tracking-related permissions where applicable

We do not guarantee continuous uptime, uninterrupted access, or any minimum level of study performance or exam outcome.

8. Privacy and Data Protection

Your use of the App is also governed by our Privacy Policy, which explains how we collect, use, process, and store information, including app analytics, subscription status, device-related information, preferences, and reminder settings.

9. Disclaimers and Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, OR RELIABILITY.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, JANOGROUP LLC WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOSS OF DATA, BUSINESS, REVENUE, PROFITS, GOODWILL, OR REPUTATION ARISING OUT OF OR RELATED TO YOUR USE OF THE APP.

THIS INCLUDES, WITHOUT LIMITATION, LOSSES OR DAMAGES RESULTING FROM:

- Reliance on outdated or incorrect civics answers or study materials

- Missed deadlines, missed interviews, or unsuccessful naturalization outcomes

- Legal or immigration decisions made without independent verification

- Subscription, billing, restore-purchase, marketplace, or third-party service issues

- Notification failures, data loss, or device-related issues

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE APP WILL NOT EXCEED THE GREATER OF: (A) THE AMOUNT YOU PAID TO US FOR THE APP IN THE 12 MONTHS BEFORE THE CLAIM, OR (B) USD $25.

10. Indemnification

You agree to indemnify, defend, and hold harmless JanoGroup LLC, its affiliates, officers, employees, contractors, licensors, and service providers from and against any claims, liabilities, damages, judgments, losses, costs, and expenses, including reasonable attorneys’ fees, arising from or related to:

- Your use or misuse of the App

- Your violation of these Terms or applicable law

- Your misuse of the App for legal, immigration, or commercial purposes

- Your attempts to bypass technical or subscription restrictions

- Any action you take in reliance on App content without reviewing official sources

11. Dispute Resolution and Governing Law

These Terms are governed by the laws of Delaware, USA, without regard to conflict-of-law principles.

Any dispute, claim, or controversy arising out of or relating to these Terms or the App will be resolved by binding arbitration under the AAA Consumer Rules, conducted in English, in Washington, DC or virtually, unless applicable law requires otherwise.

You and JanoGroup LLC agree that disputes will be brought only on an individual basis and not as part of any class, collective, consolidated, or representative proceeding.

You may opt out of arbitration within 30 days of first accepting these Terms by emailing janogroupllc@gmail.com with the subject line “Arbitration Opt-Out.”

If you opt out, exclusive jurisdiction for disputes will lie in the state or federal courts located in Washington, DC, to the extent permitted by law.

12. Termination

You may stop using the App at any time and may cancel subscriptions through the applicable app store account settings.

We may suspend, restrict, or terminate access immediately if we believe you have violated these Terms, abused the Service, attempted to bypass restrictions, or created legal, security, or operational risk.

Upon termination, your right to use the App ends immediately. Any provisions that by their nature should survive termination will survive, including ownership, disclaimers, limitations of liability, indemnification, and dispute-resolution provisions.

13. Changes to These Terms

We may update these Terms from time to time. Material changes may be communicated in the App, through release notes, or by other reasonable means.

Your continued use of the App after updated Terms become effective constitutes acceptance of the revised Terms.

14. General Provisions

These Terms, together with the Privacy Policy, form the entire agreement between you and JanoGroup LLC regarding the App and supersede all prior or contemporaneous understandings relating to the App.

If any provision is found unenforceable, the remaining provisions will remain in full force and effect. Our failure to enforce any provision is not a waiver. We may assign or transfer these Terms in connection with a merger, acquisition, financing, or sale of assets.
