By downloading, installing, accessing, or using UltraCam: HD Camera & Editor (the "App"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, please do not use the App.
If you are using the App on behalf of an organization or other legal entity, you represent and warrant that you have the authority to bind that organization to these Terms. In such case, "you" and "your" refer to that organization.
We reserve the right to modify these Terms at any time. Updated Terms will be posted with a revised "Last Updated" date. Continued use of the App following any modifications constitutes acceptance of the updated Terms.
UltraCam: HD Camera & Editor is a camera and photo/video editing application that allows users to capture, import, edit, enhance, and save photos and videos on their devices.
The App may provide features including:
Taking photos using the device camera.
Recording videos using the device camera.
Selecting photos and videos from the device.
Editing, enhancing, cropping, resizing, or applying effects to photos and videos.
Saving or exporting edited media to the user's device.
Certain features of the App may require access to the device camera, microphone, photos, videos, or storage. These permissions are requested only when required for the corresponding functionality.
Users are responsible for ensuring that they have the necessary rights and permissions to use any photos, videos, or other media that they capture, import, edit, or process through the App.
Some features of the App may be available only to users with an active Premium Subscription. Premium features are optional and are intended to enhance the user experience.
The App allows users to capture, select, import, edit, and process their own photos and videos.
Users retain ownership of the photos, videos, and other content they create or provide through the App.
By using the App, you represent and warrant that:
You own or have the necessary rights and permissions to use the photos, videos, and other media you provide.
Your use of such content does not violate applicable laws.
Your use of third-party images, videos, or other media does not infringe another person's privacy, publicity, copyright, trademark, or other rights.
You will not use the App to create, edit, or distribute unlawful or infringing content.
INDOGAST MEDIA does not claim ownership of user-generated content.
We do not monitor or review all content created or processed by users and are not responsible for user-generated content or the consequences of using or distributing such content.
The App may allow users to process personal, private, or sensitive photographs and videos.
Users are solely responsible for determining whether they have the legal right and appropriate consent to capture, edit, possess, use, or share any person depicted in such media.
In particular, users must not use the App to:
Process or distribute images or videos of another person without appropriate authorization or consent.
Violate another person's privacy or publicity rights.
Create or distribute deceptive, defamatory, abusive, or unlawful content.
Create or distribute sexual or intimate content involving any person without their appropriate consent.
Process or distribute content involving minors in an unlawful, exploitative, or sexually explicit manner.
We do not endorse or encourage the misuse of personal or sensitive media.
You are solely responsible for any photos, videos, or other content you create, edit, save, or share using the App.
Certain features of UltraCam: HD Camera & Editor may require a paid subscription ("Premium Subscription").
Subscription plans may be offered on a weekly, monthly, yearly, or other recurring basis. Prices, billing periods, and available features will be displayed within the App before purchase.
Payments are processed through the applicable app marketplace, including but not limited to Google Play Store or Apple App Store. We do not collect or store your payment card information.
Subscriptions automatically renew unless canceled before the renewal date through your applicable app store account settings.
You may manage or cancel your subscription through your Google Play Store or Apple App Store account settings. Cancellation generally takes effect at the end of the current billing period.
Any free trial offered by the App may be canceled before the trial period ends. If a Premium Subscription is purchased during a free trial period, any unused portion of the trial may be forfeited according to the applicable platform's policies.
Refund requests are handled according to the refund policies of the platform through which the purchase was made.
We reserve the right to modify subscription pricing, features, and plans at any time. Such changes will generally apply to future purchases or subscription renewals, subject to applicable law and platform requirements.
The App may display advertisements provided by third-party advertising services.
Advertising providers may collect or process certain device and usage information in accordance with their own privacy policies.
We are not responsible for the content, accuracy, availability, or practices of third-party advertisements.
All software, trademarks, logos, graphics, designs, text, interfaces, editing tools, and other materials included in the App are owned by INDOGAST MEDIA or its licensors and are protected by applicable intellectual property laws.
You may not:
Copy, reproduce, distribute, or commercially exploit the App.
Modify or create derivative works based on the App.
Reverse engineer, decompile, or disassemble the App, except where expressly permitted by applicable law.
Attempt to derive the source code of the App.
Use our trademarks, branding, or copyrighted materials without written permission.
Remove or alter proprietary notices.
Attempt to bypass technical restrictions or security mechanisms.
You agree not to:
Use the App for any unlawful purpose.
Violate any applicable law or regulation.
Use the App to infringe another person's privacy, publicity, intellectual property, or other rights.
Process or distribute unlawful, abusive, defamatory, or harmful content.
Create, process, or distribute sexual or intimate content involving another person without appropriate consent.
Create, process, or distribute sexually explicit content involving minors.
Upload or distribute malware, viruses, or harmful code.
Interfere with the operation, security, or performance of the App.
Reverse engineer, decompile, or disassemble the App except where legally permitted.
Access systems or networks without authorization.
Use bots, crawlers, scrapers, or automated tools to access the App without authorization.
Attempt to bypass technical restrictions or security mechanisms.
Misrepresent your identity or affiliation with any person or entity.
We reserve the right to suspend or terminate access to the App if these Terms are violated.
The App is provided on an "AS IS" and "AS AVAILABLE" basis.
To the fullest extent permitted by applicable law, INDOGAST MEDIA disclaims all warranties, express or implied, including but not limited to:
Merchantability.
Fitness for a particular purpose.
Non-infringement.
Availability.
Accuracy.
Reliability.
Uninterrupted operation.
We do not guarantee that:
The App will always function without interruption.
The App will be error-free or completely secure.
Editing features or effects will always produce the expected results.
Photos or videos will always be preserved without loss or corruption.
The App will be compatible with every device or operating system.
Third-party services will remain available.
Users are responsible for maintaining appropriate backups of important photos and videos.
We do not guarantee the accuracy, legality, quality, or suitability of content created or processed by users.
We are not responsible for:
User-generated photos or videos.
Content uploaded, imported, edited, or exported by users.
Loss, corruption, or accidental deletion of user media.
Claims arising from a user's use of another person's image or likeness.
Privacy, publicity, copyright, trademark, or other rights violations caused by user-generated content.
Any consequences resulting from the publication, sharing, or distribution of content created using the App.
Users are solely responsible for their content and their use of the App.
To the maximum extent permitted by applicable law, INDOGAST MEDIA, its affiliates, employees, officers, licensors, and partners shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to:
Your use or inability to use the App.
Photos, videos, or other media processed using the App.
Loss or corruption of user-generated content.
Your use or misuse of another person's image or likeness.
Privacy, publicity, copyright, trademark, or other rights claims arising from user content.
Subscription purchases or payment processing.
Advertising or third-party services.
Service interruptions, outages, or technical failures.
Unauthorized access to systems or information.
Your use of the App is entirely at your own risk.
Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited under applicable law.
To the extent permitted by applicable law, you agree to defend, indemnify, and hold harmless INDOGAST MEDIA, its affiliates, employees, officers, licensors, and partners from any claims, liabilities, losses, damages, costs, or expenses arising out of:
Your use of the App.
Your violation of these Terms.
Your violation of any applicable law.
Your misuse of the App.
Your creation, editing, possession, publication, or distribution of user-generated content.
Your infringement of privacy, publicity, copyright, trademark, or other third-party rights.
Your use of another person's image, likeness, or personal media without appropriate authorization or consent.
We may suspend, restrict, or terminate your access to the App at any time, with or without notice, if we reasonably believe that you have violated these Terms or applicable laws.
Upon termination, your right to use the App will immediately cease.
Provisions that by their nature should survive termination, including intellectual property rights, user-content responsibilities, disclaimers, limitation of liability, indemnification, and applicable legal provisions, will remain in effect.
These Terms shall be governed and interpreted in accordance with applicable laws, without regard to conflict-of-law principles.
Any disputes arising from these Terms or your use of the App shall be subject to the jurisdiction of the competent courts, subject to any mandatory consumer protection rights applicable in your jurisdiction.
We may update these Terms from time to time.
Updated versions will be posted on this page with a revised "Last Updated" date. Continued use of the App after any changes become effective constitutes acceptance of the revised Terms, to the extent permitted by applicable law.
