Under this program, individuals from the corporate customer are professionally trained in basic maintenance and repair procedures for their selected products. Right to repair legislation is directed at the ability of consumers to repair their own products instead of going back to the original manufacturer for service. Right to repair legislation includes bills addressing specific products, like wheelchairs, and those targeting broader categories, such as medical, digital or agricultural equipment. The measures often include language on what tools, parts, software or instructions manufacturers should provide to independent repairers or product owners so they may repair the products they own.

In 2012, Massachusetts enacted both an automobile right to repair bill (HB 4362) and a similar ballot initiative, followed by a measure (HB 3757; 2013) that reconciled the two new laws. In 2020, Massachusetts voters approved an initiative to expand the automobile right to repair law to include telematics; the law is currently facing a legal challenge from automobile manufacturers.

Enacts the Right to Repair Act. Requires, except as specified and regardless of whether any express warranty is made, the manufacturer of a specified electronic or appliance product, in certain circumstances, and in those same circumstances but sold to others outside of direct retail sales, to make available, on fair and reasonable terms, to product owners, service and repair facilities, and service dealers, the means to effect the diagnosis, maintenance or repair of the product.

Authorizes the State Department of Public Health to waive any licensing requirements for a medical device retail facility when a high standard of patient safety, consistent with good patient care, can be provided by the licensure of a home medical device retail facility that does not meet all of the requirements for licensure. Requires, with specified exceptions, an original manufacturer of a powered wheelchair to provide specified documentation to the wheelchair owner or an independent repair provider.

Establishes a right to repair motorized wheelchairs; provides that: a motorized wheelchair manufacturer shall provide to a motorized wheelchair owner or independent repairer all parts, embedded software, firmware, tools and technical documentation necessary for the owner or repairer to perform diagnostic, maintenance and repair work on the wheelchair any failure to provide such parts, software, firmware, tools and technical documentation constitutes an unfair or deceptive act or practice within.

Relates to fair repair of agricultural equipment; requires original equipment manufacturers of agricultural equipment to provide certain manufacturing, diagnostic and repair information to independent repair providers and owners; prohibits original equipment manufacturers from excluding certain information concerning security-related functions, provides civil liability.

Relates to selling and other trade practices, to require a manufacturer to provide certain items necessary for the diagnosis, service, maintenance or repair of a digital electronic product; provides for a short title; provides for definitions; provides for statutory construction; provides for enforcement, limitations, exclusions and applicability.

Requires manufacturers of digital electronic equipment to make available to owners and independent repair providers, on fair and reasonable terms, the documentation, parts and tools used to diagnose, maintain and repair the equipment.

Requires original equipment manufacturers of digital electronic equipment to make documentation, parts and tools available to independent repair providers and owners for the purposes of diagnosis, maintenance and repair on fair and reasonable terms; excludes certain manufacturers, dealers, distributors and importers of certain motor vehicles or motor vehicle equipment, all-terrain sports vehicles and motorcycles, heavy construction equipment, and medical equipment valued at or over $100,000.

Creates the Digital Electronic Equipment Right to Repair Act; provides that, for digital electronic equipment and parts for digital electronic equipment sold or used in the state, an original equipment manufacturer shall make available to an independent repair provider, solely for the purpose of repairing digital electronic equipment, on fair and reasonable terms, any documentation, parts, service access methods, and tools, including, but not limited to, any updates to information.

Creates the Educational Technology Right to Repair Act; provides that for educational technology equipment and parts for educational technology equipment sold or used in the state, an original equipment manufacturer shall make available to an independent repair provider, solely for the purpose of repairing educational technology equipment, on fair and reasonable terms, any documentation, parts, service access methods and tools, including, but not limited to, any updates to information. be457b7860
