Welcome to Tutoa! These Terms of Use ("Terms") govern your use of the Tutoa mobile application (the "App"), operated by Hafid Ziti ("we," "our," or "us").

By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the App.

1. DESCRIPTION OF SERVICE

Tutoa is an AI-powered educational application that allows users to scan exercises using their device camera and receive step-by-step solutions, explanations, and follow-up actions. The App is designed to assist with learning across various subjects including mathematics, physics, chemistry, biology, history, and more.

2. ELIGIBILITY

The App is intended for users of all ages for educational purposes. If you are under the age of 13, you should use the App with the supervision and consent of a parent or guardian.

3. ACCOUNT AND SUBSCRIPTIONS

3.1 Free Tier

Tutoa offers a free tier with limited daily scans and follow-up interactions. The specific limits are displayed within the App and are subject to change.

3.2 Tutoa Pro Subscription

Tutoa Pro is a paid subscription that unlocks unlimited scans and additional features. Subscription details, pricing, and trial periods are displayed at the time of purchase within the App.

3.3 Payment and Billing

All payments are processed by RevenueCat, Inc. and the respective app store (Apple App Store or Google Play Store). By purchasing a subscription, you agree to the applicable store's terms of service. Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period.

3.4 Cancellation

You can manage and cancel your subscription at any time through your device's app store settings. Cancellation takes effect at the end of the current billing period. No refunds are provided for partial subscription periods, except as required by applicable law.

3.5 Free Trial

Tutoa Pro may offer a free trial period. The trial duration is specified at the time of sign-up. If you cancel before the trial ends, you will not be charged. If you do not cancel, your subscription will automatically begin at the end of the trial period.

4. ACCEPTABLE USE

You agree not to:

- Use the App for any unlawful purpose or in violation of any applicable laws

- Attempt to reverse engineer, decompile, or extract the source code of the App

- Use automated means (bots, scripts, scrapers) to access or interact with the App

- Interfere with or disrupt the App's servers or networks

- Upload or transmit any malicious code, viruses, or harmful content

- Use the App to cheat on exams, tests, or other assessments where external assistance is prohibited

- Exceed the daily usage limits through circumvention methods

- Impersonate any person or entity

We reserve the right to suspend or terminate access to the App for violations of these Terms.

5. INTELLECTUAL PROPERTY

5.1 Our Content

The App, including its code, design, logos, trademarks, and original content, is owned by us and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the App without our prior written consent.

5.2 User Content

You retain ownership of the exercise images and text you submit through the App. By submitting content, you grant us a limited, worldwide, royalty-free license to process and analyze that content solely for the purpose of providing the App's services to you.

5.3 Generated Solutions

The step-by-step solutions and explanations generated by the App are provided for educational purposes. While we strive for accuracy, AI-generated content may contain errors. We do not claim ownership of generated solutions, but you may not resell or redistribute them as a standalone product.

6. DISCLAIMER OF WARRANTIES

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

- The App will be uninterrupted, secure, or error-free

- The AI-generated solutions will be 100% accurate or complete

- Any errors or defects will be corrected

The App is an educational tool and should not be relied upon as the sole source of information for critical decisions. Always verify solutions independently when accuracy is essential.

7. LIMITATION OF LIABILITY

To the fullest extent permitted by applicable law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or grades, arising from your use of or inability to use the App, even if we have been advised of the possibility of such damages.

Our total liability to you for any claims under these Terms shall not exceed the amount you have paid to us in the twelve (12) months preceding the claim, or fifty euros (€20) if you have not made any payments.

8. THIRD-PARTY SERVICES

The App integrates with third-party services including RevenueCat (payment processing) and Sentry (error tracking). We are not responsible for the content, privacy practices, or availability of these third-party services. Your use of such services is subject to their respective terms and policies.

9. MODIFICATIONS TO TERMS

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms in the App and updating the "Last updated" date. Your continued use of the App after changes are posted constitutes acceptance of the modified Terms.

10. MODIFICATIONS TO THE APP

We reserve the right to modify, suspend, or discontinue the App or any features at any time without prior notice. We shall not be liable for any modification, suspension, or discontinuation of the App.

11. TERMINATION

We may terminate or suspend your access to the App immediately, without prior notice, for any violation of these Terms. Upon termination, your right to use the App will cease immediately. Provisions that by their nature should survive termination (including intellectual property, disclaimers, and limitations of liability) shall survive.

12. DAILY FAIR USE LIMITS

To ensure fair usage and quality of service for all users, Tutoa enforces daily usage limits. These limits apply to all users, including Tutoa Pro subscribers. Attempts to circumvent these limits may result in account suspension.

13. GOVERNING LAW

These Terms shall be governed by and construed in accordance with the laws of France, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Paris, France.
