Abstract: Although there is evidence that discrimination laws boost the employment of protected groups, very few papers explore their effectiveness during economic downturns. The Covid-19 recession disproportionately affected older workers and increased age discrimination. In this context, I employ triple and quadruple-difference approaches to examine whether state age discrimination laws, which provide stronger protection than the federal law, reduce the adverse impacts of Covid-19 on older workers. These approaches compare labor market outcomes for older and younger workers in states with and without stronger laws before and after Covid-19. I find that older men had higher hiring and employment rates in states with stronger laws following the onset of Covid-19. However, stronger laws were also associated with increased separation rates for men. These findings suggested that older workers were more likely to move between jobs, and the increase in hiring might be larger than that in separation, reflecting increased employment rates. The results also show that stronger state laws were more likely to protect men more effectively than women. Overall, stronger state age discrimination laws were somewhat effective during and after the Covid-19 recession.
