Please read these Terms of Service ("Terms", "Terms of Service", "EULA") carefully before using the Zora AI mobile application (the "Service").
1. Agreement to Terms By downloading, accessing, or using our Service, you agree to be bound by these Terms. If you disagree with any part of the terms, then you may not access the Service. You must be at least 18 years old to use this Service.
2. Acknowledgement You and Zora AI acknowledge that these Terms are concluded between you and Zora AI only, and not with Apple Inc. ("Apple"). Zora AI, not Apple, is solely responsible for the Service and its content. These Terms do not provide for usage rules that conflict with the Apple Media Services Terms and Conditions, which you acknowledge you have had the opportunity to review.
3. Scope of License Zora AI grants you a limited, non-transferable license to use the Service on any Apple-branded Products that you own or control and as permitted by the Usage Rules set forth in the Apple Media Services Terms and Conditions. This license does not allow you to use the Service on any device that you do not own or control, and you may not distribute or make the Service available over a network where it could be used by multiple devices at the same time.
4. AI Generation, Content Usage, & Replicate API Zora AI provides video generation services powered by artificial intelligence, utilizing third-party services including the Replicate API. By using this Service, you acknowledge and agree to the following:
Unpredictability of AI: Due to the experimental nature of AI, generated videos may occasionally contain visual artifacts, inconsistencies, or unexpected results. Zora AI cannot guarantee specific outcomes based on text prompts or image inputs.
User Responsibility for Inputs: You are solely responsible for the text prompts, images, and videos you upload to the Service. You represent and warrant that you own the rights to, or have explicit permission to use, any media you upload.
Acceptable Use Policy: You may not use Zora AI to generate, upload, or distribute content that is illegal, defamatory, highly explicit, non-consensual (e.g., unauthorized deepfakes), or infringes on the intellectual property rights of others. We reserve the right to suspend or terminate accounts that violate these rules.
Age Restriction: This Service is strictly for users aged 13 and older. By using the app, you confirm you meet this age requirement.
5. In-App Purchases, Subscriptions & Credits Zora AI requires an active subscription to generate videos. We offer auto-renewing subscriptions (Weekly, Monthly, or Yearly plans) alongside one-time credit purchases.
Payment & Renewal: Payment will be charged to your App Store ID or Google Play Store account at confirmation of purchase. Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period.
Subscription Credits: Depending on your active plan, you will receive a recurring allotment of generation credits. Subscription credits do not roll over to the next billing cycle. Any unused subscription credits expire at the end of their respective weekly or monthly period.
Top-Up Credits: You may purchase additional "top-up" credit packs. Unlike subscription credits, purchased top-up credits are permanent and do not expire.
Management: You can manage your subscription and turn off auto-renewal by going to your account settings in the App Store or Google Play Store after purchase.
6. Maintenance and Support Zora AI is solely responsible for providing any maintenance and support services with respect to the Service, as specified in these Terms or as required under applicable law. You and Zora AI acknowledge that Apple has no obligation whatsoever to furnish any maintenance and support services with respect to the Service.
7. Warranty Zora AI is solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. In the event of any failure of the Service to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the Service to you. To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the Service, and any other claims, losses, liabilities, damages, costs, or expenses attributable to any failure to conform to any warranty will be Zora AI's sole responsibility.
8. Product Claims You and Zora AI acknowledge that Zora AI, not Apple, is responsible for addressing any claims by you or any third party relating to the Service or your possession and/or use of the Service, including, but not limited to: (i) product liability claims; (ii) any claim that the Service fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy, or similar legislation.
9. Intellectual Property Rights You and Zora AI acknowledge that, in the event of any third-party claim that the Service or your possession and use of the Service infringes that third party’s intellectual property rights, Zora AI, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of any such intellectual property infringement claim.
10. Legal Compliance You represent and warrant that (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a “terrorist supporting” country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.
11. Third-Party Terms of Agreement You must comply with applicable third-party terms of agreement when using the Service. For example, you must not be in violation of your wireless data service agreement when using the Service.
12. Third-Party Beneficiary You and Zora AI acknowledge and agree that Apple, and Apple’s subsidiaries, are third-party beneficiaries of these Terms, and that, upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce the Terms against you as a third-party beneficiary thereof.
13. Limitation of Liability In no event shall Zora AI, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the Service.
