Please read these Terms of Service ("Terms", "Terms of Service", "EULA") carefully before using the CRAI - AI Chat & Roleplay mobile application (the "Service").
By downloading, accessing, or using our Service, you agree to be bound by these Terms. If you disagree with any part of the terms, then you may not access the Service. You must be at least 18 years old to use this Service.
You and CRAI acknowledge that these Terms are concluded between you and CRAI only, and not with Apple Inc. ("Apple") or Google LLC. CRAI, not Apple or Google, is solely responsible for the Service and its content. These Terms do not provide for usage rules that conflict with the Apple Media Services Terms and Conditions, which you acknowledge you have had the opportunity to review.
CRAI grants you a limited, non-transferable license to use the Service on any supported devices that you own or control and as permitted by the Usage Rules set forth in the respective App Store Terms and Conditions. This license does not allow you to use the Service on any device that you do not own or control, and you may not distribute or make the Service available over a network where it could be used by multiple devices at the same time.
CRAI provides text-based conversational AI and avatar generation services powered by artificial intelligence, utilizing third-party services including the OpenRouter API and Replicate API. By using this Service, you acknowledge and agree to the following:
Unpredictability of AI: Due to the experimental nature of AI, generated text responses and character avatars may occasionally contain inconsistencies, unexpected results, or inaccurate information. CRAI cannot guarantee specific outcomes based on text prompts or image inputs.
User Responsibility for Inputs: You are solely responsible for the text chats, character definitions, prompts, and images you upload to the Service. You represent and warrant that you own the rights to, or have explicit permission to use, any media you upload.
Acceptable Use Policy: You may not use CRAI to generate, upload, or distribute content that is illegal, defamatory, non-consensual, or infringes on the intellectual property rights of others. We reserve the right to suspend or terminate accounts that violate these rules.
Age Restriction: This Service is strictly for users aged 18 and older. By using the app, you confirm you meet this age requirement.
CRAI operates on a freemium model. Free users receive a daily allotment of messages to interact with AI characters. We also offer auto-renewing Premium subscriptions to enhance the Service.
Premium Subscriptions: Upgrading to a Premium tier unlocks features such as unlimited messaging, long-term character memory, and priority AI avatar generation.
Payment & Renewal: Payment will be charged to your App Store or Google Play Store account at confirmation of purchase. Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period. Subscriptions and in-app purchases are managed securely via RevenueCat.
Management: You can manage your subscription and turn off auto-renewal by going to your account settings in the App Store or Google Play Store after purchase.
CRAI is solely responsible for providing any maintenance and support services with respect to the Service, as specified in these Terms or as required under applicable law. You and CRAI acknowledge that Apple has no obligation whatsoever to furnish any maintenance and support services with respect to the Service.
CRAI is solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. In the event of any failure of the Service to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the Service to you. To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the Service, and any other claims, losses, liabilities, damages, costs, or expenses attributable to any failure to conform to any warranty will be CRAI's sole responsibility.
You and CRAI acknowledge that CRAI, not Apple, is responsible for addressing any claims by you or any third party relating to the Service or your possession and/or use of the Service, including, but not limited to: (i) product liability claims; (ii) any claim that the Service fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy, or similar legislation.
You and CRAI acknowledge that, in the event of any third-party claim that the Service or your possession and use of the Service infringes that third party’s intellectual property rights, CRAI, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of any such intellectual property infringement claim.
You represent and warrant that (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a “terrorist supporting” country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.
You must comply with applicable third-party terms of agreement when using the Service. For example, you must not be in violation of your wireless data service agreement when using the Service.
You and CRAI acknowledge and agree that Apple, and Apple’s subsidiaries, are third-party beneficiaries of these Terms, and that, upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce the Terms against you as a third-party beneficiary thereof.
In no event shall CRAI, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the Service.
