Please read these Terms of Service ("Terms", "Terms of Service", "EULA") carefully before using the CardBindr mobile application (the "Service").
By downloading, accessing, or using our Service, you agree to be bound by these Terms. If you disagree with any part of the Terms, then you may not access the Service. You must be at least 13 years old to use this Service. If you are under the age of majority where you live, you may use the Service only with permission from a parent or legal guardian.
You and CardBindr acknowledge that these Terms are concluded between you and CardBindr only, and not with Apple Inc. ("Apple"). CardBindr, not Apple, is solely responsible for the Service and its content. These Terms do not provide for usage rules that conflict with the Apple Media Services Terms and Conditions.
CardBindr grants you a limited, non-transferable license to use the Service on Apple-branded Products that you own or control, as permitted by the Usage Rules set forth in the Apple Media Services Terms and Conditions.
CardBindr provides card scanning, cataloging, binder organization, collection statistics, portfolio-value history, cloud backups, community feature requests, and CardBindr Pro features.
Card recognition may produce incorrect or incomplete results. You are responsible for confirming card details, quantities, and condition. Card values, price history, valuations, and currency conversions are estimates based on third-party data and may be delayed or inaccurate. CardBindr does not provide financial, investment, tax, appraisal, or insurance advice.
The Service relies on third-party platforms and data sources, including Apple, Google, Supabase, RevenueCat, TCGdex, PokéWallet, and ExchangeRate-API. Third-party services may change or become unavailable.
You may use a guest account or sign in with Apple or Google. Guest accounts may be harder to recover if you lose access to your device.
You are responsible for usernames, binder covers, scan reports, feature requests, comments, and other content you submit. You must have the rights needed to submit that content. You may not submit unlawful, abusive, deceptive, infringing, explicit, or harmful content.
You may not misuse accounts, purchases, scan limits, community features, servers, or third-party services. We may remove content or suspend access when reasonably necessary.
CardBindr offers CardBindr Pro through auto-renewing subscriptions (Weekly or Yearly plans) and a one-time Lifetime purchase. Available products, prices, billing periods, and features are shown in the Service before purchase.
Payment and renewal: Payment is charged to your Apple ID account when you confirm a purchase. Subscriptions automatically renew unless canceled through your App Store account settings before renewal.
Management: You can manage or cancel subscriptions through your App Store account and restore eligible purchases in the Service.
Lifetime purchase: A lifetime purchase provides the purchased CardBindr Pro features for the supported lifetime of the Service. It is not a guarantee that the Service will remain available indefinitely.
Refund requests are handled by Apple under Apple's applicable policies.
CardBindr is solely responsible for providing maintenance and support services with respect to the Service, as required under applicable law. You and CardBindr acknowledge that Apple has no obligation to furnish maintenance or support services for the Service.
CardBindr is solely responsible for product warranties, whether express or implied by law, to the extent not effectively disclaimed. If the Service fails to conform to an applicable warranty, you may notify Apple, and Apple may refund the purchase price for the Service. To the maximum extent permitted by law, Apple will have no other warranty obligation with respect to the Service.
You and CardBindr acknowledge that CardBindr, not Apple, is responsible for addressing claims relating to the Service, including product-liability claims, claims that the Service fails to conform to legal or regulatory requirements, and claims arising under consumer-protection, privacy, or similar legislation.
You and CardBindr acknowledge that, in the event of a third-party claim that the Service or your use of the Service infringes intellectual-property rights, CardBindr, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of that claim.
Trading-card names, images, logos, and related materials may belong to their respective owners. CardBindr is an independent application and is not affiliated with, endorsed by, or sponsored by The Pokémon Company, Nintendo, Game Freak, Creatures Inc., or any other trading-card brand owner unless expressly stated.
You represent and warrant that you are not located in a country subject to a U.S. Government embargo or designated by the U.S. Government as a "terrorist supporting" country, and you are not listed on a U.S. Government list of prohibited or restricted parties.
You must comply with applicable third-party terms when using the Service. For example, you must not violate your wireless data-service agreement when using the Service.
You and CardBindr acknowledge and agree that Apple and Apple's subsidiaries are third-party beneficiaries of these Terms. Upon your acceptance, Apple will have the right to enforce these Terms against you as a third-party beneficiary.
To the maximum extent permitted by law, CardBindr and its operator will not be liable for indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, use, goodwill, or other intangible losses arising from your access to or use of, or inability to access or use, the Service.
The Service is provided "as is" and "as available." We do not guarantee uninterrupted availability, scan accuracy, pricing accuracy, or that cloud backups will prevent every loss of data.
Our Privacy Policy explains how we collect, use, and share information. By using the Service, you acknowledge that you have reviewed the Privacy Policy.
