When commissioning me, you are stating that you not only agree to the terms and conditions I have listed on my website, but you are also agreeing to follow them as stated.

Terms of Service

By ordering commissioned artwork from me you automatically agree to the Terms of Service listed below. These terms are not only here to protect you (hereby “The Client”) but as well as myself (hereby “The Artist”). It is highly advised that you read through ALL of the following terms.

1.) General

The Client is aware that they are purchasing a digital good. The Client is paying The Artist for the creation of digital artwork and the right to use it. (So long as The Client uses it in a manner outlined in #5)

2.) Ordering

2.1) Contact

The Artist accepts contacts via the following methods: Email via the following email address tophrodite.contact@gmail.com, an instant message via Instagram at the account tophrodite, or a direct message via Twitter at the account tophrodite.

Communication between Artist and Client will be held through whatever means the commission process has been started. It is highly recommended to not change contact methods midway. (Messages may be logged as proof of agreement)

2.2) Will Draw/Edit

The Artist will draw the following: Humanoid Figures, Furries (both anthro and feral), LGBTQ+ Pride Art, Original Characters (as long as reference is provided), characters from official and/or copyrighted material (for personal use ONLY), Gore, Suggestive work, and NSFW art.

2.3) Won't Draw/Edit

The Artist will not draw the following under ANY circumstance: Political propaganda (if your character is a soviet or something, and isn't like a propaganda poster then that is alright, with some exceptions), anything related to the NAZI party, the Third Reich, or Adolf Hitler (The Artist doesn't feel comfortable drawing/editing anything related to that source material), Religious propaganda, Hateful/Harmful content meant to hurt/harm others, and any more content The Artist personally doesn't feel comfortable drawing/editing.

2.4) Process

The Artist may refuse service to The Client for any reason they deem fit.

The commission request should include the following: The type of commission, references for the character(s) (Only required if the character requested is an original character of The Client’s), general details on the pose(s), and atmosphere/environment details.

FOR EDITS ONLY: The Client must have an image ready to send to The Artist when requesting an edit. If this image is made by another freelance artist permission to use must be provided in order for The Artist to edit the image to The Client's specifications.

Commissions won't necessarily be worked on in a first-come first-serve schedule. The commission-schedule depends on the complexity of the commission and the contact between Artist and Client.

Before ordering please consider: The Artist won't give out any deadline to finish the commission. Completion depends on the Artist's free time and so a fixed amount of time until completion can never be defined. However, the Artist will finish every commissioned work, unless it was canceled.

3.) Payment

Base prices are subject to change without notice. Commissions initiated before updates to prices are not affected.

Payment is due when the Client approves of a rough sketch.

If The Client takes advantage of the prepayment rough sketch by taking it and never following with the full commission, The Client will be blacklisted.

The full payment is required prior to The Artist completing the work.

The only methods of payment accepted currently are through Venmo, and Cashapp.

Payment information will be exchanged at the time of initial payment for the commission.

4.) Refund

The Client must have an appropriate reason to be eligible for a refund offer.

If the commission is already finished, it is nonrefundable.

At any point during a commission, if the Artist does not receive a needed reply from The Client within one month, the commission may be canceled. If the commission was already paid, The Client has an additional month to contact the Artist for a partial refund. After this additional month no refunds will be considered.

The Artist is within their right to cancel a commission WITHOUT refund if The Client is consistently being rude, obnoxious, childish, demeaning/and or degrading towards the Artist. The Client will also be blacklisted afterwards.

5.) Usage and Rights

The Artist retains all the rights to the artwork.

The Client retains all rights to their characters.

The Client may use the artwork for NON-COMMERCIAL, NON-PROMOTIONAL purposes. The Client may resize the artwork to create icons, but The Client is NOT allowed to alter the artwork itself. (eg, recolors, red-lines, etc.)

The Client is NOT permitted, under ANY circumstances, to use any part of the commissioned artwork they received for non-fungible tokens (NFT’s). Use of the artwork for any advertising or profits associated with non-fungible tokens and/or cryptocurrency is strictly prohibited.

The Client may upload the artwork to their personal website or gallery, but credit IS REQUIRED.

The Artist may display commissioned work on any personal website, gallery, or journal, and use commissioned work in promotional materials.
