Terms of Use for OtakuAvatar AI

These Terms of Use ("Terms") govern your use of the OtakuAvatar AI application (the "Service"), provided by developer of OtakuAvatar AI ("we," "our," or "us"). By accessing or using the Service, you agree to comply with and be bound by these Terms. If you do not agree with any part of these Terms, you must not use the Service.
By accessing or using the Service, you accept and agree to be bound by these Terms and our Privacy Policy. If you are using the Service on behalf of an organization or entity, you represent and warrant that you have the authority to bind that organization to these Terms.
You are not required to create an account to use the Service. However, if the Service offers an account creation option, you are responsible for maintaining the confidentiality of your account credentials, and you agree to notify us immediately if your account is compromised. You are solely responsible for all activities that occur under your account.
You may use the Service for lawful purposes only and in accordance with these Terms. You agree not to:
Use the Service to upload, post, or transmit any unlawful, defamatory, or otherwise objectionable content.
Violate any applicable local, state, national, or international law while using the Service.
Interfere with or disrupt the operation of the Service or the servers or networks connected to the Service.
Use the Service for commercial purposes or for creating any competing products or services.
The Service allows you to upload and process images. By using the Service, you agree that:
You retain ownership of the images you upload to the Service.
You grant OtakuAvatar AI a non-exclusive, royalty-free, worldwide license to use, store, and process the images for the purpose of providing the Service.
You are solely responsible for the content of the images you upload and ensuring that they do not violate the rights of others, including intellectual property rights or privacy rights.
We reserve the right to remove any user-generated content that violates these Terms or our community guidelines.
The Service and all of its content, including but not limited to text, images, software, and branding, are owned by or licensed to Developer and are protected by copyright, trademark, and other intellectual property laws. You may not use, copy, modify, or distribute any content from the Service without prior written permission from us.
We use Firebase Firestore and Firebase Storage to store and process the data you upload. While we take reasonable steps to protect your data, you acknowledge and agree that no data storage or transmission over the internet can be guaranteed to be 100% secure. You are responsible for taking appropriate steps to protect your own devices and data.
You agree not to use the Service for any of the following:
Illegal Activities: Any activity that violates laws, regulations, or third-party rights.
Harmful Content: Uploading or transmitting harmful, offensive, or illegal content.
Malicious Behavior: Attempting to gain unauthorized access to the Service or engaging in hacking or other malicious activities.
Impersonation: Using the Service to impersonate any person or entity.
We reserve the right to suspend or terminate your access to the Service at our discretion if we believe you have violated these Terms. You may also terminate your access by uninstalling the app and ceasing to use the Service. Upon termination, all rights and licenses granted to you under these Terms will immediately cease, and you must stop using the Service.
To the fullest extent permitted by law, Developer shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, even if we have been advised of the possibility of such damages. Our liability for any claim arising out of these Terms shall be limited to the amount you paid, if any, for using the Service during the 12-month period immediately preceding the claim.
You agree to indemnify, defend, and hold harmless Developer, its affiliates, employees, contractors, and agents from any claims, liabilities, damages, or expenses (including reasonable attorneys’ fees) arising from:
Your use of the Service.
Your violation of these Terms or the rights of any third party.
Any content you upload to the Service.
We reserve the right to update or modify these Terms at any time. If we make changes to the Terms, we will post the updated Terms on this page, and the effective date will be updated. Your continued use of the Service after such changes will constitute your acceptance of the modified Terms.
These Terms will be governed by and construed in accordance with the laws of Turkey, without regard to its conflict of law principles. Any legal action arising from these Terms shall be brought in the courts located in Turkey.
If any disputes arise between you and Developer related to the Service or these Terms, we encourage you to first contact us to resolve the issue informally. If we cannot resolve the dispute informally, we may agree to resolve the dispute through binding arbitration or mediation, as determined by mutual agreement.
