END USER LICENSE AGREEMENT (EULA)
This End User License Agreement (the "Agreement") is a legal agreement between you (the "User" or "You") and TokToMe (the "Company") governing your use of the TokToMe software (the "Software"). By installing, accessing, or using the Software, you agree to be bound by the terms and conditions of this Agreement. If you do not agree to these terms, you may not use the Software.
1. Grant of License
Subject to your compliance with the terms of this Agreement, the Company grants you a limited, non-exclusive, non-transferable, and revocable license to use the Software for personal, non-commercial purposes. The license is granted solely for your use and does not allow you to sublicense or distribute the Software.
2. Intellectual Property
The Software, including any content, features, and functionality, is owned by the Company and is protected by intellectual property laws and treaties. You acknowledge that the Company retains all rights, title, and interest in the Software, and you agree not to modify, adapt, translate, or create derivative works based on the Software.
3. User Obligations
a. Use Restrictions: You agree not to use the Software in any manner that violates applicable laws or infringes upon the rights of others. You shall not engage in any activity that disrupts, interferes with, or harms the functionality of the Software or its users.
b. User Content: You are solely responsible for the content you transmit or share through the Software. You represent and warrant that you have the necessary rights to transmit or share such content and that it does not violate any third-party rights or applicable laws.
c. Privacy and Security: The Company cannot guarantee the privacy and security of the messages and media shared through the Software, as it is a public chat app. By participating in a group, you acknowledge that all participants in that group can see all the messages and media shared within the group. Additionally, bugs and privacy issues may occur due to the experimental nature of this pilot version.
4. Phone Numbers
By participating in the same group within the chat app, users may have access to each other's phone numbers. It is your responsibility to exercise caution and discretion when sharing personal information within the app.
5. Message Deletion
Users have the ability to delete their own messages within the chat app. However, please note that deleted messages may still be visible to other users who have already viewed them or to whom they were forwarded before deletion.
6. Privacy and Data Collection
a. Data Collection: The Company may collect and process certain information about you in connection with your use of the Software. The Company's data collection practices are governed by its Privacy Policy, which you should review to understand how your information is handled.
b. User Consent: By using the Software, you consent to the collection, processing, and storage of your information as described in the Privacy Policy.
7. Disclaimer of Warranty
The Software is provided on an "as is" and "as available" basis, without warranties of any kind, whether express or implied. The Company does not warrant that the Software will be error-free or uninterrupted, or that any defects will be corrected. You use the Software at your own risk.
8. Limitation of Liability
To the maximum extent permitted by law, the Company and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, arising out of or in connection with the use or inability to use the Software.
9. Termination
This Agreement is effective until terminated by either party. The Company may terminate this Agreement at any time without notice if you breach any provision of this Agreement. Upon termination, you must cease all use of the Software and destroy all copies of the Software in your possession.
10. Governing Law and Jurisdiction
This Agreement shall be governed by and construed in accordance with the laws of [Your Jurisdiction]. Any dispute arising out of or in connection with this Agreement shall be submitted to the exclusive jurisdiction of the courts of [Your Jurisdiction].
