## Terms of Use

### 1. Acceptance of Terms

By downloading, installing, accessing, or using Times Table, the "App," you agree to be bound by these Terms of Use, the "Terms," and our Privacy Policy. If you do not agree to these Terms, do not use the App.

You must be at least 13 years old to use the App, or at least 16 years old if you are located in the European Economic Area. If you are under the age of majority in your jurisdiction, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.

### 2. Description of Service

Times Table is an educational and entertainment app designed to help users practice multiplication and related arithmetic skills through guided study, quizzes, and game-based activities.

The App may allow users to:

- Practice multiplication tables and related arithmetic facts

- Access multiplication, division, and mixed practice modes where available

- Use quiz modes, timed challenges, and game-based learning activities

- Track scores, streaks, progress insights, and saved settings where available

- Unlock premium features, including broader content access, reduced or removed advertising, and other subscription-based functionality where offered

The App is provided for educational, entertainment, and personal practice purposes only. The App does not guarantee specific educational outcomes, exam performance, mastery, or accuracy for every user.

The App is provided on an "as is" and "as available" basis. Availability, speed, and feature access may vary based on device compatibility, operating system, network conditions, app store services, third-party providers, and other factors.

### 3. Accounts, Devices, and Access

The App may use device-based identifiers, app-instance data, marketplace purchase records, analytics identifiers, locally stored preferences, onboarding state, review-prompt state, saved table settings, free-tier access counters, or similar technical data to manage feature access, subscriptions, app performance, and abuse prevention.

You are responsible for:

- Maintaining the security of your device

- All use of the App from your device

- Using the App only in compliance with applicable laws and app store rules

We may suspend, restrict, or terminate access if we detect abuse, fraud, unauthorized automation, attempts to bypass limits or premium access controls, or violations of these Terms.

### 4. User Conduct and Prohibited Uses

You agree to use the App only for lawful, personal, and non-commercial purposes unless expressly permitted by us in writing.

You may not use the App to:

- Violate any law, regulation, or third-party right

- Reverse engineer, decompile, scrape, copy at scale, or attempt to extract source logic or protected app content except as permitted by law

- Bypass paywalls, premium access restrictions, restore controls, onboarding controls, feature gates, or subscription restrictions

- Use bots, scripts, or automated systems to access the App at scale

- Resell, repackage, or offer the App or its components as a standalone paid or commercial product

- Interfere with the App's normal operation, security, advertising systems, analytics systems, or payment flows

Violations may result in immediate suspension, restriction, or termination of access.

### 5. Intellectual Property and Licensing

#### 5.1 Ownership

JanoGroup LLC, its affiliates, licensors, and service providers retain all rights, title, and interest in and to the App, including its software, design, interfaces, branding, lesson structure, game mechanics, animations, progress systems, and original materials.

#### 5.2 Free Tier License

Free access grants you a limited, revocable, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes only, subject to feature restrictions or advertising-supported access shown in the App.

#### 5.3 Paid Subscription License

If you purchase or activate a paid subscription or trial, you receive a limited, personal, non-exclusive, non-transferable license to use premium App features during the active subscription period.

Premium access may include broader learning content, progress-related features, a cleaner experience, reduced or removed advertising where offered, and other premium features made available in the App.

Paid access does not grant you the right to:

- Resell App content or functionality commercially

- Build a competing product from App content, design, or logic

- Perform automated bulk extraction or republication of App materials

#### 5.4 Third-Party Providers

Parts of the App rely on third-party providers, including app marketplaces, payment processors, subscription platforms, analytics providers, advertising services, app review services, sharing services, hosting providers, and infrastructure providers.

We are not responsible for outages, policy changes, pricing changes, service interruptions, or other issues caused by third-party providers.

#### 5.5 Copyright Complaints

If you believe content or materials in the App infringe your copyright, contact us at janogroupllc@gmail.com with:

- Your contact information

- Identification of the copyrighted work

- Identification of the allegedly infringing material

- A good-faith statement that the use is unauthorized

- A statement that the information you provide is accurate

We may remove or restrict access to content in appropriate circumstances.

### 6. Subscriptions, Usage Limits, and Billing

Usage and features may vary by plan, app version, offer, platform, country, or marketplace.

Current access may include:

**Free Tier**

- Access: Core learning features and advertising-supported access

- Features: Basic table practice, selected quizzes or games, saved local preferences, and other free features shown in the App

- Notes: Certain tables, game modes, insights, or ad-free access may require an upgrade

**Trial or Promotional Plan**

- Access: Temporary premium or expanded feature access where offered

- Features: Premium content and reduced or removed gating during the offer period

- Notes: Availability may vary by offer, marketplace, or eligibility

**Paid Premium**

- Access: Premium features during the active subscription period

- Features: Reduced or removed advertising where offered, broader access to tables or practice modes, progress-related features, and other available premium functionality

- Notes: Auto-renews unless canceled

Additional terms:

- Billing, renewals, cancellation rights, and refunds are handled by Apple, Google, or another applicable app marketplace, except where otherwise required by law.

- Prices, offer availability, subscription names, trial length, and feature descriptions shown in the App or app store listing control over any examples in these Terms.

- We may update pricing, plan structure, or feature availability at any time to reflect operational costs, service changes, legal requirements, or provider changes.

### 7. Technology and Service Limitations

The App uses software-based question generation, locally stored preferences, analytics tools, app-store purchase systems, advertising services, and other third-party platform services.

Results and features may:

- Vary by platform, operating system version, device performance, or region

- Be interrupted by app store, subscription, network, analytics, review-service, or advertising-service issues

- Change over time as features, question formats, premium offerings, or content sets are updated

- Depend on permissions you grant, such as tracking-related permissions where applicable

We do not guarantee continuous uptime, uninterrupted access, specific learning outcomes, or availability of any particular feature on every device.

### 8. Privacy and Data Protection

Your use of the App is also governed by our Privacy Policy, which explains how we collect, use, process, and store information, including app analytics, subscription status, device-related information, preferences, onboarding state, saved settings, progress-related data stored by the App, and advertising or attribution-related data where applicable.

### 9. Disclaimers and Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, OR RELIABILITY.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, JANOGROUP LLC WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOSS OF DATA, BUSINESS, REVENUE, PROFITS, GOODWILL, OR REPUTATION ARISING OUT OF OR RELATED TO YOUR USE OF THE APP.

This includes, without limitation, losses or damages resulting from:

- Reliance on App content, progress indicators, quiz results, or performance summaries

- Decisions made using the App for school placement, grading, testing, or other important outcomes

- Subscription, billing, restore-purchase, marketplace, or third-party service issues

- Advertising failures, analytics outages, data loss, or device-related issues

- Loss of saved settings, progress data, streaks, or preferences

Our total liability for any claim arising out of or relating to the App will not exceed the greater of:

**(A)** the amount you paid to us for the App in the 12 months before the claim, or 

**(B)** USD $25.

### 10. Indemnification

You agree to indemnify, defend, and hold harmless JanoGroup LLC, its affiliates, officers, employees, contractors, licensors, and service providers from and against any claims, liabilities, damages, judgments, losses, costs, and expenses, including reasonable attorneys' fees, arising from or related to:

- Your use or misuse of the App

- Your violation of these Terms or applicable law

- Your attempts to bypass technical or subscription restrictions

### 11. Dispute Resolution and Governing Law

These Terms are governed by the laws of Delaware, USA, without regard to conflict-of-law principles.

Any dispute, claim, or controversy arising out of or relating to these Terms or the App will be resolved by binding arbitration under the AAA Consumer Rules, conducted in English, in Washington, DC, or virtually, unless applicable law requires otherwise.

You and JanoGroup LLC agree that disputes will be brought only on an individual basis and not as part of any class, collective, consolidated, or representative proceeding.

You may opt out of arbitration within 30 days of first accepting these Terms by emailing janogroupllc@gmail.com with the subject line "Arbitration Opt-Out."

If you opt out, exclusive jurisdiction for disputes will lie in the state or federal courts located in Washington, DC, to the extent permitted by law.

### 12. Termination

You may stop using the App at any time and may cancel subscriptions through the applicable app store account settings.

We may suspend, restrict, or terminate access immediately if we believe you have violated these Terms, abused the App, attempted to bypass restrictions, or created legal, security, or operational risk.

Upon termination, your right to use the App ends immediately. Any provisions that by their nature should survive termination will survive, including ownership, disclaimers, limitations of liability, indemnification, and dispute-resolution provisions.

### 13. Changes to These Terms

We may update these Terms from time to time. Material changes may be communicated in the App, through release notes, or by other reasonable means.

Your continued use of the App after updated Terms become effective constitutes acceptance of the revised Terms.

### 14. General Provisions

These Terms, together with the Privacy Policy, form the entire agreement between you and JanoGroup LLC regarding the App and supersede all prior or contemporaneous understandings relating to the App.

If any provision is found unenforceable, the remaining provisions will remain in full force and effect. Our failure to enforce any provision is not a waiver. We may assign or transfer these Terms in connection with a merger, acquisition, financing, or sale of assets.
