Focus Dew – Terms of Use

These Terms of Use ("Terms") govern your use of the Focus Dew app ("the app"), developed by Khandker Tafiqul Islam ("we", "us"). By downloading or using the app, you agree to these Terms and to Apple's Licensed Application End User License Agreement (https://www.apple.com/legal/internet-services/itunes/dev/stdeula/). If you do not agree, please do not use the app.
1. THE APP
Focus Dew helps you build habits, track streaks, run focus and Pomodoro timers and, with Deep Focus, block distracting apps using Apple's Screen Time tools. Features may change over time.
2. NOT MEDICAL ADVICE
Focus Dew is a productivity and self-help tool. It is not a medical device and does not diagnose, treat or replace professional care for ADHD or any other condition. Please talk to a qualified health professional about any questions you have about your health.
3. FREE VERSION AND PREMIUM
Focus Dew is free to download. Optional Premium features are available as an auto-renewing subscription or a one-time lifetime purchase. Plans, prices and what each plan includes are shown in the app before you buy, may vary by country and may change in the future.
- Payment is charged to your Apple Account when you confirm the purchase.
- Subscriptions renew automatically unless auto-renew is turned off at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours before the end of the current period.
- Some plans include a free trial. If you do not cancel at least 24 hours before the trial ends, the subscription starts and you will be charged. Any unused part of a free trial is forfeited when you purchase a subscription.
- You can manage or cancel your subscriptions at any time in your Apple Account settings. If you cancel, Premium stays active until the end of the current period.
- All payments are processed by Apple. Refunds are handled by Apple under its policies; you can request one at https://reportaproblem.apple.com. We cannot issue refunds directly.
- Use "Restore Purchases" in the app to restore Premium on devices signed in with the same Apple Account.
4. YOUR DATA
Your habits and sessions are stored on your device and, if enabled, in your private iCloud. If you want to keep your data, keep iCloud turned on or back up your device. Our Privacy Policy explains how we handle information: https://sites.google.com/view/timer1/privecy_policy
5. DEEP FOCUS AND SCREEN TIME
Deep Focus relies on Apple's Screen Time and Family Controls frameworks. Blocking depends on iOS and your device settings, so we cannot guarantee that every app or website will always be blocked. You can end a session at any time. Do not rely on Deep Focus for safety-critical purposes.
6. ACCEPTABLE USE
You agree not to copy, modify, reverse engineer, resell or redistribute the app (except where the law allows), interfere with the app or the services it uses, use it for any unlawful purpose, or try to access Premium features without paying.
7. ADS AND THIRD-PARTY SERVICES
The free version shows ads, and the app uses third-party services described in our Privacy Policy. We are not responsible for third-party content, websites or services.
8. INTELLECTUAL PROPERTY
The app, including its design, text, graphics and code, belongs to us or our licensors. We grant you a personal, non-exclusive, non-transferable, revocable licence to use the app on Apple devices that you own or control, as permitted by Apple's Usage Rules.
9. DISCLAIMERS
The app is provided "as is" and "as available". To the extent permitted by law, we do not promise that the app will be uninterrupted or error-free, that it will meet your needs, or that reminders, timers and streaks will always work as expected.
10. LIMITATION OF LIABILITY
To the extent permitted by law, we are not liable for any indirect, incidental, special or consequential loss, or for loss of data, profits or goodwill. Our total liability for any claim relating to the app is limited to the amount you paid for the app in the 12 months before the claim. Nothing in these Terms limits liability that cannot be limited by law or affects your statutory rights as a consumer.
11. TERMINATION
You can stop using the app at any time by deleting it. Remember to cancel any active subscription in your Apple Account settings. We may suspend or end your access to the app if you break these Terms.
12. CHANGES TO THESE TERMS
We may update these Terms from time to time. We will change the "Last updated" date above. If you continue to use the app after the changes take effect, you accept the updated Terms.
13. APPLE
These Terms are between you and us, not Apple. Apple is not responsible for the app or its content and has no obligation to provide maintenance or support for it. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
14. GOVERNING LAW
These Terms are governed by the laws of Bangladesh, and the courts of Narayanganj, Bangladesh have jurisdiction. This does not take away any mandatory consumer protection rights you have under the laws of the country where you live.
15. LANGUAGE
If these Terms are translated, the English version applies in case of any difference.
