These Terms and Conditions ("Terms", "Agreement") constitute a legally binding agreement between ThinkSay ("ThinkSay", "we", "our", or "us") and you ("User", "you", or "your"). This Agreement governs your use of the ThinkSay mobile application, a text-to-speech app, and any related products or services (collectively, the “Service”).

If your account is terminated for any of the reasons outlined in this Agreement, you may not re-register or continue using the Service.

Prohibited Uses

In addition to other restrictions set forth in this Agreement, you are prohibited from using ThinkSay or its content:

(a) for any unlawful purpose;
(b) to solicit others to perform or participate in unlawful acts;
(c) to violate any international, federal, provincial, state, or local laws or regulations;
(d) to infringe upon or violate our intellectual property rights or the intellectual property rights of others;
(e) to harass, abuse, insult, harm, defame, slander, disparage, intimidate, or discriminate based on gender, sexual orientation, religion, ethnicity, race, age, national origin, or disability;
(f) to submit false, misleading, or deceptive information;
(g) to upload or transmit viruses, malware, or any other malicious code that could affect the functionality or operation of the Service or the Internet;
(h) to collect, store, or track the personal information of others without authorization;
(i) to spam, phish, pharm, pretext, spider, crawl, or scrape;
(j) to generate, convert, or distribute obscene, immoral, or offensive audio content; or
(k) to interfere with or circumvent the security features of the Service or any related applications.

We reserve the right to suspend or terminate your access to the Service for violating any prohibited uses.

Subscription Fees, Payment Terms, and Refund Policy

ThinkSay offers optional Premium Services that unlock additional text-to-speech features.

Free Trial

Users may cancel at any time during the free trial period before being charged.

Subscription Pricing

• $6.99 / Per Week

• $44.99 / Lifetime

Billing & Renewal

Payment will be charged to your Apple ID (iTunes Account) upon confirmation of purchase. Subscriptions automatically renew unless auto-renew is disabled at least 24 hours before the end of the current subscription period. Your account will be charged for renewal within 24 hours prior to the end of the current period.

Cancellation

No cancellation of the current subscription is permitted during an active billing cycle. You may manage or disable auto-renewal through your Apple Account Settings.

Pricing Changes

ThinkSay reserves the right to change subscription pricing at any time. Updated prices will be reflected in the App Store listing.

Refund Policy

As the Service is delivered immediately upon purchase and cannot be revoked remotely, no refunds will be issued, except where required by applicable law.

Copyright Infringement

If you believe that any content available through ThinkSay infringes your copyright, please contact us and provide:

• Identification of the copyrighted work

• Your name, address, email, and phone number

• A statement of good faith belief that the use is unauthorized

• A statement under penalty of perjury that the information is accurate and that you are authorized to act on behalf of the copyright owner

• Your physical or electronic signature

Privacy Policy

The ThinkSay Privacy Policy is available at [Privacy Policy].
By using the app, you acknowledge that you have read, understood, and agreed to the Privacy Policy.

Intellectual Property Rights

This Agreement does not transfer any intellectual property rights owned by ThinkSay or third parties. All trademarks, logos, voices, audio outputs, graphics, and service marks associated with ThinkSay are owned by ThinkSay or its licensors.

Your use of the app does not grant you any license or right to use these intellectual property assets beyond personal, non-commercial use of the Service.

Limitation of Liability

To the fullest extent permitted by law, ThinkSay and its affiliates, employees, partners, or licensors shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business interruption.

In no event shall our total liability exceed the greater of one dollar ($1) or the amount paid by you to ThinkSay in the one month preceding the event giving rise to the claim.

Dispute Resolution

This Agreement shall be governed by and construed in accordance with the laws of Bangladesh. Any disputes arising from this Agreement shall be resolved exclusively in the courts located in Bangladesh.

You waive any right to a jury trial. The United Nations Convention on Contracts for the International Sale of Goods (CISG) does not apply.

Changes and Amendments

We reserve the right to modify or replace this Agreement at any time. Any changes will become effective upon posting within the app, with the updated date displayed below.

Continued use of ThinkSay after changes are posted constitutes acceptance of the revised Terms.

Acceptance of Terms

By accessing or using the ThinkSay mobile application or its services, you acknowledge that you have read, understood, and agree to be bound by this Agreement. If you do not agree, you must discontinue use of the app immediately.
