General Disclaimer and Liability Clause
1. General Disclaimer
The Bike Dungeon LLC provides bicycle repair, maintenance, and related services (“Services”) on an as-is basis. While the Company exercises reasonable care and skill in performing Services, no warranty—express or implied—is given as to the quality, performance, or fitness of any repaired or serviced bicycle or component. Customers acknowledge that bicycles, like all mechanical devices, are subject to wear, damage, and failure even after proper service.
2. Customer Responsibility
Customers are responsible for providing accurate information regarding the bicycle’s condition and prior use. Upon completion of Services, the Customer must inspect the bicycle and test its functionality before use. Continued use of the bicycle after retrieval from the Company constitutes acceptance of the Services as satisfactory.
3. Limitation of Liability
To the fullest extent permitted by Pennsylvania law, the Company shall not be liable for any indirect, incidental, consequential, or punitive damages, including but not limited to personal injury, property damage, or loss of use, arising from or related to Services performed. The Company’s total liability, if any, shall not exceed the amount paid by the Customer for the specific Services giving rise to the claim.
4. Parts and Materials
Parts supplied by the Customer are installed at the Customer’s own risk. The Company assumes no responsibility for the suitability, compatibility, or future performance of customer-supplied parts or accessories.
5. Assumption of Risk
Cycling and bicycle maintenance inherently involve risk. By authorizing Services and using the repaired bicycle, the Customer acknowledges and voluntarily assumes all risks associated with bicycle operation, including the possibility of mechanical failure.
6. Governing Law
This Agreement shall be governed by and construed in accordance with the laws of the Commonwealth of Pennsylvania. Any disputes shall be brought exclusively in the appropriate state or federal courts located in Pennsylvania.
The Bike Dungeon LLC will have the right to sell, dispose of, or use any such item in any way it chooses. The customer releases the business from any and all claims and liability for items left beyond this 30-day period.
