Night Shift is a 1982 American comedy film directed by Ron Howard. The film centers on a timid night-shift morgue employee whose life is turned upside down by a new co-worker who fancies himself a free-spirited entrepreneur. It stars Howard's Happy Days co-star Henry Winkler along with Michael Keaton, in his first starring role,[2] and Shelley Long. Also appearing are Richard Belzer and Clint Howard. There are brief scenes with a young Kevin Costner[3] as "frat boy #1", Shannen Doherty as a Bluebird scout,[4] Vincent Schiavelli as a man who delivers a sandwich,[5] and Charles Fleischer[6] as one of the jail prisoners.

Charles "Chuck" Lumley, formerly a successful stockbroker, has found a refuge from the ulcer-inducing Wall Street rat race in his job as an attendant at a New York City morgue. His displeasure at being "promoted" to night-shift supervisor to make room for his boss' nephew, Leonard, is exacerbated by the irrational exuberance of Bill "Blaze" Blazejowski, his new co-worker. They are inspired by the plight of Chuck's prostitute neighbor, Belinda, to apply Chuck's financial acumen and Bill's entrepreneurial spirit to open a prostitution service headquartered at the morgue.

The film's opening theme song is "Night Shift" by Quarterflash.[9] The closing theme song, "That's What Friends Are For" was written by Burt Bacharach and Carole Bayer Sager and performed by Rod Stewart.[9] It gained popularity a few years later when covered by Dionne Warwick, Elton John, Gladys Knight, and Stevie Wonder.[9]

After earning my doctorate in pharmacy (waaay back at the turn of the century), I landed my first job as a newly-minted pill-pusher at the busy teaching hospital where I still work. I loved the challenge of being a clinical pharmacist, but the unpredictability of my shifts was a source of constant frustration.

Night shift differential means the differential paid for work performed when the majority of a prevailing rate employee's regularly scheduled nonovertime hours fall between 3 p.m. and 8 a.m. It is computed as a percentage of the employee's rate of basic pay.

Night shift differential is paid for regularly scheduled work performed at night. This generally means work scheduled before the beginning of the administrative workweek. Overtime hours do not count toward an employee's entitlement to receive a night shift differential.

Night shift differential is included in the rates of basic pay for prevailing rate employees and is used as a basis for computing overtime pay, Sunday pay, holiday pay, and amounts of deductions for retirement and group life insurance.

A prevailing rate employee regularly assigned to a day shift who is temporarily assigned to a night shift will be paid a night shift differential for any leave with pay taken when scheduled to work night shifts.

A prevailing rate employee assigned to a regular rotating schedule involving work on both day and night shifts will be paid a night shift differential for any leave with pay taken when scheduled to work night shifts.

A prevailing rate employee who is not regularly assigned to a day shift or a night shift but whose shift is changed at irregular intervals will be paid a night shift differential during leave with pay if the employee received a night shift differential for the last shift worked preceding the leave with pay.

A prevailing rate employee is entitled to the night shift differential for periods of excused absence on a holiday, while in official travel status during the hours of the employee's regular night shift, or on court leave.

A prevailing rate employee who works on a regularly scheduled shift of less than 8 hours duration (such as a part-time or intermittent employee) is entitled to a night shift differential if a majority of the employee's hours are worked during a period in which a night shift differential is payable.

There is no authority to permit a splitting of the night shift differential. An employee will either receive a 7 percent differential for an entire shift or a 10 percent differential for an entire shift if a majority of hours worked occur during the hours authorized for a night shift differential.

Meal breaks of 1 hour or less that occur when a night shift differential is authorized should be included for purposes of determining a prevailing rate employee's entitlement to a night shift differential. Thus, when an employee works from 11:30 a.m. to 8 p.m., with a meal break from 3:30 p.m. to 4 p.m., the 30-minute meal break is included to determine that a majority of hours of work occur during the second shift and a 7 percent night shift differential is payable.

Night shift differential will not be paid solely because a prevailing rate employee elects to work credit hours, or elects a time of arrival or departure at a time of day when night shift differential is otherwise authorized, except that prevailing rate employees are entitled to night shift differential for regularly scheduled nonovertime work when a majority of the hours of a flexible work schedule for a daily tour of duty occur during the night.

Part of basic pay. Night differential is part of a Federal Wage System (FWS) employee's basic pay. Night shift differential means the differential paid to a FWS employee when the majority of regularly scheduled non-overtime hours worked fall between 3 p.m. and 8 a.m. local time, and is computed as a percentage of the employee's rate of basic pay. (Title 5, Code of Federal Regulations (CFR) 532.501). Night shift differential is included in the rates of basic pay for FWS employees and is used as a basis for computing overtime pay, Sunday pay, holiday pay, and amounts of deductions for retirement and group life insurance.


Night shift differential rates. A FWS employee is entitled to a night shift differential when the majority of hours worked during a regularly scheduled non-overtime shift occur in either of these two shifts (5 U.S.C.  5343(f)):


"Majority of hours" means a number of whole hours greater than one-half (including meal breaks), e.g., 5 hours of a scheduled 8-hour shift. The night shift differential is paid for the entire shift when the majority of hours fall within the specified periods.


Overtime and night shift differential.  When an employee who regularly works a night shift performs overtime work which extends into or falls entirely within a day shift, they are entitled to overtime pay computed on the night shift differential rate (5 CFR 532.503(d)(1).


When overtime is performed on a non-workday, the employee is entitled to receive overtime pay computed on the rate of the employee's last previous regularly scheduled shift (5 CFR 532.503(d)(2)).


When an employee who is regularly assigned to a rotating schedule involving work on both day and night shifts performs overtime work which extends into or falls entirely within the succeeding shift, they are entitled to overtime pay computed on the rate of their regularly scheduled shift in effect for that calendar day (5 CFR 532.503(e)(1)).

When an employee regularly assigned to a rotating schedule performs work on a non-workday, they are entitled to overtime pay computed on the average rate of basic pay for all regularly scheduled shifts worked by the employee during the basic workweek (5 CFR 532.503(e)(2)).

Night shift differential temporary assignment to a different tour of duty.  An employee regularly assigned to a day shift who is temporarily assigned to a night shift must be paid a night shift differential.


An employee regularly assigned to a night shift who is temporarily assigned to a day shift or to a night shift having a lower night shift differential (including a temporary detail for training purposes) shall continue to receive their regular night shift differential.


An employee regularly assigned to a night shift, who is temporarily assigned to another night shift which has a higher differential, must be paid the higher differential if a majority of the employee's regularly scheduled non-overtime hours of work on the temporary shift fall within hours with the higher differential (5 CFR 532.505(d)).


Night shift differential and substituting an employee.  A FWS employee who renders occasional or irregular night service, as a substitute for another FWS employee on a regularly scheduled night shift, is entitled to night shift differential for non-overtime work. 2351a5e196
