Terms of Service for Morphic AI - AI Face Swap

Welcome to Morphic AI - AI Face Swap. These Terms of Service (“Terms”) constitute a legal agreement between you and zhaoyaxue (“we”, “us”, or “our”) governing your use of the Morphic AI mobile application (the “Service”).

1. Acceptance of Terms

By downloading, installing, or using the Service, you confirm that you have read, understood, and agreed to be bound by these Terms. If you do not agree to these Terms, you must immediately cease using the Service and uninstall the application.

2. Eligibility

You must be at least 13 years old (or the minimum legal age in your jurisdiction) to use this Service. If you are under the age of majority in your country, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.

3. AI Services and Content

3.1 Input and Output: You may upload images or videos (“Input”) to generate transformed visual content (“Output”) using our AI technology.

3.2 User Ownership: You retain all ownership rights to your Input. To the maximum extent permitted by applicable law, you own the Output generated through the Service.

3.3 License to Us: Solely for the purpose of providing the Service (processing the transformation), you grant us a temporary, worldwide, non-exclusive, royalty-free license to process your Input. As detailed in our Privacy Policy, this process is transient; we do not retain your original Input or facial feature data once the Output is generated and delivered to you.

4. User Representations and Warranties

By uploading any content containing a human face, you represent and warrant that:

You have obtained explicit consent and all necessary legal rights from any individual(s) appearing in the content.

Your use of the Service does not infringe upon the privacy, publicity, or intellectual property rights of any third party.

You assume full legal responsibility for any claims or liabilities arising from the creation or distribution of Output featuring the likeness of others.

You will not use the Service to attempt to circumvent biometric security, identity verification, or any other authentication systems.

5. Prohibited Uses

You strictly agree NOT to use Morphic AI to:

Create "Deepfake" content for the purpose of harassment, defamation, bullying, or sexual exploitation.

Impersonate public figures or create deceptive content intended to spread misinformation or influence political processes.

Generate content that is illegal, sexually explicit, promotes violence, or constitutes hate speech.

Reverse engineer, decompile, or attempt to extract the source code or proprietary algorithms of our AI models.

Violate any local or international laws regarding biometric privacy (e.g., BIPA, GDPR, CCPA).

6. Subscription and Billing

6.1 Premium Services: Morphic AI may offer premium features via auto-renewable subscriptions or one-time purchases.

6.2 Payment Processing: All payments are handled securely through the Apple App Store. Your purchases are subject to Apple’s standard Media Services Terms and Conditions.

6.3 No Refunds: Because AI processing incurs immediate computational costs, subscriptions and purchases are generally non-refundable once an AI generation has been initiated, except where required by local law or specific App Store policies.

7. Disclaimers

"As Is" Basis: The Service is provided on an “AS IS” and “AS AVAILABLE” basis. We do not guarantee that the AI Output will be accurate, meet your expectations, or be free of artifacts.

AI Evolution: You acknowledge that AI technology is experimental and may occasionally produce unexpected or offensive results. We are not responsible for such occurrences but provide reporting tools for feedback.

8. Limitation of Liability

To the maximum extent permitted by law, zhaoyaxue shall not be liable for any indirect, incidental, or consequential damages arising from your use of the Service. Our total aggregate liability shall not exceed the amount you paid us in the last twelve (12) months or $50.00 USD, whichever is greater.

9. Governing Law

These Terms are governed by and construed in accordance with the laws of the jurisdiction in which the developer is located, without regard to conflict of law principles.
