FitCoach is offered by DREAM AHEAD PTE. LTD. (“DREAM AHEAD,” “we,” “us,” or “our”). These Terms of Service (“Terms”) govern your use of the FitCoach mobile application. By downloading, accessing, or using FitCoach, you agree to these Terms and to the FitCoach Privacy Policy. If you do not agree, do not use FitCoach.
1. Fitness Guidance Only
FitCoach provides general fitness and wellness guidance. It is not medical advice, medical treatment, diagnosis, or a substitute for advice from a qualified healthcare professional. Consult a physician or other qualified professional before beginning or changing an exercise program, especially if you have an injury, medical condition, or other health concern. Stop exercising and seek medical advice if you experience pain, dizziness, faintness, shortness of breath, or unusual discomfort.
2. Eligibility and Safe Use
You must be legally able to accept these Terms. If you are under the age of majority where you live, a parent or legal guardian must review and accept these Terms on your behalf. You are responsible for choosing a safe workout space, using appropriate judgment, and following all product and safety instructions.
3. License and Acceptable Use
Subject to these Terms, DREAM AHEAD grants you a limited, personal, non-exclusive, non-transferable, revocable license to use FitCoach for your own non-commercial use. You may not copy, modify, distribute, sell, lease, reverse engineer, bypass security measures, or use FitCoach unlawfully or in a way that interferes with its operation or the rights of others, except where applicable law does not permit a restriction.
4. Your Device, Permissions, and Data
FitCoach requires a compatible device and may request access to your camera, Apple Health data, photo library, or notifications for optional features. You control these permissions in iOS Settings. The way FitCoach handles information is described in the Privacy Policy. You are responsible for any device, connectivity, or carrier charges associated with your use of the app.
5. Availability and Changes
We may update, change, suspend, or discontinue FitCoach or any feature when reasonably necessary, including for security, legal, or product reasons. We do not guarantee that FitCoach will be available at all times or that every workout result, rep count, workout summary, or form cue will be error-free. Use your own judgment and do not rely on FitCoach where an error could cause injury or other harm.
6. Intellectual Property
FitCoach, its software, design, content, trademarks, and other materials are owned by DREAM AHEAD or its licensors and are protected by applicable law. These Terms do not grant you ownership of any of those rights.
7. Disclaimer of Warranties and Limitation of Liability
To the fullest extent permitted by law, FitCoach is provided “as is” and “as available,” without warranties of any kind, whether express, implied, or statutory. DREAM AHEAD does not warrant that FitCoach will be uninterrupted, secure, accurate, or suitable for your particular purpose. To the fullest extent permitted by law, DREAM AHEAD and its affiliates, licensors, and suppliers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of data, profits, goodwill, or business opportunity, arising from or related to FitCoach. Nothing in these Terms limits liability that cannot lawfully be limited.
8. App Store Terms
If you obtain FitCoach through Apple’s App Store, you acknowledge that these Terms are between you and DREAM AHEAD, not Apple. Apple has no obligation to provide maintenance or support for FitCoach and is not responsible for claims relating to it. Your use of FitCoach must also comply with the App Store terms applicable to you. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
9. Changes to These Terms; Contact
We may update these Terms by posting an updated version and effective date on this page. Your continued use after the effective date means you accept the updated Terms to the extent permitted by law. For questions about these Terms, contact easysupport@cmcm.com.
