1. Agreement to Terms

Welcome to Cruzr! These Terms of Service ("Terms") govern your access to and use of the MiniHorizon mobile application ("App," "Service," "we," "us," or "our").

By creating an account or using Cruzr, you agree to be bound by these Terms and our Privacy Policy.

If you do not agree to these Terms, do not use the App.

2. Important Safety Notice

🚨 DRIVING SAFETY - CRITICAL

YOU MUST OBEY ALL TRAFFIC LAWS AND DRIVE SAFELY AT ALL TIMES.

• Never use your phone while driving except as permitted by hands-free operation under applicable law

• Never interact with the app while your vehicle is in motion unless using legal hands-free methods

• Always focus on the road - driving is your primary responsibility

• Pull over safely if you need to interact with the app

• Background tracking does not require interaction - start your drive, then focus on driving

BY USING CRUZR, YOU ACKNOWLEDGE:

• We are not responsible for accidents, injuries, or damages resulting from app use

• You are solely responsible for your driving behavior

• You will comply with all traffic laws and regulations

• You will not use the app in any way that compromises safety

3. Eligibility

Age Requirements:

• You must be at least 17 years old to use Cruzr (driving age)

• You must be at least 13 years old to create an account (COPPA compliance)

• Users under 18 must have parental/guardian permission

License Requirements:

• You represent that you have a valid driver's license in your jurisdiction

• You represent that you are legally permitted to drive

• You will not use the app for illegal driving activities

4. Account Registration

Creating an Account:

• You must provide accurate and complete information

• You must maintain the security of your account

• You are responsible for all activity under your account

• You must promptly notify us of unauthorized access

Account Rules:

• One account per person - multiple accounts are prohibited

• No account sharing - accounts are non-transferable

• No impersonation - do not pretend to be someone else

• Accurate information - keep your profile information current

We Reserve the Right to:

• Refuse registration to anyone

• Suspend or terminate accounts at our discretion

• Require additional verification

• Remove inactive accounts

5. Acceptable Use Policy

You Agree NOT To:

Content Violations:

• Upload, post, or share illegal, harmful, or offensive content

• Post content that is harassing, abusive, or threatening

• Share sexually explicit, pornographic, or adult content

• Post content promoting violence, hatred, or discrimination

• Share spam, malware, or malicious links

Behavior Violations:

• Harass, bully, or threaten other users

• Impersonate other users or entities

• Stalk or invade privacy of others

• Engage in hate speech or discrimination

• Promote illegal activities

Technical Violations:

• Hack, exploit bugs, or manipulate the app

• Use GPS spoofing or location manipulation

• Employ bots, scripts, or automation

• Reverse engineer or decompile the app

• Overload or disrupt our servers

Competition Violations:

• Cheat or game the XP system

• Use false location data to gain unfair advantages

• Exploit bugs for competitive gain

• Create fake drives or manipulated routes

• Engage in coordinated cheating with other users

Professional Conduct:

• Be respectful and courteous to other users

• Use appropriate language in groups and chats

• Report violations when you see them

• Help maintain a positive community

6. User-Generated Content

Your Content:

When you upload photos, create posts, send messages, or share content:

You Retain Ownership:

• You own the content you create and upload

• We do not claim ownership of your content

You Grant Us a License:

• You grant Cruzr a non-exclusive, worldwide, royalty-free license to:

  • Display your content in the app

  • Share your content as you direct (friends, groups, etc.)

  • Store your content on our servers

  • Process your content to provide features

• This license ends when you delete your content or account

You Represent That:

• You own or have rights to all content you upload

• Your content does not violate copyright, trademark, or other rights

• Your content does not violate these Terms

• You have permission to share any content featuring other people

Our Rights Regarding Content:

We May:

• Remove content that violates these Terms

• Moderate content to ensure community standards

• Review reported content and take action

• Use automated systems to detect violations

We Are Not Responsible For:

• Content posted by users

• Accuracy of user-generated content

• Offensive or inappropriate user content

• Loss of content due to technical issues

7. Privacy and Location Data

Location Tracking:

By using Cruzr, you understand:

• We collect GPS location data during drives

• We may collect background location during active drive sessions only

• Your location data is used as described in our Privacy Policy

• You can control location permissions in iOS Settings

Location Data Usage:

• Track your driving routes

• Calculate distance, speed, and statistics

• Award XP for exploration

• Display your location to friends (if you choose)

• Enable live drive sharing features

Your Control:

• You can end tracking by stopping your drive

• You can disable location in iOS Settings

• You can control visibility of your location to others

8. Social Features

Friends & Groups:

Friend Connections:

• You control who you add as friends

• Friends can see your profile, stats, and public drives

• You can remove friends at any time

Groups:

• Groups may be public or private

• Group admins can moderate content and members

• We may remove groups that violate these Terms

• Group chat content must follow our Acceptable Use Policy

Live Drive Sharing:

• You control when to share your live location

• You choose who to invite to live drives

• You can end sharing at any time

Leaderboards & Competition:

• Leaderboards are based on legitimate driving activity

• Cheating or manipulation will result in removal from leaderboards

• We may reset stats if manipulation is detected

• Leaderboard positions are not guaranteed and may change

9. Experience Points (XP) & Gamification

XP System:

How XP Works:

• Earn XP by driving and exploring new areas

• XP calculations are automated and may change

• XP is for entertainment purposes only and has no monetary value

We Reserve the Right To:

• Modify XP calculations at any time

• Reset XP if cheating is detected

• Remove badges or achievements obtained through violations

• Change gamification features without notice

Prohibited Activities:

• GPS spoofing to falsify location

• Driving loops solely to game the system

• Exploiting bugs for XP gain

• Coordinated manipulation with other users

Consequences:

• First offense: Warning and XP adjustment

• Repeat offenses: Account suspension or termination

• Severe violations: Permanent ban

10. Photos & Media

Uploading Photos:

Content Guidelines:

• Photos must be appropriate for all ages

• No sexually explicit or suggestive content

• No graphic violence or gore

• No illegal activity depicted

• No copyrighted material without permission

Profile & Car Photos:

• Photos must accurately represent you or your car

• No misleading or deceptive photos

• No photos of other people without consent

We May Remove:

• Photos that violate these guidelines

• Photos reported by other users

• Photos deemed inappropriate by our team

11. Intellectual Property

Cruzr's Rights:

We Own:

• The Cruzr app and all its features

• Our logo, trademarks, and branding

• The design, layout, and user interface

• All app code and technology

You May Not:

• Copy, modify, or distribute our app

• Use our trademarks without permission

• Create derivative works

• Remove copyright notices

Your Rights:

• You retain ownership of content you create

• We only use your content as described in these Terms

• You can delete your content at any time

12. Prohibited Uses

You May Not Use Cruzr To:

Illegal Activities:

• Engage in or promote illegal street racing

• Plan or coordinate illegal activities

• Violate traffic laws or regulations

• Engage in reckless or dangerous driving

Commercial Use:

• Sell or resell access to the app

• Use for commercial purposes without permission

• Scrape or harvest data from the app

• Advertise or promote businesses without permission

Harmful Activities:

• Transmit viruses or malicious code

• Interfere with app functionality

• Bypass security measures

• Access unauthorized areas of the app

13. Account Suspension & Termination

We May Suspend or Terminate Your Account If:

• You violate these Terms

• You engage in prohibited activities

• You harass or harm other users

• You cheat or manipulate the system

• You post inappropriate content

• We receive legal requests

• Your account is inactive for extended periods

Process:

Warning System:

1. First violation: Warning (usually)

2. Second violation: Temporary suspension (3-30 days)

3. Third violation: Permanent termination

Immediate Termination May Occur For:

• Severe safety violations

• Illegal activities

• Severe harassment or threats

• Coordinated cheating schemes

• Repeated violations after warnings

Your Rights:

• Appeal process available for suspensions

• Contact us to dispute termination

• Export your data before account deletion (if requested in advance)

Upon Termination:

• You lose access to your account

• Your content may be deleted

• You may not create a new account without permission

• Outstanding obligations remain (if applicable)

14. Data Backup & Loss

Important Notice:

We Are Not Responsible For:

• Loss of your data due to technical issues

• Deletion of content by you or others

• Data loss during account termination

• Corruption of drive data or statistics

You Should:

• Regularly back up important data

• Export drive history if desired

• Not rely on Cruzr as your only data storage

We Make Reasonable Efforts To:

• Maintain data backups

• Prevent data loss

• Restore data when possible

15. Third-Party Services

Cruzr Uses:

• Firebase/Google Cloud (data storage, authentication)

• Google Sign-In (authentication)

• Apple Maps (mapping services)

• Other third-party services as needed

Important:

• These services have their own terms and privacy policies

• We are not responsible for third-party services

• Third-party services may change or discontinue

16. Disclaimers & Limitation of Liability

Disclaimer of Warranties:

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND.

We disclaim all warranties, including:

• Merchantability

• Fitness for a particular purpose

• Non-infringement

• Accuracy or reliability of content

• Uninterrupted or error-free operation

Limitation of Liability:

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CRUZR SHALL NOT BE LIABLE FOR:

• Indirect, incidental, or consequential damages

• Lost profits or data

• Accidents or injuries related to driving

• User-generated content

• Third-party actions

• Service interruptions

• Data loss or corruption

TOTAL LIABILITY SHALL NOT EXCEED $100 OR THE AMOUNT YOU PAID US IN THE LAST 12 MONTHS, WHICHEVER IS GREATER.

Driving Safety Disclaimer:

YOU ACKNOWLEDGE THAT:

• Cruzr is not a driving assistant or safety device

• We do not monitor your driving behavior in real-time

• We are not responsible for accidents, injuries, or violations

• You are solely responsible for safe driving

17. Indemnification

You agree to indemnify and hold harmless Cruzr, its affiliates, officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from:

• Your use of the app

• Your violation of these Terms

• Your violation of any rights of others

• Your driving behavior

• Content you post or share

• Your account or actions

18. Changes to the Service

We May:

• Modify features at any time

• Add or remove functionality

• Change XP calculations or gamification

• Update the app with new versions

• Discontinue the service (with notice when possible)

You Will Be Notified:

• Through in-app notifications

• Via email (if applicable)

• By updating these Terms

Your Options:

• Continue using the app (acceptance of changes)

• Stop using the app if you disagree

19. Changes to These Terms

How We Update Terms:

• We may update these Terms at any time

• Changes become effective immediately upon posting

• We will update the "Last Updated" date

• Significant changes will be notified in-app

Your Responsibility:

• Review Terms periodically

• Continued use means acceptance of changes

• If you disagree with changes, stop using the app

20. Dispute Resolution

Informal Resolution:

Before filing a claim, you agree to:

Governing Law:

These Terms are governed by the laws of United Kingdom, without regard to conflict of law principles.

You agree to bring claims only in your individual capacity, not as part of a class action or representative proceeding.

21. Miscellaneous

Entire Agreement:

These Terms and our Privacy Policy constitute the entire agreement between you and Cruzr.

Severability:

If any provision is found invalid or unenforceable, the remaining provisions remain in full force and effect.

Waiver:

Our failure to enforce any provision does not constitute a waiver of that provision.

Assignment:

You may not assign these Terms. We may assign these Terms without restriction.

No Agency:

These Terms do not create an agency, partnership, or joint venture relationship.

Force Majeure:

We are not liable for delays or failures due to circumstances beyond our reasonable control (natural disasters, acts of God, war, etc.).

• We can display it as you direct

• Keep it appropriate

Our Rights:

• We can suspend/terminate accounts for violations

• We can modify features anytime

• We can remove content that violates rules

Legal Stuff:

• App provided "as is"

• We're not liable for damages beyond reasonable limits

• You're responsible for your driving
