1. Introduction and Acceptance These Terms of Service ("Agreement" or "Terms") constitute a legally binding contract between you and Kelta APP ("Kelta APP," "we," "us," or "our"). This Agreement governs your access to and use of the View AI: Photo & Generator mobile application, our website at keltaapp.com, and any associated software, tools, content, or functionalities (collectively referred to as the "Services").
By downloading, installing, or interacting with any part of View AI: Photo & Generator, you expressly acknowledge that you have read, comprehended, and agreed to be bound by these Terms. If you do not accept these conditions in their entirety, you are strictly prohibited from using the Services.
We retain the absolute right to revise or update these Terms at any time. Should material changes occur, we will endeavor to notify you via in-app alerts, pop-ups, or other reasonable communication methods, and we will update the "Last Updated" date above. Your continued utilization of View AI: Photo & Generator following any modifications indicates your full acceptance of the revised Agreement.
IMPORTANT ARBITRATION NOTICE: PLEASE REVIEW THIS AGREEMENT CAREFULLY. IT CONTAINS A MANDATORY ARBITRATION PROVISION. BY ACCEPTING THESE TERMS, YOU AGREE THAT ANY DISPUTES BETWEEN YOU AND KELTA APP WILL BE RESOLVED BY BINDING, INDIVIDUAL ARBITRATION. YOU EXPRESSLY WAIVE YOUR RIGHT TO A TRIAL BY JURY OR TO PARTICIPATE IN ANY CLASS ACTION, COLLECTIVE, OR REPRESENTATIVE PROCEEDING, EXCEPT WHERE PROHIBITED BY APPLICABLE LAW.

2. Service Description and Account Security
The Core Service: View AI: Photo & Generator operates as a platform that processes textual, visual, or other media inputs provided by you ("Submissions") to create and deliver artificial intelligence-driven photo and image content ("Output"). Collectively, Submissions and Output are referred to as "Content."
Your Rights to Submissions: You must possess the legal authority to use any material you upload. By providing Submissions, you guarantee that you own or have acquired all mandatory licenses, rights, and permissions to utilize such data and to grant us the ability to process it. You further warrant that your Submissions do not violate any laws or infringe upon third-party intellectual property or privacy rights.
Registration and Eligibility: While using specific features, you may be prompted to create an account or provide identifiable details. You agree to submit accurate, current information and to keep it updated. You must be at least 13 years of age to use View AI: Photo & Generator. Users between 13 and 18 years old may only access the platform under the direct supervision and with the explicit consent of a parent or legal guardian.
Account Integrity: You bear sole responsibility for safeguarding your login credentials. You must immediately notify Kelta APP of any unauthorized account access or security breaches. We are not liable for any damages or data loss resulting from your failure to secure your account. Furthermore, we reserve the right to establish storage limits, delete inactive accounts after extended periods of non-use, or modify the Services at our discretion without prior notice.
3. Rules of Conduct and Prohibited Activities You bear full responsibility for your behavior on the platform and for the Content you generate or upload. The Service must not be used to create competing technologies or to train external AI models.
Kelta APP strictly prohibits the following activities. Engaging in these behaviors may result in immediate account termination, content removal, and potential legal action:
Uploading or generating Content that infringes on copyrights, trademarks, or trade secrets.
Distributing malware, viruses, or any code designed to disrupt telecommunications or computer hardware.
Engaging in unauthorized commercial solicitations, spamming, pyramid schemes, or scraping data.
Generating or sharing material that is defamatory, harassing, sexually explicit, discriminatory, highly violent, or otherwise unlawful and harmful.
Impersonating another individual or falsely misrepresenting your identity, including generating AI content designed to deceive others regarding its true origin.
Collecting personal data of others without consent, or specifically targeting minors under 18 for information gathering.
Attempting to bypass geographical restrictions, IP blocks, or security protocols (including the unauthorized use of VPNs or proxy servers to evade bans).
Using automated bots or data mining techniques to extract information from our servers.
4. Payments, Subscriptions, and Refunds
In-App Purchases and Subscriptions: View AI: Photo & Generator offers enhanced features, premium content, and expanded generation limits through one-time payments or auto-renewing subscriptions ("In-App Purchases").
Billing and Auto-Renewal: If you purchase an auto-renewing subscription, the payment will be charged to your Apple ID or Google Play account at the confirmation of purchase. Your subscription will automatically renew at the same price and duration unless auto-renew is turned off at least 24 hours before the end of the current billing period. Your account will be charged for renewal within 24 hours prior to the end of the current period.
Managing and Canceling Subscriptions: You can manage and cancel your subscriptions at any time by accessing your account settings on the Apple App Store or Google Play Store after purchase. Please note that deleting the View AI application from your device or deleting your user account does not cancel your subscription. You must manually cancel it through the respective app store.
Refund Policy: Because all In-App Purchases are processed directly and securely by Apple or Google, we do not have the ability to process payments or issue refunds directly. All purchases are generally final and non-refundable, except where required by applicable law or the respective app store's refund policy. If you believe you are entitled to a refund, you must contact Apple Support or Google Play Support directly.
Pricing Changes: Kelta APP reserves the right to modify the pricing for our subscriptions or In-App Purchases at our sole discretion. Any price changes will be communicated to you in advance and will take effect at the start of your next subscription billing period.
5. Mobile Application and Apple Disclaimers You are responsible for obtaining the necessary hardware and data connections to use the View AI: Photo & Generator app. We do not guarantee compatibility with all devices or networks. Standard data and messaging rates from your wireless carrier may apply, and Kelta APP is not responsible for these external costs. By installing the app, you consent to receive push notifications and alerts, which can be managed in your device settings.
Apple App Store Users: If you download the app via Apple Inc., you acknowledge that this Agreement is strictly between you and Kelta APP, not Apple. Apple is entirely exempt from any obligation to provide maintenance or support for the app. Apple is not responsible for addressing any claims relating to product liability, consumer protection, or intellectual property infringement regarding View AI: Photo & Generator. However, Apple and its subsidiaries are recognized as third-party beneficiaries of this Agreement and possess the right to enforce these terms against you.
6. Intellectual Property and Content Licensing
Our Property: The proprietary algorithms, source code, design elements, and software powering View AI: Photo & Generator ("Software"), alongside all branding, logos, and trademarks, are the exclusive intellectual property of Kelta APP. You are strictly forbidden from reverse engineering, modifying, copying, or distributing our Software or branding without explicit written consent.
Your License to Us: By utilizing the Service, you grant Kelta APP a global, royalty-free, perpetual, sublicensable, and irrevocable license to host, reproduce, display, adapt, and process your Submissions and Output. This license is essential for us to operate the platform, improve our algorithms, and develop our AI systems.
Output Ownership and Commercial Use: Due to the complexities of generative AI, Kelta APP cannot guarantee exclusive copyright over any generated images. All users are permitted to utilize their AI-generated Output strictly for personal, non-commercial purposes. When sharing or publishing Output, you must provide appropriate attribution to "View AI: Photo & Generator." You acknowledge that AI technology may generate identical or highly similar outputs for different users who input similar prompts, and you hold no ownership claims over content generated by or for others.
Feedback: Any suggestions, reviews, or ideas you provide to us become the property of Kelta APP, and we may utilize them freely without offering compensation or confidentiality.
7. DMCA and Copyright Infringement We respect intellectual property laws and swiftly address valid infringement claims. If you believe your copyrighted work has been improperly used on our platform, please send a written Digital Millennium Copyright Act (DMCA) takedown notice to support@keltaapp.com containing:
Your physical or digital signature.
A description of the copyrighted work.
The exact location of the infringing material on our app.
Your contact details.
A good-faith statement that the use is unauthorized.
A declaration under penalty of perjury that the information is accurate.
Kelta APP maintains a strict policy of terminating the accounts of users identified as repeat infringers.
8. Indemnification To the maximum extent permitted by law, you agree to indemnify, defend, and hold harmless Kelta APP, its executives, affiliates, and partners from any claims, damages, liabilities, legal fees, and expenses arising from:
Your use or misuse of View AI: Photo & Generator.
Your generated Output or uploaded Submissions.
Your violation of this Agreement.
Your infringement of any third-party rights, including privacy and copyright laws.
9. Disclaimers and Limitations of Liability
"AS IS" Delivery: View AI: Photo & Generator is provided strictly on an "AS IS" and "AS AVAILABLE" basis. We disclaim all warranties, whether statutory, express, or implied, including warranties of merchantability and fitness for a specific purpose. We do not guarantee that the Service will be error-free, completely secure, or that the AI-generated results will be accurate, appropriate, or non-infringing. AI is experimental technology; outputs may sometimes be distorted or offensive, and you rely on them solely at your own risk.
Liability Cap: UNDER NO CIRCUMSTANCES SHALL KELTA APP OR ITS AFFILIATES BE HELD LIABLE FOR ANY INDIRECT, INCIDENTAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES (INCLUDING LOSS OF DATA OR PROFITS) ARISING FROM YOUR USE OF THE APP. In jurisdictions that do not allow total liability exclusion, Kelta APP’s maximum cumulative liability to you for any claims shall not exceed one hundred U.S. dollars ($100.00 USD). If you are dissatisfied with the Service, your sole remedy is to delete the application.
10. Dispute Resolution and Binding Arbitration
Arbitration Protocol: Any disputes arising from these Terms or your use of the Services shall be resolved exclusively through final and binding arbitration, governed by the Singapore International Arbitration Act (Cap. 143A). This replaces the right to go to court before a judge or jury.
Class Action Waiver: ALL CLAIMS MUST BE BROUGHT IN AN INDIVIDUAL CAPACITY. You and Kelta APP explicitly waive the right to participate in class actions, consolidated arbitrations, or representative proceedings.
Informal Resolution: Before initiating arbitration, you must first contact us at support@keltaapp.com with a written Notice of Dispute. If the matter remains unresolved after 60 days, either party may officially commence arbitration proceedings. Arbitration costs will be handled according to SIAC rules, and all proceedings shall remain strictly confidential.
11. Termination and General Provisions
Termination Rights: Kelta APP reserves the unilateral right to suspend, restrict, or terminate your access to View AI: Photo & Generator at any time, for any reason (including suspected violations of these Terms), without prior warning or liability.
Governing Law: This Agreement is governed by the laws of Singapore, excluding its conflict of law principles. Any legal matters not subject to arbitration shall be submitted to the exclusive jurisdiction of the courts in Singapore.
Statute of Limitations: Any claim relating to your use of the Service must be formally filed within one (1) year of the incident occurring; otherwise, it is permanently barred.
Severability: If any clause within this Agreement is deemed unenforceable by a legal authority, that specific clause will be modified or severed, and the remainder of the Agreement will remain in full effect.
