Please read these Terms of Use carefully before using SceneSafe: EMT Test Prep
These Terms of Use ("Terms") govern your use of the SceneSafe: EMT Test Prep mobile application (the "App") provided by xSoft Global ("we", "us", "our"). By downloading or using the App, you agree to these Terms and to Apple's Licensed Application End User License Agreement (https://www.apple.com/legal/internet-services/itunes/dev/stdeula/).
1. EDUCATIONAL USE ONLY
The App is a study aid for EMS certification exams. It is not medical advice, clinical training or a substitute for an accredited EMT/AEMT/Paramedic program, your local protocols or your medical director. Never use App content to make real patient care decisions.
2. NO AFFILIATION
The App is independent and is not affiliated with, endorsed by or sponsored by the National Registry of Emergency Medical Technicians (NREMT), any state EMS office or any certifying body. All trademarks belong to their respective owners.
3. NO GUARANTEE OF RESULTS
Practice scores and readiness scores are estimates only. We do not guarantee that you will pass any exam or obtain any certification. While we work to keep content accurate and current, exam content and standards change, and the App may contain errors or omissions.
4. SUBSCRIPTIONS AND PURCHASES
- Some features require a paid subscription (weekly or monthly) or a one-time lifetime purchase.
- Payment is charged to your Apple ID at confirmation of purchase.
- Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours before the end of the current period.
- You can manage or cancel subscriptions in your Apple ID Account Settings. Deleting the App does not cancel a subscription.
- Any unused portion of a free trial, if offered, is forfeited when you purchase a subscription.
- Refunds are handled by Apple under its policies (https://reportaproblem.apple.com). We cannot issue refunds directly.
- Prices may change; any change will not affect your current paid period.
5. LICENSE
We grant you a personal, non-exclusive, non-transferable, revocable license to use the App on Apple devices you own or control, for your own non-commercial study. You may not copy, scrape, resell, redistribute or publish the App's questions, explanations or other content, or reverse engineer the App.
6. INTELLECTUAL PROPERTY
All questions, explanations, designs, text, graphics and software in the App are owned by or licensed to xSoft Global and are protected by copyright and other laws.
7. DISCLAIMER OF WARRANTIES
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING FITNESS FOR A PARTICULAR PURPOSE, ACCURACY OR NON-INFRINGEMENT, TO THE MAXIMUM EXTENT PERMITTED BY LAW.
8. LIMITATION OF LIABILITY
TO THE MAXIMUM EXTENT PERMITTED BY LAW, XSOFT GLOBAL SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL OR CONSEQUENTIAL DAMAGES, INCLUDING EXAM RESULTS, LOSS OF CERTIFICATION OR EMPLOYMENT OPPORTUNITIES, ARISING FROM YOUR USE OF THE APP. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE APP IN THE 12 MONTHS BEFORE THE CLAIM.
9. APPLE
These Terms are between you and xSoft Global, not Apple. Apple is not responsible for the App or its content and has no obligation to provide maintenance or support. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them.
10. TERMINATION
We may suspend or end your access if you violate these Terms. Sections 3, 6, 7, 8 and 11 survive termination.
11. GOVERNING LAW
These Terms are governed by the laws of [JURISDICTION], without regard to conflict-of-law rules.
12. CHANGES
We may update these Terms. Continued use of the App after changes are posted means you accept the updated Terms.
