1. Acceptance of Terms

Welcome to NiceDriver. These Terms of Use ("Terms" or "Agreement") constitute a legally binding agreement between you ("User" or "you") and NiceDriver ("we," "us," or "our") regarding your use of the NiceDriver mobile application (the "App") and related services.

By downloading, installing, accessing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, you must not use the App and should uninstall it immediately.

2. Description of Service

NiceDriver is a mobile application that provides trip tracking, route recording, automatic trip detection, vehicle management, fuel consumption tracking, and related driving log services. The App may offer both free and premium subscription-based features.

3. Eligibility

You must be at least 16 years of age to use the App. If you are under 18, you represent that you have your parent's or guardian's permission to use the App and that they have agreed to these Terms on your behalf.

4. User Accounts

4.1 Account Creation

- You may create an account using Google Sign-In, Apple Sign-In, or Email/Password authentication.

- You may also use the App in Guest Mode without creating an account.

- You are responsible for maintaining the confidentiality of your account credentials.

4.2 Account Responsibilities

- You are responsible for all activities that occur under your account.

- You must immediately notify us of any unauthorized use of your account.

- You must provide accurate, current, and complete information when creating an account.

4.3 Account Termination

- You may delete your account at any time through the App settings.

- We reserve the right to suspend or terminate your account if you violate these Terms.

5. Subscriptions and Payments

5.1 Subscription Services

- NiceDriver offers premium features through auto-renewable subscriptions.

- Subscription features may include: unlimited trip access, cloud backup, real-time sync, and cross-device access.

- Free version may have limitations (e.g., limited number of trips per month).

5.2 Subscription Terms

- Subscription Length: Auto-renewable monthly subscription (renews every 1 month / 30 days)

- Auto-Renewal: Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period.

- Price: Subscription prices are displayed in the App and may vary by region. Prices are subject to change with notice.

5.3 Payment

- Payment will be charged to your Apple ID account or Google Play account at confirmation of purchase.

- Subscription automatically renews unless auto-renew is turned off at least 24 hours before the end of the current period.

- Your account will be charged for renewal within 24 hours prior to the end of the current period.

- You can manage and cancel your subscriptions by going to your account settings on the App Store (iOS) or Google Play Store (Android) after purchase.

5.4 Refunds

- Refund requests are subject to the policies of Apple (App Store) or Google (Play Store).

- We do not provide direct refunds. All refund requests must be processed through Apple or Google.

5.5 Free Trial

- If offered, any free trial period will be specified at the time of subscription.

- At the end of the free trial, your subscription will automatically convert to a paid subscription unless cancelled.

6. Acceptable Use

6.1 Permitted Use

You may use the App for lawful purposes only and in accordance with these Terms. You agree to:

- Use the App only for personal, non-commercial purposes

- Comply with all applicable laws and regulations

- Respect the rights of others

6.2 Prohibited Activities

You agree NOT to:

- Use the App for any illegal or unauthorized purpose

- Attempt to gain unauthorized access to the App or related systems

- Interfere with or disrupt the App or servers

- Reverse engineer, decompile, or disassemble the App

- Remove or alter any copyright, trademark, or other proprietary notices

- Use automated systems to access the App without permission

- Share your account credentials with others

- Use the App to track others without their consent

7. Location Data and Privacy

7.1 Location Services

- The App requires location permissions to provide trip tracking and automatic trip detection.

- Location data is collected and used as described in our Privacy Policy.

- You can control location permissions through your device settings.

7.2 Privacy

- Your use of the App is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

- By using the App, you consent to the collection and use of your information as described in the Privacy Policy.

8. Intellectual Property Rights

8.1 Our Rights

- The App, including all content, features, functionality, and software, is owned by NiceDriver and protected by copyright, trademark, and other intellectual property laws.

- You are granted a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes.

8.2 Your Content

- You retain ownership of any data, trips, routes, or other content you create using the App ("User Content").

- By using the App, you grant us a license to use, store, and process your User Content solely to provide and improve the App's services.

8.3 Restrictions

- You may not copy, modify, distribute, sell, or lease any part of the App.

- You may not use our trademarks, logos, or brand names without our prior written consent.

9. Data and Backup

9.1 Data Storage

- By default, your data is stored locally on your device.

- Cloud backup and sync are optional features that require an active subscription.

- You are responsible for backing up your data. We are not responsible for data loss.

9.2 Data Export

- You may export your data at any time using the App's export features.

- Upon account deletion, your data will be deleted in accordance with our Privacy Policy.

10. Disclaimers and Limitations of Liability

10.1 Service Availability

- We strive to provide reliable service but do not guarantee that the App will be available at all times or error-free.

- The App may be unavailable due to maintenance, updates, or circumstances beyond our control.

10.2 Accuracy of Information

- While we strive for accuracy, we do not warrant that trip data, routes, calculations, or other information provided by the App is completely accurate or error-free.

- The App is provided for informational purposes and should not be solely relied upon for critical decisions.

10.3 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

- THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

- WE DISCLAIM ALL WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

- WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR USE.

- OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE APP OR SUBSCRIPTION IN THE 12 MONTHS PRECEDING THE CLAIM.

10.4 Third-Party Services

- The App may integrate with third-party services (e.g., Google Maps, Apple Maps, Firebase).

- We are not responsible for the availability, accuracy, or practices of third-party services.

- Your use of third-party services is subject to their respective terms and policies.

11. Indemnification

You agree to indemnify, defend, and hold harmless NiceDriver and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

- Your use of the App

- Your violation of these Terms

- Your violation of any rights of another party

- Your User Content

12. Termination

12.1 Termination by You

- You may stop using the App at any time by uninstalling it.

- You may delete your account at any time through the App settings.

12.2 Termination by Us

We may suspend or terminate your access to the App if:

- You violate these Terms

- You engage in fraudulent or illegal activity

- We are required to do so by law

- We discontinue the App or service

12.3 Effect of Termination

- Upon termination, your right to use the App will immediately cease.

- We may delete your account and data in accordance with our Privacy Policy.

- Provisions that by their nature should survive termination will survive.

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by:

- Posting the updated Terms in the App

- Updating the "Last Updated" date

- Providing notice through the App or via email (if you have an account)

Your continued use of the App after such modifications constitutes your acceptance of the updated Terms. If you do not agree to the changes, you must stop using the App.

14. Governing Law and Dispute Resolution

14.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of United Kingdom, without regard to its conflict of law provisions.

14.2 Dispute Resolution

- Any disputes arising from these Terms or your use of the App shall be resolved through binding arbitration or in the courts of United Kingdom, as applicable.

- You waive any right to participate in a class-action lawsuit or class-wide arbitration.

15. Apple-Specific Terms

If you download the App from the Apple App Store:

- This Agreement is between you and NiceDriver, not Apple.

- Apple is not responsible for the App or its content.

- Apple has no obligation to provide support or maintenance for the App.

- If the App fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if applicable).

- Apple is not responsible for addressing any claims relating to the App or your use of it.

- Apple is not responsible for the investigation, defense, settlement, or discharge of any third-party claims.

16. Google Play-Specific Terms

If you download the App from Google Play:

- This Agreement is between you and NiceDriver, not Google.

- Google is not responsible for the App or its content.

- Your use of the App is also subject to Google Play's terms of service.

17. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

18. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and NiceDriver regarding the App and supersede all prior agreements and understandings.

19. Waiver

Our failure to enforce any right or provision of these Terms will not be considered a waiver of such right or provision.

21. Acknowledgment
