For the purposes of these Terms and Conditions, the legal name of the mobile application is "Wanderlust by Lorikeet", and the application may also be referred to in these Terms, app stores, product materials, notices, and related documentation as "Lorikeet Wanderlust" or "Wanderlust" (collectively, the "App").

## 1. Acceptance of These Terms
These Terms and Conditions govern your access to and use of the mobile application currently branded as Wanderlust, together with all text, designs, layouts, data feeds, remote content, travel information, checklists, maps, links, notices, screens, prompts, tools, and features made available through the application or in connection with it.
By downloading, installing, opening, browsing, tapping, viewing, searching, interacting with, or otherwise using the app in any way, you agree to these Terms and Conditions. If you do not agree, you must not access or use the app.
These Terms apply whether the app is accessed through a phone, tablet, emulator, web view, app preview, app store test build, internal test track, closed test track, open test track, or production release. These Terms also apply to any remote data delivered into the app through Firebase, similar remote configuration tools, or other back-end infrastructure used by the operator.
If you are using the app on behalf of another person, business, organisation, school, employer, or other entity, you represent that you have authority to bind that person or entity to these Terms. If you do not have that authority, you must not use the app on their behalf.
## 2. Nature of the App
Wanderlust is an informational and convenience app intended to help users organise travel-related research. It may display country-specific content such as:
- visa portal links and immigration-related references
- country maps and highlighted country displays
- short country descriptions, practical notes, and travel summaries
- capital city, largest city, time zone, area, and similar reference information
- emergency contact numbers
- safety and health advisory indicators
- itinerary content, attractions, experiences, food ideas, language phrases, customs, checklists, and travel reminders
- partner, sponsor, affiliate, or referral links for flights, accommodation, insurance, eSIMs, and similar services
- user suggestion and feedback submission tools
- cached content that was previously synced from a remote service
The app is not an official government service, emergency service, health authority service, legal advice service, migration advice service, insurance service, booking agent, medical service, crisis service, navigation service, or professional consultancy service.
The app is designed as a planning aid and convenience layer only. It is not a substitute for independent research, direct confirmation with providers, professional advice, or official government and emergency sources.
## 3. No Government, Embassy, or Official Affiliation
The operator is independent. The app is not owned, endorsed, approved, administered, certified, supervised, or operated by any government, embassy, consulate, ministry, immigration office, border authority, customs authority, tourism board, police service, ambulance service, fire service, public health body, emergency management authority, or regulator unless the app expressly states otherwise in a specific written notice.
The presence of country names, government references, flag imagery, country data, visa-related links, embassy-style language, emergency numbers, public warning indicators, or official-looking references does not mean the app is itself official, complete, endorsed, current, or authoritative.
Any reference to a third party, government body, or public institution is for identification and convenience only.
## 4. No Professional Advice
Nothing in the app is legal advice, migration advice, visa advice, emergency advice, medical advice, public health advice, insurance advice, investment advice, financial advice, counselling, navigation guidance, professional translation, or professional consultation of any kind.
You must not treat the app as a substitute for a licensed migration professional, lawyer, doctor, pharmacist, insurer, embassy, airline, consulate, travel medicine clinic, or emergency authority.
If a matter is urgent, high risk, expensive, safety-sensitive, health-related, legally significant, or time-critical, you must verify it independently and consult an appropriate official or qualified professional before acting.
## 5. AI-Assisted, Automated, and Curated Content
Some or all content in the app may be generated, summarised, paraphrased, compiled, ranked, structured, reformatted, translated, or assisted by automated systems, artificial intelligence tools, templates, scripts, manual curation, or combinations of those methods.
Because automated systems can be wrong, incomplete, outdated, overconfident, or misleading, content in the app may contain errors, omissions, broken assumptions, outdated rules, factual mistakes, poor phrasing, translation issues, incorrect local nuances, invalid links, inaccurate summaries, or unsuitable recommendations.
AI-assisted content may sound authoritative even where it is uncertain, incomplete, generalized, or wrong. Travel content can also become outdated quickly due to changes in law, policy, weather, health events, conflict, airline schedules, border practice, pricing, access restrictions, transport disruptions, or commercial partner changes.
You acknowledge and agree that:
- the operator does not promise that any AI-assisted content is accurate, complete, current, or suitable for your circumstances
- you will independently verify all important information before relying on it
- you assume responsibility for decisions you make after using informational content in the app
## 6. No Promise of Accuracy, Completeness, Availability, Suitability, or Currency
To the maximum extent permitted by law, the operator does not warrant, represent, or guarantee that the app or any content in it is accurate, complete, current, lawful, safe, reliable, available, error-free, useful, fit for purpose, merchantable, uninterrupted, or compatible with your expectations or device.
Without limiting the above, the operator does not promise that:
- country summaries are correct or complete
- maps, country outlines, highlights, borders, or markers are perfectly accurate
- emergency numbers are correct or valid in all localities
- health or safety indicators reflect current reality
- airport, taxi, airline, or navigation references remain current
- driving-side, water, air, retail, or cultural information is still accurate
- itineraries are suitable, safe, open, efficient, legal, affordable, or bookable
- external providers still offer the service described
- prices, availability, or timeframes on third-party links remain valid
- app features will continue to exist or remain in the same place in future versions
Content may change at any time without notice, including through background or on-launch remote updates.
## 7. Your Duty to Verify
You are solely responsible for checking whether information shown in the app is still correct before you rely on it or act on it.
You must verify important details directly with relevant primary or official sources, including where applicable:
- official visa and immigration authorities
- embassy or consular websites
- official government travel advisory sites
- airlines, airports, rail providers, ferry providers, and transport operators
- accommodation providers
- insurers
- public health and vaccination authorities
- local emergency services
- local official tourism or park authorities
- maps and navigation services
- licensed professionals where appropriate
This duty is especially important for visas, border rules, passport validity, transit permissions, emergency numbers, health requirements, safety conditions, medication rules, insurance coverage, bookings, closures, strike action, conflict conditions, and natural events.
## 8. Emergency Information Disclaimer
The app may display emergency numbers or emergency-related references. Those numbers may be incomplete, outdated, region-specific, network-specific, language-specific, city-specific, or wrong. A number may work in one location and fail in another. A number may connect to a switchboard rather than a direct emergency responder. Emergency access can also depend on roaming status, carrier support, SIM configuration, device type, local infrastructure, or government changes.
You must never rely solely on the app in an emergency, urgent medical situation, crime situation, disaster, safety threat, or other immediate-risk event.
If you need urgent help, you must use direct official channels available in your location and verify emergency contact methods through local authorities, official sources, accommodation staff, transport operators, embassies, or other direct resources.
To the maximum extent permitted by law, the operator is not responsible for any injury, delay, failed contact, failed assistance, loss, or damage arising from or related to reliance on emergency information displayed in the app.
## 9. Health and Safety Content Disclaimer
The app may display health advisories, safety advisories, pharmacy information, water or air quality indicators, general health notes, itinerary warnings, or destination-related practical warnings. This content is for general informational purposes only.
It is not a diagnosis, not a treatment recommendation, not a medical opinion, not public health clearance, not professional safety advice, and not a substitute for emergency or clinical guidance.
Health and safety conditions can change rapidly and may depend on your personal circumstances, including medical history, age, pregnancy, allergies, prescriptions, mental health, language ability, mobility, citizenship, gender, identity, local conditions, and route choices.
You are solely responsible for consulting qualified professionals and official sources for health, medication, vaccination, emergency, and safety decisions.
## 10. Visa, Immigration, Entry, and Border Disclaimer
The app does not determine your eligibility to travel, enter, transit, work, study, remain, or apply for status in any country.
Visa and border rules may depend on:
- nationality or multiple nationalities
- passport type and passport validity
- residency status
- travel purpose
- prior travel history
- criminal or immigration history
- health or vaccination status
- sanctions, watchlists, or airline policy
- discretionary decisions made by border officers or officials
The operator does not warrant that any visa-related link, government portal reference, entry summary, or immigration text in the app is current, official, complete, or suitable for your circumstances.
You must verify all entry requirements, documentation requirements, and application procedures directly with official authorities before travel or submission of any application.
## 11. Travel Itineraries Disclaimer
The app may provide travel itineraries, attraction suggestions, timing ideas, city sequencing, or route concepts. These are convenience suggestions only. They are not guarantees of access, safety, opening hours, transport continuity, affordability, suitability, or legality.
Itinerary content may become unsuitable because of weather, local closures, permit requirements, transport delays, strikes, seasonal restrictions, conflict, illness, operator changes, crowding, special events, or local law.
The operator does not guarantee that any itinerary is:
- optimal
- safe
- current
- complete
- bookable
- open on the day
- appropriate for your pace, budget, fitness, age, or family circumstances
You are solely responsible for checking routes, times, closures, ticketing, permits, costs, and safety conditions before acting on any itinerary content.
## 12. Maps, Borders, Territory, and Geographic Display
The app includes maps, highlighted countries, zoom states, markers, rings, labels, outlines, and territory depictions for visual and navigational convenience within the app interface. These are not legal maps, official maps, survey-grade maps, political declarations, marine charts, aviation charts, or navigation instructions.
Map rendering may include technical limitations, clipping, projection distortion, scaling distortion, overseas territory quirks, label mismatches, timing differences between devices, or incomplete cartographic representation.
Nothing shown in the map component is intended to express a political position or a legal determination of sovereignty, border status, jurisdiction, or recognition.
## 13. Third-Party Sites, Links, and Services
The app may open, suggest, or embed links to third-party sites or services such as government pages, maps, airline sites, accommodation platforms, travel providers, insurers, eSIM providers, local service providers, or sponsored partners.
Those third parties are independent from the operator. The operator does not control their content, policies, terms, security, prices, availability, performance, cancellations, refunds, or conduct.
The operator is not responsible for:
- inaccurate or misleading third-party content
- changes made by a third party after a link is shown in the app
- security issues, malware, fraud, or phishing on a third-party site
- service failures, cancellations, overbookings, fraud, refunds, disputes, or losses
- third-party collection or misuse of your data
- any purchase, booking, application, claim, or communication you make with a third party
You access third-party services entirely at your own risk and must review their own terms and privacy policies.
## 14. Sponsored Content, Ads, Affiliate Links, and Commercial Relationships
The app may contain sponsored placements, ads, affiliate links, referral links, or commercial arrangements with travel, insurance, connectivity, transport, accommodation, or related providers.
The operator may receive a fee, commission, referral payment, advertising revenue, or other commercial benefit if you click, enquire, install, subscribe, book, buy, or otherwise interact with a promoted service.
Any such commercial relationship does not mean the operator guarantees or promises:
- the provider is the best, cheapest, safest, fastest, or most suitable option
- pricing or availability is current
- the service will meet your expectations
- the provider is risk-free
- the provider is available in your country, route, or device environment
You remain fully responsible for evaluating whether a third-party offering is appropriate for you.
## 15. No Obligation to Supply Bookings, Insurance, eSIM, or Transport
The app itself does not sell flights, accommodation, visas, insurance, eSIMs, medical services, tours, local transport, or border approvals unless expressly stated in writing in a future product feature.
If the app links to or displays a third-party service, that does not create a contract between you and the operator for the supply of that third-party service.
Any contract for a booking, subscription, insurance policy, eSIM plan, or external service is between you and the relevant third-party provider, not with the operator of the app.
## 16. Firebase, Remote Data, Syncing, Caching, and Local Storage
The app may use Firebase Remote Config, Firebase services, local device storage, cached snapshots, bundled files, or similar systems to display content. The app may store previously synced data on your device so that content remains available after you close and reopen the app.
You acknowledge and agree that:
- remote content may update, fail, lag, or be replaced without notice
- cached content may remain visible when remote syncing fails
- locally cached data may differ from the most current remote data
- the app may decide whether to sync based on timing logic or availability checks
- a sync may succeed, fail, partially apply, or be delayed
- locally stored data can be affected by device resets, storage policies, OS changes, reinstalls, or user actions
The operator does not guarantee that syncing will occur at a particular time, that every user device will reflect the same version immediately, or that cached content will remain permanently available.
The operator may add, change, remove, or stop syncing categories of content at any time.
## 17. Offline, Cached, and Bundled Content Disclaimer
Some app content may be bundled with the app package and some may be cached from earlier remote updates. Bundled content may become outdated after installation. Cached content may also remain visible where a later sync fails or is unavailable.
The operator does not warrant that bundled or cached content remains current after install or after a period of time.
The fact that the app shows a country card, itinerary, emergency number, or advisory does not mean the content is fresh, verified, or complete.
## 18. Suggestions, Feedback, and User Submissions
The app may allow you to submit suggestions, reports, corrections, comments, or other feedback through a suggestion interface or similar feature.
By submitting any material, you agree that:
- you are responsible for what you submit
- you will not submit unlawful, abusive, defamatory, infringing, harassing, misleading, obscene, malicious, or harmful material
- you will not impersonate another person or entity
- you will not include confidential information that you do not want disclosed, reviewed, stored, or processed
- you will not submit emergency requests or time-critical help requests through feedback channels
You also grant the operator a perpetual, irrevocable, worldwide, royalty-free, transferable, sublicensable licence to use, store, copy, modify, adapt, publish, analyse, display, distribute, and incorporate your feedback or suggestions into the app or related services without compensation to you.
The operator has no obligation to keep submissions confidential, no obligation to respond, and no obligation to implement any suggestion.
## 19. User Content Moderation and Internal Review
Even if suggestions are not publicly displayed in the app, the operator may review, filter, reject, archive, moderate, or delete submissions at its discretion.
The operator may preserve submission data for operational, moderation, analytics, legal, security, or abuse-prevention purposes. The operator may also refuse to process content that appears abusive, irrelevant, spam-like, unlawful, or technically harmful.
The operator is not obliged to publish, action, investigate, verify, or correct information based on any user report or suggestion.
## 20. No Guarantee of Correction or Update
The app may invite users to report corrections or suggest updates. That invitation does not mean the operator guarantees that a correction will be reviewed immediately, accepted, published, or reflected in the app by any deadline.
The operator may choose whether, when, and how to update content. The presence of a feedback feature does not create a duty to monitor, correct, or maintain content continuously.
## 21. Privacy and Data Handling
Your use of the app may involve the collection, storage, processing, or transmission of certain data, including device identifiers, install identifiers, suggestion submissions, app usage data, cached content, and data handled by third-party infrastructure providers such as Firebase.
The operator’s handling of personal information and related data practices should be read together with the app’s Privacy Policy or privacy notice where provided. If the operator provides a separate Privacy Policy, that document forms part of the overall legal framework governing the app.
The operator does not promise that any third-party service used by the app is free from all security risk. No digital system can be guaranteed completely secure.
## 22. Local Device Permissions and Device Responsibility
The app may rely on internet access, local storage, app store services, browser components, fonts, rendering engines, remote configuration services, or other device-level infrastructure.
You are responsible for your device, network, operating system, account security, passcode security, malware protection, and the consequences of allowing others to access your device while the app is installed.
The operator is not responsible for issues caused by:
- rooted or modified devices
- unsupported devices or operating systems
- emulator or preview instability
- broken browser components
- app store testing environments
- hostile networks or insecure Wi-Fi
- user-installed malware or device compromise
## 23. No Warranty of Compatibility or Performance
The operator does not warrant that the app will work on all devices, all versions of Android, all screen sizes, all regions, all carriers, or all testing tracks.
Visual elements, map rendering, fonts, spacing, remote content layout, icons, and animations may appear differently across devices. Performance may vary based on hardware, software version, memory, locale, and network conditions.
The operator is not liable for display inconsistencies, layout issues, animation issues, or device-specific rendering quirks.
## 24. Permitted Use
You are granted a limited, revocable, non-exclusive, non-transferable licence to use the app for personal, lawful, non-commercial use in accordance with these Terms.
This licence does not permit you to:
- resell or commercially exploit the app
- scrape, harvest, bulk export, or systematically extract app content
- reverse engineer, decompile, disassemble, or attempt to derive source code except as permitted by mandatory law
- remove attributions, notices, or branding
- mirror or frame the app or its content in another service
- use the app in a way that harms the operator, users, partners, or infrastructure
## 25. Prohibited Conduct
You must not use the app:
- for unlawful, fraudulent, deceptive, harmful, abusive, or defamatory purposes
- to misrepresent yourself as an official authority
- to submit malicious or irrelevant data
- to interfere with app infrastructure or remote services
- to test, probe, overload, or exploit vulnerabilities without written permission
- to infringe intellectual property, privacy, consumer, or other legal rights
- to use the app in breach of sanctions, export controls, or local law
The operator may limit, suspend, or terminate access where misuse is suspected.
## 26. Intellectual Property
Except for third-party materials owned by others, the app’s software, structure, layouts, branding, wording, compilation, screens, interaction design, and original content are owned by or licensed to the operator and protected by applicable law.
You receive no ownership rights in the app. All rights not expressly granted are reserved.
Third-party names, trademarks, maps, icons, libraries, and licensed materials remain the property of their respective owners.
## 27. Open Source and Third-Party Components
The app may include open-source libraries, licensed assets, SVG maps, dependencies, and third-party software subject to separate licence terms.
Those licences may contain notices, disclaimers, attribution requirements, or permissions that apply in addition to these Terms. Nothing in these Terms reduces rights or obligations that must be preserved under an applicable third-party licence.
## 28. Disclaimers About Specific Content Categories
Without limiting any broader disclaimer in these Terms, the operator specifically disclaims responsibility for errors or omissions relating to:
- visa portal links
- partner links
- sponsored partner labels
- maps and country highlighting
- plug type visualisations
- language guides and transliterations
- attractions and experience lists
- itinerary day planning
- transport operators and taxi numbers
- water and air quality markers
- pharmacy references
- laws, customs, and tipping summaries
- emergency contacts
- shopping, servo, retail, or alcohol references
- snacks, gifts, festivals, sports, beaches, lakes, and hidden-gem content
These content categories are inherently dynamic and may change without notice.
## 29. App Store Distribution and Testing Tracks
If the app is distributed through Google Play or another platform, you acknowledge that platform policies and store terms may also apply. A testing build, internal track, or closed/open testing release may include experimental content, incomplete features, or rapidly changing remote data.
The operator is not obliged to maintain any testing build, preserve any feature across test builds, or provide transition support between test builds and production builds.
## 30. Suspension, Restriction, and Termination
The operator may suspend, limit, disable, remove, or terminate access to the app or any part of the app at any time, with or without notice, including where required for legal, security, moderation, infrastructure, business, or operational reasons.
The operator may also change, remove, or restrict features, screens, layouts, countries, partner links, or remote content categories without notice.
Sections of these Terms that by nature should survive termination, including disclaimers, liability limits, intellectual property clauses, governing law, and licence provisions, will survive termination.
## 31. Changes to the App
The operator may update, redesign, rename, rebrand, reposition, hide, or remove features in the app at any time. The operator may also switch data providers, remove partner links, add new content types, discontinue categories, or alter the wording, visual structure, or legal flow of the app.
You accept that the app may evolve and that prior screenshots, earlier versions, or beta expectations do not create an obligation to preserve any particular feature.
## 32. Changes to These Terms
The operator may update these Terms and Conditions from time to time. Updated terms may be included in the app bundle, shown in-app, or otherwise made available through the app.
Your continued use of the app after updated Terms become effective constitutes acceptance of the updated Terms. If you do not agree to an updated version, you must stop using the app.
## 33. Consumer Law and Non-Excludable Rights
Nothing in these Terms excludes, restricts, or modifies any condition, warranty, guarantee, right, or remedy implied or imposed by law that cannot lawfully be excluded, including protections that may apply under the Australian Consumer Law or other mandatory consumer legislation.
Where the law permits the operator to limit liability for a non-excludable guarantee, the operator’s liability is limited to the minimum extent permitted by law.
## 34. Limitation of Liability
To the maximum extent permitted by law, the operator is not liable for any direct, indirect, incidental, special, exemplary, consequential, punitive, or economic loss, or for any loss of profits, loss of revenue, loss of opportunity, loss of bookings, loss of travel value, business interruption, reputational harm, injury, illness, detention, visa refusal, missed transport, missed deadlines, denied boarding, denied entry, third-party charges, data loss, or similar loss arising from or related to:
- use of or inability to use the app
- reliance on any content in the app
- AI-assisted content
- emergency number errors
- itinerary errors
- map or country display quirks
- third-party websites or booking partners
- health or safety information
- local caching, stale content, failed syncs, delayed updates, or missing updates
- outages, bugs, rendering issues, or device incompatibility
If liability cannot be excluded, it is limited to the minimum amount and scope permitted by law.
## 35. Indemnity
To the maximum extent permitted by law, you agree to indemnify and hold harmless the operator, its related bodies, contractors, licensors, content providers, infrastructure providers, personnel, and affiliates from and against claims, losses, liabilities, damages, costs, and expenses arising out of or related to:
- your breach of these Terms
- your misuse of the app
- your violation of law or third-party rights
- your submissions or feedback
- your reliance on or use of app content in a way inconsistent with these Terms
## 36. Force Majeure and External Events
The operator is not responsible for any delay, outage, failure, or impairment caused by events outside reasonable control, including internet outages, store review delays, infrastructure failures, cloud provider issues, regulatory changes, armed conflict, civil disorder, pandemics, epidemics, sanctions, weather events, natural disasters, transport collapse, power failures, labour actions, or third-party service disruption.
## 37. Severability
If any provision of these Terms is held invalid, illegal, void, or unenforceable, that provision will be read down to the extent necessary or, if that is not possible, severed. The remaining provisions will continue in full force to the extent permitted by law.
## 38. Waiver
If the operator does not enforce a provision of these Terms immediately, that does not mean the operator waives that provision or any other right.
## 39. Entire Agreement
These Terms, together with any Privacy Policy, in-app legal notice, app store disclosure, or additional written legal notice expressly incorporated by reference, form the entire agreement between you and the operator regarding the app, to the extent permitted by law.
## 40. Governing Law and Jurisdiction
Unless mandatory law in your location requires otherwise, these Terms are governed by the laws of South Australia and the Commonwealth of Australia.
You submit to the non-exclusive jurisdiction of the courts of South Australia and courts competent to hear appeals from those courts, unless mandatory law provides otherwise.
## 41. Contact and Legal Notices
If the app provides a support contact, feedback channel, store listing contact, or legal notice contact, that channel is provided for general communication only and does not create a promise of response time, legal advice, emergency support, migration support, or direct operational service.
No support or feedback channel in the app is appropriate for emergencies, urgent medical issues, time-critical visa issues, or crisis situations.
## 42. Final Risk Allocation Statement
The app is a convenience tool, not a guarantee.
You use it at your own risk.
You are responsible for verifying important information, checking official sources, deciding whether to travel, deciding whether to book, deciding whether to apply, deciding whether to rely on a third-party provider, deciding whether information is safe to act on, and deciding whether a destination or activity is suitable for you.
The operator provides the app on an "as is" and "as available" basis to the maximum extent permitted by law, with no promise that the app or its content will be accurate, complete, suitable, uninterrupted, or free from error.
If you do not accept that allocation of risk, you must not use the app.
## 43. Beta, Test, Preview, and Experimental Features
The app may be distributed through internal testing, closed testing, open testing, staged rollout, preview, or similar release channels. Even if the app is available in a store, that does not mean every feature is final, complete, stable, or production-grade.
Certain screens, visual elements, cached data paths, remote data categories, itinerary logic, map behavior, plug visualisation, partner placements, or feedback flows may be experimental or recently changed. Features may behave differently between devices or builds, and remote data may be updated without a matching binary update.
You acknowledge that test or pre-release style behavior may include:
- layout inconsistencies across devices
- stale or mixed cached and remote content
- differences between what two users see at the same time
- temporary placeholders
- inconsistent typography or wording
- temporary buttons, labels, or feature sequencing
- content categories being added or removed after installation
The operator is not liable merely because a testing build contains incomplete polish, incomplete coverage, or iterative design changes.
## 44. Destination Conditions and Real-World Variability
The app may describe countries, attractions, routes, or practical travel experiences in a way that is concise, simplified, or tourism-oriented. Real conditions on the ground may vary substantially.
Travel practicality can be affected by:
- weather and natural disasters
- floods, fires, storms, volcanic activity, earthquakes, or heat events
- civil unrest, protests, conflict, or political instability
- road closures, ferry cancellations, or rail outages
- permit changes or local access rules
- public holidays, religious observances, curfews, or sudden government measures
- crime patterns, scams, crowding, or seasonal congestion
- wildlife conditions, marine hazards, altitude, or terrain difficulty
- local infrastructure reliability, including water, power, internet, or card payments
The operator does not promise that a destination or activity described in the app remains accessible, practical, safe, open, or worthwhile at the time you intend to travel.
## 45. No Guarantee About Cost, Value, Savings, or Affordability

- a partner offer remains active
- a quoted or implied travel cost remains accurate
- a suggested route is budget-friendly
- an itinerary is financially sensible for your circumstances
- insurance is available for your nationality, route, age, or medical status
- an eSIM or connectivity service will work with your handset, region, or carrier
Travel decisions may involve substantial financial consequences. You are solely responsible for checking prices, currency effects, taxes, refund conditions, baggage rules, exclusions, and all provider-specific terms before committing money.
## 46. No Guarantee of Suitability for Children, Families, Groups, or Special Needs
The app is not tailored to any particular user profile unless it explicitly states otherwise. It does not guarantee that content, routes, or suggested activities are appropriate for:
- children or minors
- elderly travellers
- solo travellers
- families with infants or prams
- travellers with disabilities or mobility limitations
- travellers with language barriers
- pregnant travellers
- travellers with medical vulnerabilities
- travellers subject to visa restrictions or guardianship requirements
You are responsible for assessing whether a destination, route, attraction, booking, or activity is suitable for your own group and needs.
## 47. Accessibility and Translation Limitations
The app may use simplified wording, stylised phrasing, visual cues, colour cues, icons, or informal travel language. It may also present transliterations, short language phrases, abbreviations, or condensed warnings.
The operator does not warrant that:
- all users will interpret app content the same way
- all text is accessible to all users
- all warnings are linguistically or culturally precise
- translated or transliterated phrases are idiomatically correct
- phrasing that is clear in one dialect or region is clear in another
If accessibility, translation precision, or formal legal wording is important to your use case, you must rely on official or professionally prepared sources.
## 48. User Responsibility for Local Laws and Conduct
You are solely responsible for complying with all laws, rules, customs, codes, permits, restrictions, and social expectations that apply in your origin country, transit locations, and destination.
This includes responsibility for:
- immigration compliance
- customs declarations
- medication import restrictions
- drone, photography, or filming restrictions
- driving rules and licensing
- alcohol laws
- public behavior restrictions
- permit systems for parks, hikes, religious sites, or protected areas
- prohibited goods, sanctions, or export/import rules
The app may mention practical or cultural points, but it does not guarantee full legal coverage of a destination’s rules.
## 49. No Representation That User Reports Will Improve Safety
The app may allow users to report incorrect information, missing content, or suggested improvements. You acknowledge that this feature is not a safety monitoring system, not a legal reporting channel, not a complaints authority, and not an emergency escalation mechanism.
The existence of a reporting feature does not mean:
- every report will be read immediately
- a wrong number or wrong link will be corrected before another user sees it
- dangerous content will be removed before someone relies on it
- the operator is monitoring all content continuously
You remain responsible for verifying important information yourself, regardless of the existence of a feedback tool.
## 50. Release, Waiver, and Personal Responsibility for Travel Decisions
To the maximum extent permitted by law, you release the operator from claims arising from your personal travel decisions, including decisions to:
- book or not book travel
- cross or not cross a border
- visit or not visit an attraction
- rely or not rely on a link, itinerary, or summary
- purchase or not purchase insurance
- purchase or not purchase a connectivity service
- drive, hike, swim, dive, climb, camp, or otherwise undertake an activity mentioned in the app
This release does not override non-excludable legal rights, but it does allocate responsibility to you for your travel choices to the broadest extent permitted by law.
## 51. Disclaimer About Omitted Content
The operator does not promise that the app will include every country, every rule, every route, every attraction, every airline, every advisory, every map nuance, every local service, or every relevant warning.
Information may be omitted for many reasons, including:
- source limitations
- editorial decisions
- remote data constraints
- caching constraints
- device layout limitations
- partner or infrastructure changes
- legal or moderation considerations
- incomplete research
An omission does not imply that a topic is unimportant, irrelevant, safe, available, or risk-free.
## 52. No Duty to Monitor Third-Party Changes in Real Time
The operator may use remote content systems to keep certain information fresher over time, but the operator does not undertake a real-time monitoring duty.
There may be a delay between:
- a government changing a rule and the app reflecting it
- a third-party provider changing a link and the app reflecting it
- an emergency number changing and the app reflecting it
- a destination condition shifting and the app reflecting it
- a partner withdrawing an offer and the app reflecting it
The operator is not responsible for losses arising from the practical reality that digital informational products cannot guarantee immediate, universal, real-time synchronisation of all real-world developments.
## 53. Security and Abuse Prevention Rights
The operator may take any technical or operational measures reasonably considered necessary to protect the app, remote content feeds, feedback channels, local data flows, partner relationships, or infrastructure. These measures may include blocking, throttling, filtering, rate-limiting, removing content, disabling features, or changing data-delivery methods.
You agree not to challenge such measures solely because they reduce or change app functionality, provided the operator acts in good faith and within applicable law.
## 54. Electronic Communications and In-App Notices
You agree that legal notices, updates, warnings, prompts, disclosures, confirmations, and acceptance steps may be delivered electronically through the app, an app-store listing, a linked policy page, or another digital channel used by the operator.
Where the app requires you to tap to accept legal terms or continue using a feature after a legal update, that digital interaction constitutes valid assent to the extent permitted by law.
## 55. Interpretation
In these Terms:
- references to "including" or similar wording mean "including without limitation"
- headings are for convenience only and do not limit interpretation
- the singular includes the plural and vice versa where the context permits
- a reference to the app includes later renamed or rebranded versions of substantially the same product unless the operator states otherwise
If there is any ambiguity, these Terms must be interpreted in a commercially reasonable manner that reflects the app’s role as an informational and convenience service rather than a guaranteed professional or official source.
This wording prevails.
## 56. Additional Risk Allocation for Technical, Informational, and Interface Features
Without limiting any earlier clause, you acknowledge that the app contains many different interface surfaces, modules, screens, flows, and technical behaviors that are provided for convenience only. These may include country browsing, travelled-country marking, checklists, itinerary cards, information cards, swipe cards, maps, overlays, search panels, filters, interactive bubbles, in-app browser launches, safety cards, advisory cards, affiliate cards, partner offers, notifications, chat flows, subscription flows, and locally cached informational content. Each of these features may contain different code paths, data assumptions, presentation logic, timing logic, or fallback behavior. The operator does not warrant that every screen, state, branch, timing edge case, or presentation combination will be free from defects, omissions, delay, stale data, visual glitches, performance limitations, unexpected ordering, missing cards, inconsistent spacing, gesture sensitivity issues, stale cache presentation, notification delay, or display mismatch across all devices, densities, operating systems, or app-store release channels.
You agree that the app is supplied as a consumer-facing convenience product, not as a mission-critical system. You must not use the app in any scenario where a display issue, stale informational card, missing advisory, hidden button, expired link, stale schedule, delayed sync, broken visual treatment, incomplete list, or unavailable remote payload could reasonably cause unacceptable legal, medical, financial, aviation, immigration, transport, or personal safety consequences unless you independently verify the underlying information elsewhere first.
To the maximum extent permitted by law, the operator is not liable merely because:
- a feature existed in one build and was moved, reduced, or removed in a later build
- a bubble or card was previously visible and is no longer shown because data was unavailable
- a country had cached data on one device and not another
- a visual card sequence, random fact deck, swipe panel, or animated prompt behaved differently after an update
- a travel-related suggestion appeared in one session and not another
- a list of countries, attractions, providers, or references was incomplete or reordered
- a map or country visualization was simplified, stylized, or technically approximate
- an informational card used remote data from a cached snapshot rather than a live fetch
- a remote update was delayed, throttled, unavailable, rejected, partially applied, or missed
You accept that software evolution, defensive disabling of unreliable data, and safety-driven removal of weak fallback content are normal and permitted parts of the service.
## 57. Feature-by-Feature No-Reliance Clause
You agree not to rely on any single feature of the app as though that feature were a complete, standalone, authoritative, or guaranteed source of truth. Different features serve different limited purposes. For example, a travelled-countries screen is a self-managed memory aid, not an immigration history record. A checklist is a personal reminder tool, not a certified packing audit. A visa link is a convenience pointer, not a legal clearance. A safety card is a general awareness aid, not a live operational warning feed. A health card is a summary signal, not a clinical or epidemiological decision engine. A chat request is a user-generated interaction, not a verified representation of identity, safety, sincerity, or suitability. A subscription bubble is an account-access feature, not a promise of uninterrupted availability of every future premium capability.
You specifically agree that you will not treat any of the following as complete or sufficient in isolation:
- country charm text
- editorial summaries
- itinerary sequencing
- attraction highlights
- local experiences lists
- food, snacks, slang, gifts, or festival content
- taxi references
- emergency numbers
- map cues
- national animal or national bird references
- water, air, safety, health, power, laws, telecom, navigation, or transport summaries
- affiliate listings
- ads, referrals, or sponsored placements
- stored local message history
- cached Firebase content
If your use case requires certainty, documentary proof, professional judgment, legal enforceability, route-critical navigation, or life-impacting precision, this app is not enough by itself. You bear sole responsibility for obtaining direct, current, primary-source confirmation.
## 58. Assumption of All Travel and Booking Risk
Travel itself carries inherent risk, including risk of delay, denial, injury, illness, cancellation, detention, loss, confusion, theft, deception, natural events, mechanical problems, operator misconduct, crowd incidents, route changes, border discretion, local law enforcement action, public-health controls, strikes, weather disruption, fraud, overbooking, scams, and cultural or language misunderstandings. The app does not remove, reduce, or insure against those risks.
You knowingly assume all risk connected with:
- deciding whether to travel
- deciding where, when, and how to travel
- deciding whether to book transport, lodging, insurance, connectivity, local activities, or local services
- choosing to rely on any app summary, suggestion, or third-party link
- moving money or making commitments because of information displayed in the app
- entering a country, transiting through a country, or remaining in a country
- driving, walking, hiking, swimming, climbing, consuming food or drink, using medicines, attending events, or hiring local services
The operator does not undertake a duty to protect you from commercial disappointment, missed opportunities, booking friction, schedule mismatch, poor provider conduct, bad exchange rates, lost deposits, visa refusal, route closure, fraud, account lockout, or emotional dissatisfaction. You acknowledge that planning tools can assist but do not control reality. To the maximum extent permitted by law, all consequences of your travel and purchasing choices remain your responsibility.
## 59. Expanded Third-Party Provider Disclaimer
Third-party providers may include airlines, aggregators, hotels, hostels, insurers, eSIM providers, car-rental providers, activity platforms, mapping products, browser surfaces, government services, telecom businesses, pharmacies, stores, referral partners, tourism services, and local operators. The app may mention, link to, visually feature, advertise, or organize access to such providers. None of that makes the operator responsible for the provider.
You agree that the operator is not responsible for:
- provider solvency
- provider honesty
- provider licensing status
- provider staff behavior
- provider payment collection practices
- provider chargebacks, fees, taxes, or refund refusal
- provider cancellation rules
- provider dynamic pricing
- provider wait times
- provider local legality
- provider age restrictions
- provider hidden limitations
- provider account suspensions
- provider sanctions screening
- provider identity verification demands
- provider network coverage claims
- provider insurance exclusions
- provider blackout dates
- provider overbooking or under-delivery
Even if the app arranges links in a polished or persuasive way, you remain solely responsible for evaluating whether a provider is legitimate, safe, insured, licensed, suitable, and worth paying. You must review the provider's own terms, privacy policy, refund policy, claim policy, and cancellation rules before buying, applying, or booking.
## 60. Sponsored Placement and Commercial Influence Disclosure Expansion
You acknowledge that the app may make money from commercial relationships and that commercial incentives can influence what appears, where it appears, how prominently it appears, what wording is used, and which providers are highlighted. This does not mean the operator guarantees commercial neutrality, perfect comprehensiveness, or provider superiority. A provider may be shown because of availability of a partner link, technical compatibility, payment arrangement, editorial preference, or product strategy. A provider may be omitted even if that provider is cheaper, better, closer, safer, or more suitable for your situation.
You agree that:
- presence does not equal endorsement
- ranking does not equal objective superiority
- omission does not equal unsuitability
- prominence does not equal safety or legality
- affiliate placement does not create a fiduciary duty to you
You release the operator, to the maximum extent permitted by law, from claims based solely on the existence of monetization, referral, sponsorship, or revenue-sharing arrangements, provided the operator does not exclude non-excludable rights and does not intentionally misstate a provider as guaranteed, official, or risk-free.
## 61. User Representations, Warranties, and Covenants
By using the app, you represent, warrant, and covenant that:
- you are legally able to enter into these Terms
- you will use the app only for lawful purposes
- you will not misrepresent your identity, age, or authority
- you will not use the app in breach of sanctions, embargoes, or export controls
- you will not use the app to facilitate fraud, trafficking, harassment, exploitation, spam, stalking, extortion, or impersonation
- you will not submit malicious, false, obscene, defamatory, or rights-infringing content
- you will not reverse engineer, scrape, attack, or systematically extract protected content or service logic except as non-excludably allowed by law
- you will not use the app as a substitute for official immigration, medical, legal, insurance, or emergency advice
- you will independently verify important information before acting on it
- you will comply with app-store rules, payment rules, and local law
- you will not upload or transmit content you do not have the right to transmit
- you understand that other users, if any, are independent people and not agents of the operator
If any of these statements becomes inaccurate, you must stop using the relevant feature or the app entirely.
## 62. Account, Authentication, and Sign-In Risk Allocation
The app may support Google sign-in, Apple sign-in, or similar authentication mechanisms. Authentication is used for access management and convenience, not identity certification. A person who signs into an account is not guaranteed to be who you think they are in every practical sense. The operator does not perform full biometric, passport, visa, criminal, insurer, airline, medical, or law-enforcement-grade verification of each user merely because an authentication provider authenticated a sign-in event.
You are responsible for:
- maintaining control of your device
- maintaining control of your Google or Apple account
- securing your email account and app-store credentials
- preventing unauthorized device use
- signing out where appropriate
- not sharing access with others
The operator is not liable, to the maximum extent permitted by law, for loss arising from:
- compromised devices
- stolen sessions
- reused credentials
- account takeover at the email-provider or platform-provider level
- user error in signing into the wrong account
- delay in noticing unauthorized use
Authentication convenience does not create a guarantee that the service is immune from unauthorized access by someone who controls your device or upstream account.
## 63. Chat, Social, and User-Generated Communication Disclaimers
If the app offers or later offers user-to-user chat, inbound requests, discovery, profile visibility, or any social-contact function, those features are provided as a limited communication environment only. The operator does not guarantee the truthfulness, sincerity, legality, accuracy, good faith, age, safety, intent, availability, or real-world identity of any other user. The operator does not promise that a user profile is complete, current, accurate, non-deceptive, or suitable for contact. The operator does not promise that a user who seems nearby is actually nearby, that a user who appears online is continuously available, or that a user who sends a message has benign motives.
You assume all risk associated with:
- reading, sending, ignoring, or responding to a chat
- revealing information to another user
- interpreting tone, identity, or intent through text
- moving to off-platform communication
- taking advice from another user
- making travel, safety, immigration, relationship, money, lodging, transport, or health decisions because of another user's message
The operator strongly disclaims liability, to the maximum extent permitted by law, for deception, fraud, catfishing, abuse, manipulation, harassment, coercion, disappointment, or reputational damage arising from user-generated communication unless non-excludable law prevents that disclaimer.
## 64. No Duty to Screen, Vet, or Guarantee Other Users
The operator may choose to moderate, filter, disable, archive, restrict, or remove user access or content, but does not undertake a general obligation to continuously vet every user, verify every statement, monitor every interaction, or prevent every harmful act. The existence of profile creation, subscription gating, disconnection tools, deletion tools, archive behavior, or safety reminders does not create a guarantee that the communication environment is fully screened or safe.
You agree that:
- the operator may miss harmful or suspicious behavior
- technical controls may reduce but cannot eliminate abuse
- moderation decisions may be imperfect
- some content or behavior may be removed late or not at all
- some accounts may evade detection or return under new credentials
You remain responsible for exercising judgment, limiting disclosures, and exiting unsafe or unwanted interactions promptly.
## 65. Local Message Storage, Relay Queue, and Device Risk
Where the app stores message history locally on your device, whether in encrypted form or otherwise protected form, you acknowledge that local custody of data carries its own risk profile. The operator may design the system so that profiles, plan state, or connection state remain server-side while message history is retained primarily on the user's device and server-side message relay is temporary. This may reduce long-term server retention of message content, but it does not eliminate device-level risk.
You understand and accept that:
- messages may be lost if you lose a device, wipe a device, factory reset a device, replace a device, break a device, or uninstall the app
- encrypted local storage reduces but does not eliminate risk
- rooted, jailbroken, compromised, mirrored, or forensically examined devices may expose stored material
- backup systems, screenshots, notification previews, OS-level logs, malware, clipboard capture, or physical access can create exposure independent of app design
- temporary server-side relay may still exist for undelivered messages for a limited time
- delivered messages may no longer be recoverable from server infrastructure after deletion from the relay queue
To the maximum extent permitted by law, the operator is not liable for loss of locally stored chats, inability to recover delivered content, or unauthorized access caused by device compromise.
## 66. Message Delivery, Delay, Expiry, and Non-Delivery
If the chat system uses temporary relay delivery, message delivery can fail or be delayed for many reasons, including push-delivery limitations, background restrictions, offline devices, revoked permissions, local storage error, token invalidation, OS process killing, platform throttling, corrupted state, expired relay items, account sign-out, or connectivity issues. The operator does not guarantee delivery, ordering, timing, retention, recoverability, or evidentiary integrity of any message.
You acknowledge that messages may:
- arrive late
- arrive out of order
- expire before receipt
- fail to download locally
- appear unavailable after account deletion
- disappear from the server after both sides save them locally
- become unreadable after device loss
You must not use the app as a guaranteed legal-record system, business-critical messaging platform, emergency communications platform, or sole repository for legally sensitive statements.
## 67. Subscription, Entitlement, and Billing Limitations
The app may use subscriptions, entitlement checks, billing APIs, store products, restore-purchase flows, backend verification, or plan-based access controls. The operator does not guarantee that store infrastructure, billing APIs, subscription status propagation, receipt validation, purchase restoration, entitlement refresh, or cross-platform purchase recognition will always function instantly or perfectly.
You acknowledge that subscription access may be affected by:
- store delays
- payment failure
- fraud screening
- region restrictions
- test-track behavior
- pending transactions
- account mismatch
- subscription cancellation or lapse
- billing disputes
- app-store policy changes
- backend verification outages
- entitlement refresh delay
The operator is not liable, to the maximum extent permitted by law, for loss caused by temporary mismatch between store state and app state, provided the operator retains non-excludable consumer obligations to the extent required by law.
## 68. No Guarantee of Cross-Platform Identity or Purchase Equivalence
Android, iOS, app-store, and device ecosystems differ. A feature, price label, restore flow, payment method, notification path, sign-in method, permission requirement, or device behavior may differ between platforms. A subscription or entitlement may require additional verification steps or may be subject to the rules of the platform on which it was acquired. A purchase made through one ecosystem may not entitle you to equivalent behavior in another ecosystem if platform policy, payment architecture, or technical design differs.
You agree that:
- platform differences are normal
- different app stores may impose different rights and limitations
- not every feature reaches every platform at the same time
- beta, test, or staged releases may not behave identically to production releases
The operator does not warrant simultaneous parity across all platforms.
## 69. Data Caching, Snapshot Age, and Refresh Timing
The app may intentionally cache Firebase-fed or remotely delivered informational content on-device for extended periods in order to reduce repeated network usage and improve availability. This means that information may remain stable locally for a configured cache window even if the world changes during that period. You agree that this is an intentional design tradeoff. Cached data can be correct at the time of retrieval and later become incomplete or wrong without any bug occurring. A later sync may also fail, leaving older cached data in place longer than expected.
You agree that:
- cache persistence across app closure, reboot, or inactivity is permitted
- a "last synced" indicator is informational only and not a promise that every field is current
- different data categories may age differently in practical usefulness
- a successful sync in the past is not a guarantee of current truth
You remain responsible for time-sensitive verification regardless of sync age.
## 70. Search, Filter, Suggestion, and Ranking Behavior Disclaimer
Any search, autocomplete, filter, ordering, ranking, suggestion, itinerary composition, or prompt logic in the app may be based on incomplete, local, cached, approximate, randomized, promotional, or opinionated inputs. The operator does not represent that search results are exhaustive, that ordering is objective, or that omission means irrelevance. A country, attraction, provider, or fact may be missing from a list because of code constraints, data availability, editorial choice, caching state, or safe-display logic.
You agree not to infer from list order, search position, bubble prominence, or swipe-card frequency that the operator has made a professional judgment that one option is best for your needs.
## 71. Notification Disclaimer
Push notifications, local notifications, or other reminders may be late, suppressed, duplicated, delayed, truncated, generic, unavailable, or blocked by the platform, the user, the carrier, or the device. The operator does not guarantee that a message, subscription event, travel prompt, sync reminder, or safety-related notice will appear, appear promptly, or appear with full content. The operator may intentionally keep notification wording generic for privacy and safety reasons.
You must not rely on notifications as your sole means of learning about messages, subscription status, travel changes, or urgent information.
## 72. No Warranty of Suitability for Minors, Families, Group Travel, or Dependency Use Cases
The app is not designed as a child-safety platform, school-duty platform, guardian-duty system, court-compliance system, medical escort platform, or dependency-management system. If a child, dependent person, vulnerable adult, employee, patient, student, or supervised traveler uses or is affected by the app, the supervising adult or entity bears sole responsibility for supervision, verification, consent, and legal compliance.
Nothing in the app shifts that supervision duty to the operator.
## 73. Prohibited Uses
You must not use the app to:
- plan or facilitate unlawful entry or overstaying
- evade screening, sanctions, or official requirements
- mislead officials, carriers, insurers, or service providers
- harvest data at scale
- scrape, clone, or republish substantial content without authorization
- interfere with service performance
- automate abusive interactions
- harass or scam users
- distribute malware or phishing links
- conduct unauthorized security testing
- impersonate an official or the operator
- reproduce the app as a competing service using copied content or structure
Violation may result in suspension, termination, reporting, or legal action where permitted.
## 74. Indemnity
To the maximum extent permitted by law, you agree to indemnify, defend, and hold harmless the operator and its related persons from and against claims, demands, proceedings, investigations, liabilities, losses, damages, costs, penalties, fines, judgments, settlements, and reasonable legal expenses arising out of or related to:
- your use of the app
- your breach of these Terms
- your breach of law
- your reliance on app content without independent verification
- your dealings with third parties reached through the app
- your user-generated content, suggestions, reports, or submissions
- your infringement of another person's rights
- your travel, booking, payment, transport, immigration, insurance, or social-contact decisions
- any dispute between you and another user
- any dispute between you and a linked provider
This indemnity is intended to be broad, but only to the extent enforceable under applicable law.
## 75. Limitation of Liability and Non-Excludable Rights
To the maximum extent permitted by law, the operator excludes liability for indirect, incidental, special, consequential, exemplary, punitive, or economic loss, including lost profits, lost opportunity, lost savings, lost data, lost goodwill, lost booking value, emotional distress, reputational loss, travel disruption loss, or substitute service cost. To the extent liability cannot be excluded, it is limited to the minimum extent permitted by law and, where permitted, to resupply of the services or payment of the cost of resupply.
Nothing in these Terms excludes, restricts, or modifies rights that cannot lawfully be excluded, including applicable non-excludable guarantees under the Australian Consumer Law where relevant.
## 76. Entire Agreement, Updates, and Lawyer Review
These Terms, together with any linked policies expressly incorporated, form the legal framework governing use of the app. The operator may update them as the app evolves, including when features such as chat, subscriptions, caching, local encryption, affiliate flows, or remote content behavior change.
Because no template can make anyone completely immune from legal risk in every jurisdiction or fact pattern, these Terms are intended as a strong operational draft, not a substitute for tailored legal advice. You agree that any continued use after updates constitutes acceptance to the extent permitted by law.
## 77. Operator Identity and Contact
For the purposes of these Terms, the app operator is Lorikeet Studio. Unless a different legal entity is expressly identified in a later written notice, store listing, invoice, or incorporated legal document, references in these Terms to "the operator," "we," "us," or "our" mean Lorikeet Studio.

The operator may change its contact details, trading style, branding, or legal structure over time. If it does so, the app, a linked policy page, or the relevant store listing may be updated accordingly. A change in email, branding, or business structure does not by itself terminate these Terms or any rights, waivers, releases, disclaimers, limitations, consents, or indemnities that arose before the change.
## 78. Construction of These Supplemental Terms
Sections 77 onward are intended to supplement, strengthen, and more specifically apply the earlier provisions of these Terms to the app's evolving feature set, technical architecture, monetization paths, caching behavior, chat design, on-device storage design, remote configuration behavior, affiliate-link surfaces, in-app browser flow, and other app-specific operational realities.
If there is any inconsistency between a broad earlier statement and a more detailed later statement, the more specific statement should be read as explaining and refining the earlier statement rather than replacing it, unless doing so would be unlawful or impossible. If any provision is unenforceable, the rest of these Terms continue to apply to the maximum extent permitted by law.
These supplemental sections are written intentionally broadly because the app may continue to change through future updates, staged releases, test builds, region-specific releases, pricing changes, store policy changes, remote content changes, backend redesigns, or legal-risk adjustments.
## 79. Definitions Used in These Terms
In these Terms:
- "App" means Wanderlust and any successor, renamed, rebranded, companion, staged, test, or platform-adapted version of substantially the same product unless we expressly state otherwise.
- "Content" means all information, wording, suggestions, links, cards, lists, prompts, screens, maps, icons, data fields, notices, rankings, facts, itineraries, bubbles, chat prompts, safety prompts, and other materials displayed through the app.
- "Remote content" means content or configuration retrieved from Firebase, similar remote tools, or any other service used to deliver or update app information.
- "Cached content" means remote content or local content saved on a user's device for later use.
- "User content" means anything a user submits, sends, stores, transmits, reports, suggests, uploads, or causes to appear through the app.
- "Partner link" means any commercial, sponsored, affiliate, referral, monetized, tracked, or campaign-linked external URL or route.
- "Official link" means a link that appears intended to point to a government, public authority, embassy, immigration portal, or similar formal source, whether or not it remains correct.
- "Chat relay" means the temporary server-side message-delivery layer used to help pass messages between devices before deletion or expiry.
- "Delivered message" means a chat message that a device or service treats as received, downloaded, stored, acknowledged, or otherwise processed.
- "Plan" or "subscription plan" includes free access states, paid access states, trial states, promotional access states, and store-linked entitlements.
The singular includes the plural and vice versa. Headings are for convenience only.
## 80. Scope of Features Covered by These Terms
These Terms are intended to cover the app as a whole, including but not limited to:
- overview screens and country summary screens
- info tabs and informational card surfaces
- visa bubbles, flight bubbles, stay bubbles, insurance bubbles, eSIM bubbles, and other monetized bubbles
- checklists, itinerary content, facts cards, travel-preparation text, and similar planning aids
- travelled-country marking, local preference storage, local visual state, and country history features
- safety notices, emergency references, customs prompts, etiquette notes, and language snippets
- chat profiles, chat discovery, chat requests, subscription-gated chat, free/paid restrictions, locked inbound requests, local message storage, relay messaging, push notifications, and disconnection behavior
- in-app browser flows, handoff flows, and external URL launches
- remote sync, Firebase-fed content, fallback suppression rules, and local caching
- account creation, Google sign-in, Apple sign-in where offered, logout, deletion, profile removal, and archive behaviors
- subscription offers, entitlement refresh, restore purchase flow, and store-facing pricing display
If the app introduces a new feature later that is reasonably related to travel information, discovery, planning, messaging, monetization, personalization, or remote content delivery, these Terms are intended to apply to that feature as well unless a new specific term says otherwise.
## 81. Informational Country Data Specific Disclaimer
Country information in the app may include capitals, largest cities, time zones, regions, public facts, map references, attraction ideas, etiquette notes, language snippets, climate ideas, cuisine notes, or similar informational summaries. Such material may be simplified, generalized, shortened, stylized, editorialized, incomplete, culturally imperfect, or outdated. A country can change rules, transportation norms, emergency systems, tourism conditions, visa rules, advisories, or infrastructure faster than the app updates. A fact may also be contested, nuanced, regional, politically sensitive, or dependent on context.
You agree that:
- informational country content is not a substitute for official or expert country research
- a short summary cannot capture all legal, cultural, geographic, safety, infrastructure, or practical nuances
- omission of a warning does not mean absence of risk
- mention of an attraction, route, food, or activity does not mean it is safe, suitable, open, accessible, or ethical for you
- stylized wording, beautiful design, or persuasive language does not convert informational content into a binding promise or guarantee
To the maximum extent permitted by law, the operator is not liable because country information was simplified, abbreviated, localized poorly, or became stale after caching or sync delay.
## 82. Visa, Entry, and Immigration Feature-Specific Terms
The app may contain country-specific visa bubbles, e-visa references, immigration portal links, consular information links, or text suggesting where a user might start research. These are navigation aids only. They do not guarantee that a user is eligible to enter a country, that a portal is the right one for that user, that the relevant nationality is covered, that the linked process remains lawful, or that a digital route is still the preferred or valid route.
You acknowledge that visa and immigration outcomes can depend on matters not knowable to the app, including:
- nationality
- dual citizenship
- residency status
- travel history
- sanctions exposure
- purpose of travel
- length of stay
- criminal history
- health history
- vaccination status
- employer status
- invitation status
- transit status
- previous immigration refusals
- airline documentation requirements
- border-officer discretion
You agree not to rely solely on the app when making or delaying immigration, visa, transit, or border decisions. If the app does not have a current official link, the absence of a fallback display is intentional and does not create any representation that no route exists or that unofficial alternatives are suitable.
## 83. Government, Embassy, and Public Authority Link Terms
Where the app displays a link that appears to be governmental or quasi-governmental, the operator does not promise that:
- the linked page remains official
- the domain remains unchanged
- the information is still current
- the service is offered to your nationality or region
- the page remains secure
- the process remains available online
- the page is accessible in your language
- the route is the best route for your facts
Government websites themselves can change ownership, structure, paths, domains, forms, availability, security posture, or eligibility rules. Public agencies can also temporarily remove services, redirect them, or replace them with different systems. You bear sole responsibility for confirming authenticity and security before entering personal or payment information into any external site.
The operator is not responsible for impersonation pages, phishing pages, government-domain compromise, form rejection, server errors, queue errors, payment failures, or legal consequences arising from your use of a linked public-authority page.
## 84. Safety, Health, and Emergency Content Terms
Any safety, health, or emergency-related information in the app is general and non-exhaustive. Safety cards, health cards, warning banners, emergency-number cards, pharmacy references, scam tips, or etiquette prompts are not a substitute for live situational awareness or professional advice. Conditions vary by city, neighborhood, weather, season, event calendar, crime patterns, protest activity, health outbreaks, carrier coverage, building safety, and individual circumstance.
You agree that:
- the app cannot monitor your live environment in real time
- a country's general risk label may be wrong for a specific neighborhood or vice versa
- a green or calm-looking design does not mean actual safety
- the absence of a warning does not mean an absence of legal, health, or physical danger
- the app is not a panic button, emergency call center, or dispatch system
You must verify emergency numbers, local hospital options, embassy pathways, evacuation instructions, and relevant advisories through direct official channels. You accept that some numbers may fail because of roaming, SIM status, Wi-Fi calling, device configuration, carrier routing, local network issues, or regional service differences.
## 85. Attractions, Experiences, and Itinerary Content Terms
Itinerary content, attraction lists, destination highlights, food tips, customs notes, and activity cards are descriptive suggestions only. They are not promises of access, legality, safety, affordability, suitability, or schedule feasibility. An itinerary can be charming and still be impractical. A country can have beautiful ideas in a card and yet be unsuitable for your budget, visa status, mobility needs, health condition, language level, weather tolerance, or political risk profile.
You agree that itinerary and experience content may:
- omit closures
- omit permit rules
- omit reservation requirements
- omit disability-access limitations
- omit local legal restrictions
- omit seasonal shutdowns
- omit strikes
- omit weather disruption
- omit transport gaps
- omit crowd conditions
- omit local scams
- omit pricing volatility
The operator does not guarantee that a suggested experience is family-friendly, child-safe, sober, lawful, culturally appropriate, accessible, good value, safe at night, or practical without a car. You assume all responsibility for deciding what to do, where to go, what to book, and what risk is acceptable.
## 86. Travel Provider, Flight, Stay, Insurance, and eSIM Terms
The app may visually surface partner or affiliate routes for flights, accommodation, insurance, eSIMs, transportation, and similar services. These links may come from Firebase-fed data and may appear or disappear depending on remote configuration, region, campaign status, or product strategy. The presence of such a bubble does not mean:
- the provider is the only provider
- the provider is the cheapest provider
- the provider is the safest provider
- the provider is appropriate for your needs
- the provider is available in your jurisdiction
- the provider complies with all laws affecting you
- the provider is endorsed by any government
Any booking, purchase, policy, contract, SIM activation, refund dispute, baggage issue, no-show issue, hotel dispute, claim denial, upgrade dispute, cancellation, rebooking, or payment problem is between you and the relevant third party unless non-excludable law says otherwise. The operator is not your travel agent, insurer, telecom carrier, accommodation principal, or merchant of record merely because the app routed you to a provider.
## 87. Sponsored Placement and Promotional Ordering Terms
You acknowledge that the app may use ordering, prominence, wording, color treatment, mascot treatment, card position, bubble position, or interface emphasis in ways that reflect design choices, monetization choices, remote campaign controls, available link data, or editorial strategy. A partner card may be featured more prominently than a non-partner idea. A non-partner option may be absent entirely. A country card may show one sponsor today and a different sponsor later.
You agree that:
- visual prominence is not a neutral market survey
- card position does not guarantee superior value
- scarcity wording, urgency wording, glow styling, or premium styling may be persuasive design rather than factual assurance
- a provider omitted from the app may still be better for you than a provider shown in the app
To the maximum extent permitted by law, you release the operator from claims based solely on disagreement with display order, sponsor prominence, or absence of comprehensive provider comparison, provided we do not intentionally misstate a provider as guaranteed, official, or risk-free.
## 88. In-App Browser and Link-Security Terms
The app may open external content inside an in-app browser, custom tab, secure browser surface, or similar embedded viewing experience. That embedded viewing experience is a convenience layer only. It does not transform a third-party website into a service operated by the operator. It does not guarantee that the site is safe, secure, correct, legitimate, properly encrypted, or appropriate for data entry. Even if the app blocks some insecure schemes or upgrades some URLs to HTTPS, the operator cannot guarantee the safety of every destination, subpage, redirect chain, cookie flow, embedded widget, script, or identity form.
You agree that before entering any sensitive information into a site opened by the app, you must independently review the domain, security indicators, legitimacy, and relevance of the destination. Sensitive information includes passport data, national ID data, visa data, biometric data, home addresses, financial information, health information, social-account credentials, and payment credentials.
The operator is not liable for phishing, malware, page compromise, insecure third-party scripts, certificate issues, keylogging outside the app, or misuse of information you provide to an external site.
## 89. Firebase-Fed Data and No-Fallback Display Terms
Some app surfaces are intentionally designed to show information only when remote Firebase-fed or similar remote content is present and valid. The operator may deliberately suppress fallback content, placeholder content, search-engine redirects, guessed links, stale partner alternatives, or broad generic substitutes where those substitutes would be more misleading than silence.
You agree that:
- a blank state may be more accurate than an invented fallback
- a missing bubble does not mean the underlying service or topic does not exist in the real world
- a missing bubble may simply mean the operator chose not to show unverified or non-current content
- a previously seen bubble may disappear without notice when remote content changes or fails validation
The operator is not liable because content was withheld rather than guessed. You accept that the app may choose "no data shown" over "possibly wrong data shown" and that this design choice is reasonable, intentional, and protective.
## 90. Remote Caching and Thirty-Day Snapshot Terms
The app may intentionally cache certain Firebase-fed content locally on a user's device after a successful retrieval and then continue using that cached snapshot for a significant period, including a 30-day window or any later configured period. That cache can persist across app closure, device restart, idle time, backgrounding, operating-system restarts, and ordinary user inactivity.
You acknowledge that this means:
- the app may show content that was accurate when downloaded but later became stale
- the app may not check Firebase again until the configured refresh window expires or another valid refresh trigger occurs
- a device may remain on an older snapshot even while another device already has a newer snapshot
- a "last synced" label may be directionally useful but not a guarantee that every field currently matches reality
You accept this as an intentional performance, cost, and availability tradeoff. The operator is not liable because content remained cached during its valid cache window or because a later remote refresh was delayed, failed, or returned different information.
## 91. Local Preferences, Travelled-Country Lists, and Device-State Terms
The app may store local preferences, travelled-country selections, search history fragments, dismissed-card states, carousel positions, seen-fact states, local visual progress, or similar convenience data on your device. Such data may be lost, duplicated, reset, or become inconsistent because of uninstall, reinstall, backup restore, storage corruption, platform cleanup, permission changes, account-switching, cache-clearing, or app update behavior.
You agree that:
- local preference storage is provided for convenience only
- loss of local state does not create a right to compensation
- local state may differ from server-side account state
- a travelled-country list may be incomplete if local data was lost or not restored
The operator does not guarantee historical reconstruction of every local preference, every swiped fact, every dismissed prompt, or every country you previously marked. Where the app later introduces cloud sync for some of these preferences, different synchronization risks may also apply.
## 92. Lori Facts, Randomization, Animation, and Editorial Surface Terms
The app may present entertainment or educational surfaces such as facts cards, swipe-card stacks, animated prompts, random fact drops, or similar engagement elements. These surfaces may use randomized ordering, shuffled lists, timed animations, gesture hints, nudges, and stylistic presentation. The operator does not guarantee:
- perfectly uniform randomness
- no repeated fact within a time period
- no accidental stale phrasing
- no subjective wording
- no cultural simplification
- no editorial disagreement
These surfaces are for lightweight engagement and informational flavor only. Their tone, order, repetition frequency, or animation style does not create a factual warranty, educational certification, or promise of comprehensiveness. The operator is not liable because a user considers a fact trivial, repeated, incorrect, incomplete, badly timed, unhelpful, or culturally imperfect.
## 93. Checklist and Preparation Tool Terms
Checklists, packing prompts, preparation speech, pre-flight reminders, and similar planning surfaces are general convenience tools only. They are not exhaustive and are not tailored to every trip, medical need, airline policy, destination rule, customs regime, weather pattern, event type, or baggage allowance. A checklist may omit something essential to your circumstances, even if it looks polished and structured.
You agree that:
- you remain responsible for your own packing, documentation, timing, and compliance
- an item not listed may still be necessary
- an item listed may be unnecessary for your trip
- a checklist cannot account for every disability, prescription, infant, work device, visa packet, sports equipment, or cultural requirement
The operator is not liable for packing mistakes, missed documents, denied boarding, customs issues, prescription issues, forgotten chargers, luggage problems, or trip disruption arising from use of the checklist surface.
## 94. Search, Suggestion, and Card-Visibility Terms
The app may use search fields, filters, cards, bubbles, chips, or similar discovery surfaces that are dependent on a mix of local assets, cached data, remote configuration, device capability, and feature-specific visibility rules. Not every result will appear all the time. Some cards may only display if a Firebase-fed link exists. Some cards may disappear if data is stale, missing, or intentionally suppressed. Some search flows may return nothing even where information exists elsewhere in the app or in the real world.
You agree that non-display does not equal non-existence. You further agree that:
- the app is not a complete reference index
- search is not guaranteed exhaustive
- indexing may change across updates
- visibility thresholds and display rules may change without notice
- results may be intentionally reduced for safety, clarity, monetization, or quality-control reasons
The operator does not accept liability because a user inferred too much from what was or was not visible in a particular screen state.
## 95. Accounts, Authentication, and Identity Assumptions
If the app offers account features, sign-in, profile creation, or entitlement-linked access, those features are provided for app access management, not for guaranteeing a person's true legal identity. A Google account, Apple account, or similar sign-in event may establish access credentials, but it does not prove moral reliability, travel competence, age truthfulness, location truthfulness, or non-fraudulent intent.
You agree that:
- the operator is not a passport office
- the operator is not a police verification service
- the operator is not a criminal-background screening service
- the operator is not a romance, trust, or credibility guarantor
You are responsible for your own decisions about whether to trust, contact, pay, travel with, disclose information to, or meet another person who uses the app.
## 96. Chat Feature Architecture Terms
If chat or user-to-user communication features are available, the architecture may intentionally separate:
- profiles and plan state stored server-side
- chat connection state stored server-side
- temporary message relay stored server-side for limited periods
- delivered message history stored primarily on users' devices
That design is intentional. It may improve privacy and reduce long-term server retention of message content, but it also means the operator may not retain a readable server-side archive of delivered conversations. Once messages are delivered, locally saved, acknowledged, deleted, or expired from the relay layer, the operator may no longer possess or be able to reconstruct their content.
You agree not to use the chat feature as your sole legal record, compliance archive, escrow channel, emergency log, or evidence system. You also accept that the operator may be technically unable to retrieve delivered content even if asked later by you or a third party.
## 97. Local Message Storage Terms
Delivered chat messages may be stored locally on the user's device rather than permanently on the operator's servers. That local storage may be encrypted by app-level mechanisms, platform-level mechanisms, or both, but no device environment is risk-free. The operator does not guarantee that local storage is immune from:
- rooted-device compromise
- jailbroken-device compromise
- device theft
- malware
- spyware
- shoulder surfing
- unlocked-device access by another person
- insecure backup extraction
- hardware fault
- corrupted storage
- user error
If you lose your device, wipe your device, move to another device, or reinstall the app, locally stored chats may become inaccessible. The operator is not responsible for that loss and does not promise cloud recovery of delivered message history.
## 98. Chat Relay, Delivery, and Expiry Terms
Undelivered or in-transit messages may temporarily exist in a chat-relay queue for limited delivery purposes only. Those relay items may be deleted after both sides are treated as having saved them locally, or they may expire after a configured time window such as seven days if delivery does not complete. This means server-side visibility of a message may be temporary, incomplete, or absent.
You agree that relay behavior may cause a message to:
- arrive late
- never arrive
- expire undelivered
- appear out of sequence
- duplicate
- disappear after delivery
- remain unavailable after account deletion
- be lost during a device transition
The operator does not guarantee chain-of-custody integrity, legal-evidence integrity, or perfect timeline integrity for relay messages.
## 99. Locked Inbound Chat, Free Access, and Monetized Gate Terms
The app may let some users remain visible or searchable while restricting what they can initiate, view, reply to, or unlock without a paid plan. A user may see prompts such as locked inbound requests, blurred photos, generic previews, or prompts indicating another traveler is trying to chat, while withholding the underlying content until subscription or entitlement conditions are satisfied.
You agree that:
- the app may intentionally conceal sender identity, sender message text, and metadata in locked states
- locked inbound requests may expire
- free users may be capped as to how many locked requests they can hold
- a sender has no guarantee that a free user will ever unlock, read, or respond
- a free user has no guarantee that a locked request remains available indefinitely
The operator is not liable for commercial disappointment, missed opportunities, unaccepted contact attempts, or expired social opportunities arising from these product-design choices.
## 100. User Conduct in Chat and Social Features
You must not use chat, discovery, profile, or social surfaces to harass, manipulate, scam, threaten, exploit, extort, impersonate, stalk, groom, spam, deceive, defame, blackmail, catfish, solicit unlawful services, distribute malware, solicit money under false pretenses, or otherwise misuse another person. You must not share or demand sensitive personal information unless lawfully necessary and appropriate, and even then you do so at your own risk. The operator does not endorse users moving conversations off-platform and may present safety language discouraging that behavior.
Even with these restrictions, the operator does not guarantee that all misuse will be detected or prevented. You release the operator, to the maximum extent permitted by law, from claims that another user behaved badly, deceptively, or dangerously unless non-excludable law prevents that release.
## 101. Moderation, Restriction, and Reporting Rights
The operator may, but is not obliged to, moderate, review, restrict, suspend, hide, archive, disconnect, throttle, or remove users, messages, profiles, links, or features where misuse, policy risk, legal risk, reputational risk, or infrastructure strain is suspected. The operator may rely on internal heuristics, user reports, platform warnings, automated filtering, metadata signals, or human judgment when taking action.
You agree that:
- moderation may be imperfect
- no moderation promise creates a duty to prevent all harm
- the operator may act quickly without proving a violation to your satisfaction
- the operator may preserve some metadata or limited operational records for security, legal, or abuse-prevention reasons
The operator is not liable merely because moderation was late, early, harsh, incomplete, or commercially inconvenient to you, provided mandatory legal obligations are not excluded.
## 102. Deletion, Logout, Profile Removal, and Archive Terms
The app may distinguish between logout and profile deletion. Logout may disconnect your current device session while leaving server-side profile and plan information intact. Profile deletion may remove some or many server-side records, but practical deletion behavior can vary because of caching, legal retention, abuse-prevention controls, local device state, store-transaction records, relay-state expiry, or residual backups.
You acknowledge that:
- deletion may not instantly erase every technical trace
- delivered chats stored on another person's device may remain outside the operator's control
- undelivered relay messages may still exist temporarily until expiry or cleanup
- billing or tax records may need to be retained where law requires
- subscription-store operators may hold their own records independently of us
The operator is not liable because another user still has a local copy of a message or because a platform or lawful record-keeping regime retains records outside the operator's immediate deletion surface.
## 103. Billing, Plans, Prices, and Store-Displayed Amounts
Displayed pricing in the app may depend on store product data, regional formatting, product availability, local currency, tax treatment, and successful store lookup. The app may show a local store price, a generic label, or a fallback wording such as "local price in store" when the exact live store price is not yet available. The operator does not guarantee that the app display, store display, and backend entitlement state will update simultaneously.
You agree that:
- the app does not promise a price until the store confirms the transaction terms
- taxes, foreign exchange fees, bank fees, and local billing rules may affect what you actually pay
- store interfaces, not app copy alone, govern the final purchase confirmation step
If there is a mismatch between decorative or preliminary pricing language in the app and the actual store checkout screen, the store checkout screen governs the charge actually authorized.
## 104. Subscription Auto-Renewal, Cancellation, and Refund Terms
Where applicable, subscriptions may auto-renew unless canceled according to the rules of the relevant app store or payment platform. Cancellation rights, refund rights, cooling-off rules, billing periods, grace periods, payment retry behavior, and account-hold behavior may depend on store policy and local law. The operator does not control every aspect of those platform rules.
You are responsible for:
- reviewing the store's purchase terms before subscribing
- canceling in time if you do not want renewal
- using the correct account and store region
- checking whether a purchase was made in a test environment or live environment
To the maximum extent permitted by law, the operator is not liable because you forgot to cancel, used the wrong account, misunderstood the store's renewal cycle, or expected a refund that the store did not grant, provided the operator does not exclude non-excludable legal rights.
## 105. Platform-Specific Billing and Purchase Validation Terms
The app may use backend verification, purchase-token checks, entitlement refresh calls, restore-purchase routines, and platform APIs to decide whether chat or premium access should be enabled. Those mechanisms are subject to platform restrictions, service-account permissions, latency, outage, revocation, test-track behavior, and fraud controls. A purchase may be valid in one practical sense yet temporarily unreflected in the app pending verification or refresh.
You agree that:
- purchase validation may require internet access
- platform policy changes can affect validation behavior
- backend verification can fail temporarily even where a store purchase exists
- entitlement may be delayed while state reconciles
The operator will remain bound by any non-excludable legal obligations, but otherwise disclaims liability for temporary entitlement mismatch or validation delay to the maximum extent permitted by law.
## 106. Device Security, Compatibility, and User Environment Responsibility
You are solely responsible for the security, maintenance, and lawful operation of your device environment. This includes your phone, tablet, emulator, keyboard app, browser surface, mobile operating system, installed accessibility tools, backup tools, anti-malware tools, screen overlays, and network environment. The operator does not control your Wi-Fi, router, VPN, corporate firewall, carrier, enterprise mobile-management profile, operating-system bugs, or other apps on your device.
You agree that the operator is not liable for problems caused by:
- rooted or jailbroken devices
- third-party overlays or accessibility services
- aggressive battery managers
- notification suppression
- enterprise device restrictions
- cloned apps
- modified app packages
- sideloaded versions
- unsupported emulators
- low storage
- corrupted local databases
- damaged hardware
If you run the app in a non-standard environment, you assume the resulting risk.
## 107. Rooted, Jailbroken, or Compromised Device Terms
If your device is rooted, jailbroken, unlocked in ways that reduce security, infected, or otherwise practically compromised, the confidentiality, integrity, and reliability of local data can be materially reduced. That includes chat history, account tokens, cached content, notification tokens, and local preferences. Even strong app-level encryption may be weakened by a compromised environment.
You agree that if you choose to use the app on such a device, you do so at your own risk. To the maximum extent permitted by law, the operator is not liable for unauthorized access, key compromise, token theft, or data extraction arising from the compromised state of your device.
## 108. Backups, Restores, and Data Migration Terms
The app may or may not integrate cleanly with platform backups, encrypted device backups, vendor migration tools, cloud transfer tools, or handset-to-handset cloning tools. A backup can restore too much, too little, or inconsistent state. Local encrypted chat history may not decrypt properly on a different device if key material does not move with it. Conversely, some data may persist longer than a user expected if a platform backup reintroduces it.
You agree that:
- backup/restore outcomes are not guaranteed
- the operator does not promise device-to-device migration of all local state
- reinstalling the app may change the local key environment
- a restored cache may be older than current remote content
The operator is not liable for migration inconvenience, duplicate cards, stale local state after restore, or unreadable restored chat history.
## 109. Law Enforcement, Regulatory, and Legal-Request Terms
Because the app may intentionally retain delivered chat history primarily on user devices rather than permanently on our servers, the operator may not possess the full content of delivered communications. You agree and acknowledge that:
- we may not be able to supply delivered-message content later even if asked
- we may only possess limited metadata, connection state, billing-related records, or temporary relay-state records
- undelivered or not-yet-cleaned relay items may exist temporarily but are not guaranteed to remain
- third-party platforms such as app stores, email providers, and cloud providers may hold separate records outside our control
Nothing in the app is a promise that we can retrieve any given historical chat. The operator may comply with lawful requests to the extent legally required and technically possible, but does not warrant that full content recovery will exist.
## 110. No Duty to Preserve Evidence for You
You must not assume that the operator is preserving evidence for your personal dispute, breakup, chargeback, immigration issue, insurance claim, harassment complaint, defamation claim, travel dispute, or criminal complaint. If you need your own records, you are responsible for lawfully maintaining them yourself, subject to privacy law, consent requirements, and other applicable law.
The operator is not a records escrow agent, evidence custodian, or statutory archive. To the maximum extent permitted by law, we disclaim liability because a message, card, prompt, or local state was unavailable later for your personal dispute or legal strategy.
## 111. Children, Age-Sensitive Use, and Vulnerable-User Terms
The app is not designed to create a duty of care equivalent to a school, babysitter, therapist, social worker, guardian, migration adviser, or custodial service. If minors or vulnerable persons use the app or are affected by its use, the responsible adult or entity must supervise and bear responsibility for permissions, disclosures, and decision-making.
You agree not to rely on the app as a screening tool for whether another user is safe, age-appropriate, sober, mentally stable, financially honest, or suitable to contact. The operator does not warrant that all users are adults, truthful, or appropriate for communication. If the law in your jurisdiction requires parental consent, guardian oversight, or additional disclosures, you are responsible for compliance.
## 112. Accessibility, Translation, and Interpretation Terms
The app may use simplified language, short-form copy, stylized headings, AI-assisted wording, translated phrases, or approximated summaries. Some copy may be harder to understand on certain devices, in certain languages, or through certain accessibility tools. Translations, transliterations, and pronunciation hints may be imperfect. A safety phrase, etiquette phrase, or visa-related phrase may be shortened or simplified in ways that lose nuance.
You agree that:
- translation is informational only unless expressly stated otherwise
- the operator does not promise legal-grade translation accuracy
- a mistranslated or simplified phrase may be awkward, incomplete, or culturally imperfect
The operator is not liable for embarrassment, misunderstanding, or operational inconvenience caused by informal translation or simplified wording.
## 113. Geographic, Geopolitical, and Mapping Sensitivity Terms
Country names, regional labels, map outlines, and border representations may be simplified, stylized, or dependent on data sources. Such representations may be politically sensitive or disputed. They are displayed for travel-reference convenience only. The operator does not intend to make geopolitical, sovereignty, sanctions, or diplomatic determinations through app presentation.
You agree that:
- a map outline or label is not a legal statement
- border and territory disputes may exist that the app does not capture
- a travel route can become politically, legally, or militarily sensitive quickly
The operator is not liable for offense, dispute, denial of entry, or travel consequence arising from a user's reliance on map simplifications or geopolitical assumptions.
## 114. Compliance with Local Laws and Export Controls
You are solely responsible for complying with the laws, sanctions rules, customs rules, import/export restrictions, content rules, privacy rules, immigration rules, booking rules, consumer rules, payment rules, and local conduct rules that apply to you. This includes laws that govern what devices, medicines, media, drones, currencies, satellite devices, communications tools, or social interactions are lawful in a destination.
The operator does not represent that any feature, route, provider, or communication method displayed in the app is lawful in every country or for every user. If local law prohibits a use case, you must not rely on the app as permission to proceed.
## 115. App-Store, Distribution, and Test-Track Terms
The app may be distributed through internal testing, closed testing, open testing, staged production, or similar channels. Test-track builds can contain unfinished features, changed terms, different prices, disabled pathways, placeholder art, temporary architecture, or partial rollouts. A feature seen by one tester may not be seen by another.
You agree that:
- test builds are especially likely to change without notice
- app-store review, propagation delay, or device caching may affect what build you actually receive
- a store listing may lag behind current code or vice versa
- distribution through a store does not mean the store endorses every factual statement in the app
The operator is not liable for differences between test and production behavior or for propagation delays controlled by app stores.
## 116. Force Majeure and External Dependency Events
Without limiting earlier clauses, the app depends on many external systems, including mobile operating systems, app stores, Firebase, Google services, Apple services, carriers, DNS, CDNs, certificate chains, hosting providers, email systems, notification services, browser surfaces, and payment infrastructure. Any of these can fail, throttle, block, or change policy unexpectedly.
The operator is not liable for failure, delay, or changed behavior caused by external dependency events beyond reasonable control, including:
- cloud outages
- DNS incidents
- certificate failures
- carrier restrictions
- sanctions
- government takedowns
- store policy changes
- forced deprecations
- platform API removals
- background-execution restrictions
## 117. Waiver, Release, and Assumption of Risk
To the maximum extent permitted by law, you expressly assume all ordinary and extraordinary risks of using a travel-planning, link-routing, social-contact, and subscription-gated app in the real world. You further release the operator from claims arising from your use of the app, your interactions with third parties, your travel decisions, and your reliance decisions, except to the extent such a release would be unlawful or ineffective under applicable non-excludable law.
You acknowledge that this release is intended to be interpreted broadly and to reinforce all earlier disclaimers, waivers, releases, and allocations of responsibility contained in these Terms.
## 118. Additional Indemnity Details
Without limiting Section 74, your indemnity obligations include claims arising from:
- your breach of privacy obligations
- your misuse of another person's information
- your misuse of linked government or provider sites
- your unlawful or misleading travel representations
- your chargebacks, payment disputes, or fraud allegations linked to your conduct
- your use of the app in violation of employer, school, guardian, or corporate policy
- your use of the app to contact, pressure, deceive, or harass another user
- your breach of export, sanctions, migration, or local-content laws
- your publication or redistribution of app content in a way that creates liability
Where permitted by law, this indemnity survives termination, deletion, suspension, and discontinuation of the app.
## 119. Limitation of Liability Categories Expanded
Without limiting any earlier exclusion, and to the maximum extent permitted by law, the operator excludes liability for:
- denied boarding
- missed flights
- lost reservations
- lost tour value
- failed visa appointments
- identity-theft consequences
- insurance denial
- SIM failure
- roaming charges
- lost work time
- reputational harm from user-to-user communications
- emotional upset caused by ghosting, scams, or disappointment
- loss caused by stale cached data
- loss caused by missing Firebase-fed links
- loss caused by deliberate no-fallback design
- loss caused by local device compromise
- loss caused by relay expiry or message non-recovery
Where law requires a remedy, the remedy is limited to the minimum lawful scope.
## 120. Survival of Key Clauses
The following survive suspension, deletion, uninstall, account closure, feature discontinuation, and app shutdown to the extent relevant:
- disclaimers
- risk allocations
- user warranties
- releases
- indemnities
- limitations of liability
- intellectual property clauses
- payment obligations
- lawful-request clauses
- interpretation clauses
- provisions that by their nature are intended to survive
## Schedule A. Detailed Feature Allocation of Risk
The purpose of this schedule is to state clearly that the operator does not undertake responsibility for the real-world outcomes of informational, planning, commercial-linking, or communication features. The operator provides software, layout, and information surfaces. The user chooses what to trust, what to book, what to say, what to buy, what to ignore, and what risk to accept.
For example:
- if you click a visa bubble and use an external site, you bear responsibility for checking the site
- if you click a flight bubble and book an expensive itinerary, you bear responsibility for that provider decision
- if you rely on a cached emergency number, you bear responsibility for verifying it
- if you use chat to contact another traveler, you bear responsibility for what you disclose and how you interpret their conduct
- if you subscribe to unlock premium chat, you bear responsibility for understanding that premium access is not a guarantee of finding useful people or outcomes
The operator does not stand behind third-party conduct, real-world travel outcomes, or social-contact outcomes merely because the app visually organized your path to those outcomes.
## Schedule B. Specific Acknowledgments for Privacy-Forward Chat Architecture
You specifically acknowledge and accept all of the following:
- the app may prioritize privacy and limited server retention over recovery convenience
- delivered chat history may live primarily on user devices
- a deleted relay message may no longer be recoverable by the operator
- another user may still retain a copy of a conversation on their own device
- the operator may not be able to help you retrieve your full message history later
- push notifications may be intentionally generic and may not reveal message content
- local encryption improves protection but does not eliminate risk on a compromised device
- if you need legally robust, enterprise-grade, evidence-grade, or regulator-grade record retention, this app is not suitable for that purpose
These are not bugs in themselves. They are core design choices. By using the chat feature, you accept those design choices and their consequences.
## Schedule C. Specific Acknowledgments for Firebase-Fed Content
You specifically acknowledge and accept all of the following:
- some travel information, partner links, visa links, and app cards come from remote Firebase-fed data
- such data may be cached locally for extended periods
- if data is missing, invalid, or intentionally suppressed, the app may show nothing rather than a guessed fallback
- what one user sees may differ from what another user sees depending on cache state, sync timing, region, testing track, or rollout state
- a card disappearing does not mean the world changed in the same instant; it may reflect remote reconfiguration or safe-display logic
You accept that the operator has chosen a product design that prefers accuracy controls and cost controls over exhaustive always-on live reads.
## Schedule D. Commercial and Affiliate-Link Acknowledgments
You specifically acknowledge and accept all of the following:
- the operator may earn money from ads, affiliate links, referrals, subscriptions, promoted cards, or commercial routing
- such commercial relationships can affect what is displayed
- commercial display does not by itself make the operator your travel agent, broker, insurer, or merchant of record
- you remain responsible for reading third-party terms, refund rules, cancellation rules, and privacy policies before transacting
The operator disclaims liability, to the maximum extent permitted by law, for outcomes arising from your business dealings with external providers, subject always to non-excludable law.
## Schedule E. No Absolute Liability Elimination
These Terms are intended to be broad and protective of Lorikeet Studio, but they operate only to the maximum extent permitted by applicable law. No wording in these Terms should be read as excluding rights or obligations that cannot lawfully be excluded, waived, or limited. If a court, tribunal, regulator, or mandatory law declines to enforce any particular clause in full, that does not invalidate the remainder.
You nevertheless agree that the commercial intention of these Terms is that:
- the user bears primary responsibility for their own travel decisions, purchases, disclosures, and interactions
- the operator's role is limited, informational, and technical
- liability allocation should favor the operator wherever law allows
- indemnity, release, disclaimer, and limitation clauses should be construed broadly in the operator's favor to the extent legally permissible
## Schedule F. User Warranty Package
By using the app, you warrant, represent, and promise that:
- you will independently verify important information
- you will not rely on the app for emergency-only use
- you understand the app is not professional advice
- you understand external links are third-party environments
- you understand chat may not be archived server-side after delivery
- you understand cached data can become stale
- you understand pricing and subscriptions depend on store systems
- you understand the app may monetize through commercial relationships
- you will comply with law
- you will not misuse the app or use it to harm others
If any of these acknowledgments are untrue for you, you must not use the app.
## Schedule G. Expanded Scenario-Based Acknowledgments
Without limiting any earlier clause, you specifically acknowledge, agree, and accept all of the following scenario-based allocations of risk:
1. If the app displays a visa link and the government later changes the process, you remain responsible for checking the latest process before acting.
2. If a card disappears because Firebase-fed data was removed or failed validation, you remain responsible for continuing your own research.
3. If a cached card remains visible for part of a 30-day cache window after reality changed, you remain responsible for verifying current reality before acting.
4. If a partner link changes destination, price, path, offer, or availability, you remain responsible for checking the provider's own terms before purchasing.
5. If an in-app browser page appears polished or embedded, you remain responsible for checking whether the destination is legitimate and suitable for sensitive data entry.
6. If a travel fact, customs note, etiquette note, or phrase is incomplete or awkward, you remain responsible for using judgment and seeking better context where needed.
7. If a checklist item is missing and you forget something important, you remain responsible for your own preparation.
8. If an itinerary suggestion proves too expensive, impractical, unsafe, inaccessible, culturally insensitive, or closed, you remain responsible for changing your plans.
9. If you rely on an emergency number and it is outdated, incomplete, region-specific, or unreachable, you remain responsible for using direct official channels.
10. If a user in chat misleads you, misstates their identity, or disappears, you remain responsible for how much trust, money, time, or emotion you invest in that interaction.
11. If a store purchase appears successful but app entitlement takes time to refresh, you remain responsible for following the platform's process for restore, refresh, or account verification.
12. If a device is lost or compromised and local message history becomes exposed or unavailable, you remain responsible for the practical consequences of that device event.
13. If a locally encrypted history cannot be restored after reinstall or device migration, you accept that as part of the privacy-forward architecture of the product.
14. If an undelivered relay message expires from the server after the configured window, you accept that the product favored temporary delivery over long-term retention.
15. If another user retains a local copy of a delivered message after you delete your own profile, you accept that the operator cannot control data already held on another person's device.
These examples are illustrative only. They do not limit the broader scope of your responsibilities, waivers, releases, or indemnities under these Terms.
## Schedule H. Storefront, Review, Distribution, and Platform-Risk Annex
You acknowledge that mobile app distribution is dependent on platform gatekeepers, automated review systems, policy documents, review queues, account standing, propagation delays, tax settings, merchant-account settings, app-signing keys, store-region rules, and storefront behavior outside the operator's full control. This means that even where the code is functioning correctly, the user experience can still differ materially because of app-store conditions.
For example, and without limitation:
- a store may delay a rollout even after a build is uploaded
- a user may continue seeing an older build because propagation has not completed
- a closed-test link may present a different result from a public search listing
- a subscription may exist in one region but not another
- a store may suppress or defer purchase availability pending review, merchant setup, tax setup, or policy compliance
- a platform may require additional verification before showing payment methods
- a store may decide how price localization appears to a user
- a store may cache old screenshots, old icons, old text, or old build assets temporarily
You agree that the operator is not liable merely because a store, app review system, propagation layer, or subscription-console process introduced delay, mismatch, or temporary inconsistency.
You further agree that:
- store screenshots, preview assets, and descriptions may lag behind the newest technical build for periods of time
- some users may continue receiving older update packages for reasons outside the operator's immediate control
- test purchases can behave differently from live purchases
- platform testing tracks can expose or hide features in inconsistent ways
- a platform may suspend, reject, or demand changes to content, billing, or disclosure flow at any time
The operator does not warrant uninterrupted or perfect parity between source code, store listing, currently installed device build, store subscription console state, and backend entitlement state.
## Schedule I. Comprehensive Third-Party Dependency Annex
The app depends directly or indirectly on many third-party systems, and those systems can affect outcomes even where the operator has acted reasonably. You acknowledge that the app may depend on:
- app stores
- payment processors through app stores
- Firebase services
- authentication providers
- remote configuration services
- cloud storage systems
- notification-delivery services
- browser engines
- mobile operating systems
- handset vendors
- carriers
- DNS providers
- certificate authorities
- analytics tools
- ad or affiliate routing tools
- government domains
- public websites
- tourism providers
- flight aggregators
- hotel or hostel platforms
- insurer sites
- eSIM sites
Any of these can be slow, unavailable, inaccurate, deprecated, region-blocked, policy-restricted, security-compromised, or commercially changed without notice to the operator. The operator does not assume responsibility for how those third-party systems choose to behave or what legal obligations they impose on you through their own terms.
Where the app organizes, beautifies, or streamlines access to such systems, that organizational role does not make the operator legally responsible for those systems themselves. The operator does not become:
- the issuer of a visa
- the maker of a hotel booking
- the carrier operating a flight
- the insurer underwriting a policy
- the telecom operator providing data service
- the agency dispatching emergency help
- the government publishing entry rules
- the user sending you a chat request
Each third party remains independent, and your dealings with those third parties remain your own responsibility.
## Schedule J. Deep User Responsibility Statement
By using the app, you accept that the app is a tool and not a decision-maker. You are the decision-maker. The app may be attractive, polished, premium-looking, glowy, persuasive, simplified, playful, or confidence-inducing in its presentation, but presentation style does not move responsibility from the user to the operator.
You remain solely responsible for:
- verifying eligibility to travel
- choosing whether to travel
- choosing where to travel
- choosing what to book
- choosing what documents to carry
- choosing what data to share
- choosing what providers to trust
- choosing whether to subscribe
- choosing whether to message another user
- choosing whether to rely on cached information
- choosing whether to act on itinerary or checklist suggestions
- choosing whether to open an external site and input sensitive data
You agree that no bubble, prompt, card, badge, counter, shimmer, glow, animation, CTA, label, premium sheet, locked chat prompt, "stay safe" card, or plan prompt can reasonably be interpreted as the operator taking over your personal responsibility for those choices.
## Schedule K. Additional Release Regarding Social and Travel Outcomes
To the maximum extent permitted by law, you release Lorikeet Studio and its related persons from claims arising out of:
- failed social interactions
- unwanted contact
- ignored contact attempts
- expired locked requests
- subscription disappointment
- lack of local relevance in a chat connection
- incompatible expectations between travelers
- awkward or misleading conversations
- discussions that move too slowly
- discussions that never become useful
- messages that were delivered but later unavailable from the server
- misunderstandings arising from generic or blurred previews
- any real-world consequence of relying on a stranger met through the app
You also release the operator from claims based on the app not generating enough opportunities, not producing enough interesting users, not producing enough local users, not converting enough free users to paid users, or not creating the social or commercial outcome you hoped for.
This release is important because the app can facilitate a path to communication without controlling human behavior, human honesty, human compatibility, or human follow-through. You accept that reality as part of the bargain of using the app.
## Schedule L. Consumer-Law Preservation and Commercial Intent
The operator intends these Terms to be as protective of Lorikeet Studio as applicable law permits. At the same time, the operator does not intend to misstate the effect of non-excludable legal rights. If a user has rights under mandatory law, including rights that cannot be waived or excluded, those rights continue to apply despite any broader-risk-allocation language used elsewhere in these Terms.
However, to the maximum extent allowed by law, you agree that:
- all waivers should be read broadly
- all releases should be read broadly
- all disclaimers should be read broadly
- all indemnities should be read broadly
- all limitations of liability should be read broadly
- any ambiguity should, where law allows, be resolved in favor of preserving the operator's intended protection rather than destroying it
You also agree that if any clause is found too broad in full form, it should be interpreted, severed, or reduced to the minimum extent required so that the maximum lawful protection remains in place for the operator.
## Schedule M. Final User Acknowledgment Bundle
By continuing to use the app after reading or being given access to these Terms, you confirm all of the following:
- you understand that the app is not a government, legal, medical, migration, insurance, or emergency service
- you understand that travel is inherently risky and fact-dependent
- you understand that remote content can be stale, missing, changed, or intentionally suppressed
- you understand that Firebase-fed data may be cached locally for extended periods
- you understand that the app may choose no display over risky fallback display
- you understand that ads, affiliate cards, and provider placement can be commercially motivated
- you understand that partner links lead to independent third parties
- you understand that in-app browser convenience is not a security warranty
- you understand that chat can involve strangers and that strangers can lie
- you understand that premium access does not guarantee better people, better conversations, or better travel outcomes
- you understand that delivered chats may no longer remain available on the operator's servers
- you understand that locally stored chats can still be lost or exposed in device-compromise scenarios
- you understand that the operator is trying to allocate as much responsibility to the user as the law permits
- you agree to accept that allocation as a condition of using the app
If you do not accept all of the above, your only remedy is to stop using the app.
## Schedule N. Notices, Complaints, Disputes, and Operational Handling Annex
If you want to contact the operator about a general concern, billing question, legal notice, misuse report, or takedown-related issue, the current general contact channel identified in these Terms is lorikeetstudio@outlook.com, unless another channel is later designated by us in writing. You acknowledge, however, that sending an email does not by itself create:
- a duty to investigate immediately
- a duty to preserve evidence for your benefit
- a contractual promise to answer within any particular time
- a professional advisory relationship
- a guarantee of a refund
- a guarantee of a moderation outcome
- a guarantee of legal compliance advice tailored to your situation
The operator may prioritize, defer, summarize, decline, or internally route messages according to the seriousness, clarity, lawfulness, evidence quality, safety implications, staffing capacity, business priorities, or apparent authenticity of the request.
If you raise a complaint, you agree to present it in good faith and with enough detail to identify the issue. You also agree that the operator may request reasonable clarifying information before taking action. The operator does not agree that every user dissatisfaction, every social disappointment, every provider dispute, or every travel outcome constitutes a defect for which the operator is responsible.
Without limiting the rest of these Terms, you agree that the following categories of complaints are especially likely to involve third parties or user-controlled circumstances rather than operator liability:
- complaints about airline pricing, routing, baggage, cancellation, and delay
- complaints about hotels, hostels, check-in, cleanliness, or booking-platform conduct
- complaints about insurer decisions, claim outcomes, exclusions, or underwriting
- complaints about eSIM compatibility, carrier quality, region support, throttling, or device lock status
- complaints about other users' honesty, responsiveness, manners, or usefulness
- complaints about changing government rules, embassy queues, or visa refusal
- complaints about stale data that should have been independently verified before action
You agree that before making any claim against the operator, you will consider whether the issue truly arises from operator-controlled conduct rather than from third-party systems, user choice, legal change, travel reality, or device environment.
If a dispute does arise between you and the operator, you agree that, to the maximum extent permitted by law:
- the dispute should first be raised directly with the operator through the designated contact channel
- the operator may investigate using records, metadata, app-state evidence, logs, cached-state knowledge, and internal notes available to it
- the operator may be unable to reconstruct all user-facing events precisely, especially where features involve local device state, temporary relay, or third-party store behavior
- the operator's inability to reconstruct a full event timeline does not create a presumption of fault
You acknowledge that the technical design of the app means some information may never have been stored centrally, may have been intentionally deleted after delivery, may exist only on user devices, may have been overwritten by cache refreshes, or may sit in third-party systems outside the operator's control. You agree not to argue that the mere absence of a complete server-side record proves misconduct by the operator.
Where the law permits, you agree that any remedy available against the operator should be proportionate to the operator's actual role as a limited software and information provider rather than a guarantor of travel, commerce, social interaction, or third-party performance. You further agree that no claim should be inflated by downstream losses caused by your own reliance decisions, your own delay in verification, your own failure to maintain local records, or your own decision to use the app for a purpose for which it was plainly not suited.
The operator may, but is not obliged to, preserve or produce limited operational records where reasonably necessary for security, abuse review, legal compliance, fraud prevention, subscription verification, or dispute handling. Those records may include timestamps, plan status, account identifiers, configuration state, device-token state, or similar non-content information. They may not include the full content of delivered user chats, the complete state of a user's device, or the full state of an external website opened through the app.
You agree that this is a reasonable operational limitation, not a breach in itself.
## Schedule O. Governing-Law, Venue, and Interpretation Annex
To the maximum extent permitted by law, these Terms are governed by the laws applicable in South Australia, Australia, without regard to conflict-of-law rules that would displace that result. You submit to the non-exclusive jurisdiction of the courts of South Australia and courts capable of hearing appeals from them, except to the extent a mandatory law gives you a different forum right that cannot lawfully be displaced.
This clause is intended to provide predictability and structure. It does not concede that every possible claimant is entitled to sue, nor does it expand the operator's liability beyond what these Terms and applicable law otherwise provide.
If any regulator, court, tribunal, or law requires part of these Terms to be read differently for a particular user, transaction, or jurisdiction, the remainder should still be interpreted so as to preserve the operator's broad protective framework to the maximum lawful extent. If a clause is too broad in one context, it should be narrowed only so far as necessary rather than discarded wholesale.
You agree that headings such as "stay safe," "plan," "unlock," "official link," "last synced," "chat requests waiting," "free," "pro," or similar user-facing labels are functional product labels only. They are not legal guarantees and do not override these Terms. Marketing-style or design-style wording in UI copy must be read consistently with the legal disclaimers, risk allocations, releases, limitations, and indemnities contained here.
You further agree that if a short in-app phrase appears more optimistic or simpler than the legal position, these Terms govern to the maximum extent permitted by law.
## Schedule P. Final Protective Intent Statement
The operator's intention in publishing these Terms is to make the legal position as clear as possible:
- the app is a tool, not a promise
- the app may be useful, beautiful, persuasive, and technically advanced, but it is still limited
- the world changes faster than travel apps can guarantee
- third parties remain third parties
- users remain responsible for their own decisions
- law may preserve some non-excludable rights, but otherwise risk should sit primarily with the user rather than the operator
You agree that this protective intent is fundamental to the bargain between the user and Lorikeet Studio. The operator would not offer the app on the same basis, or perhaps at all, without broad disclaimers, broad user acknowledgments, broad waivers, broad releases, broad indemnities, and broad limitations of liability of the kind set out in these Terms.
Accordingly, to the maximum extent permitted by law, you agree that every clause in these Terms that protects the operator should be given practical effect and should not be interpreted narrowly merely because it is protective. If a protective clause can reasonably bear a broader lawful meaning and a narrower lawful meaning, you agree that the broader lawful meaning should be preferred.
You also agree that if any dispute arises about whether a particular loss should sit with the operator or with the user, and the law permits the issue to be allocated by contract, the issue should be allocated to the user unless these Terms expressly say otherwise.
That allocation is part of the commercial basis on which the app is offered, downloaded, opened, and used.
