Terms of Use for Mushroom ID

Introduction

Welcome to Mushroom ID ("we," "our," or "us"). These Terms of Use ("Terms") govern your use of our iOS application, Mushroom ID (the "App"). By accessing or using the App, you agree to be bound by these Terms. If you do not agree with these Terms, please do not use the App.

Use of the App

a. License We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes in accordance with these Terms.

b. Restrictions You agree not to:

Use the App for any unlawful purpose or in any way that could harm us or any third party.

Modify, adapt, translate, or reverse engineer any part of the App.

Use any automated system, including but not limited to robots, spiders, or offline readers, to access the App.

Interfere with or disrupt the integrity or performance of the App or the data contained therein.

User-Uploaded Content

a. Content Ownership You retain ownership of any images or other content you upload to the App ("User Content"). By uploading User Content, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, distribute, and display the User Content for the purpose of operating and improving the App.

b. Prohibited Content You agree not to upload any User Content that is unlawful, harmful, threatening, abusive, defamatory, obscene, infringing, or otherwise objectionable. We reserve the right to remove any User Content that violates these Terms or is otherwise inappropriate in our sole discretion.

Third-Party Services

The App utilizes ChatGPT, a third-party service, to identify Mushrooms from the images you upload. By using the App, you acknowledge and agree to ChatGPT's privacy policy and terms of service, which can be found here.

Privacy

Your privacy is important to us. Please review our Privacy Policy, which explains how we collect, use, and disclose information from our users. By using the App, you consent to our collection and use of your information as outlined in the Privacy Policy.

Return and Refund Policy

Thanks for shopping at Mushroom ID. We appreciate the fact that you like to buy the stuff we build. We also want to make sure you have a rewarding experience while you’re exploring, evaluating, and purchasing our products.

As with any shopping experience, there are terms and conditions that apply to transactions at Mushroom ID. We’ll be as brief as our attorneys will allow. The main thing toremember is that by placing an order or making a purchase at Mushroom ID, you agree to the terms along with Mushroom ID Privacy Policy.

If, for any reason, You are not completely satisfied with any good or service that we provide, don't hesitate to contact us and we will discuss any of the issues you are going through with our product.

Third-Party Services

We may display, include or make available third-party content (including data, information, applications and other products services) or provide links to third-party websites or services ("Third- Party Services").

You acknowledge and agree that Mushroom ID shall not be responsible for any Third-Party Services, including their accuracy, completeness, timeliness, validity, copyright compliance, legality, decency, quality or any other aspect thereof. Mushroom ID does not assume and shall not have any liability or responsibility to you or any other person or entity for any Third-Party Services.

Third-Party Services and links thereto are provided solely as a convenience to you and you access and use them entirely at your own risk and subject to such third parties' terms and conditions.

 Termination

We reserve the right to terminate or suspend your access to the App at any time, without notice and for any reason, including if we believe you have violated these Terms. Upon termination, all licenses and other rights granted to you in these Terms will immediately cease.

 Disclaimer of Warranties

The App is provided on an "as-is" and "as available" basis. We disclaim all warranties, express or implied, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the App will be uninterrupted, error-free, or secure.

 Limitation of Liability

To the fullest extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (a) your use or inability to use the App; (b) any unauthorized access to or use of our servers and/or any personal information stored therein; (c) any interruption or cessation of transmission to or from the App; (d) any bugs, viruses, trojan horses, or the like that may be transmitted to or through the App by any third party; or (e) any errors or omissions in any content or for any loss or damage incurred as a result of the use of any content posted, emailed, transmitted, or otherwise made available through the App.

Indemnification

You agree to indemnify, defend, and hold harmless Mushroom ID and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including without limitation reasonable legal and accounting fees, arising out of or in any way connected with your access to or use of the App or your violation of these Terms.

Governing Law

These Terms are governed by and construed in accordance with the laws of  Turkey, without regard to its conflict of law principles. You agree to submit to the exclusive jurisdiction of the courts located in Turkey for the resolution of any disputes.

Changes to Terms

We may modify these Terms at any time. We will notify you of any changes by updating the "Effective Date" at the top of these Terms. Your continued use of the App after any such changes constitutes your acceptance of the new Terms.
