The developer withdrew the request to remove the condition to preserve the forested buffer, but not the 'sidewalk.'
The public was not informed of this.
Jeanette Akhter for Dirickson Creek Friends learned (by happenstance) that the developer's attorney has submitted a 'Request for Reconsideration" to P&Z which would remove 2 conditions:
Remove P&Z approval condition which removed lots 77 to 85 from OML South to preserve the most environmentally sensitive area from development. It included significant forest and hydric soils, as well as wildlife habitat and historic sites.
Remove P&Z approval condition that required sidewalks on both sides of the street.
The first condition requested to be removed is what Dirickson Creek Friends found not acceptable. However, the public is not allowed any comments or a hearing for such requests by the developer to revise the approval conditions.
