Please read these Terms and Conditions ("Terms") carefully before using the Ditto Mimi mobile application (the "App") operated by AI Practica Foundry LLC ("us", "we", or "our").
By downloading, installing, or using the App, you agree to be bound by these Terms. By using the App, you also agree to our Privacy Policy, available at https://sites.google.com/view/style-emulator, which is incorporated into these Terms by reference. Your rights under these Terms terminate automatically if you fail to comply with any provision herein.
The App is an AI-powered creative tool that analyzes user-uploaded content ("Input") to generate a descriptive style profile, which is then used to generate new artistic or textual content ("Generations").
This is the most critical section regarding your rights.
You retain all ownership rights to the images, text, and media you upload to the App. We do not claim ownership of your original uploads.
By uploading any content to the App, you strictly represent and warrant that:
You own the copyright to the uploaded content, OR;
You have express written permission from the copyright owner to use the content for AI training and generation purposes.
You agree NOT to upload art, writing, or media created by third parties (e.g., famous artists, movies, other users) without their consent.
By uploading content, you grant us a worldwide, non-exclusive, royalty-free license to access, store, analyze, and process your uploads solely for the purpose of generating the style descriptions and new content you request. We do not use your private uploads to train our public foundation models without your explicit consent.
Subject to your compliance with these Terms, AI Practica Foundry assigns to you all its right, title, and interest in and to the content generated by the App ("Generations"). You are free to use these Generations for personal or commercial purposes, provided you assume full liability for such use.
You acknowledge that AI-generated content may not be eligible for copyright protection.
Under current US Copyright Office guidance and various international laws, content created purely by AI (without significant human creative input) cannot be copyrighted.
We make no warranty that you will be able to register a copyright for any content generated by the App.
We are not liable if your Generations are deemed public domain or if third parties use them without your permission.
Due to the nature of generative AI:
Generations may resemble the works of third parties or other users.
We do not guarantee that Generations will be unique.
You are solely responsible for ensuring your use of the Generations does not infringe on the trademark, copyright, or publicity rights of others.
You acknowledge that the App is designed to emulate "style," which is an abstract analysis of patterns, techniques, and aesthetics.
No Ownership of Style: You acknowledge that "style" generally cannot be copyrighted. However, specific expressions can be.
Prohibited Mimicry: You agree not to use the App to deliberately create forgeries, deepfakes, or works intended to mislead the public into believing they were created by a specific human artist or entity.
You agree not to use the App to generate:
Sexual Abuse Material (CSAM) or non-consensual sexual content.
Hate speech, harassment, or violence.
Content that infringes on the intellectual property or privacy rights of others (e.g., uploading photos of celebrities or private individuals without consent).
Deepfakes intended to deceive or manipulate political/financial outcomes.
We reserve the right to ban any user who violates these prohibitions and report illegal content to law enforcement.
The App offers auto-renewable subscription plans ("Basic" and "Pro"). Subscriptions automatically renew unless canceled at least 24 hours before the end of the current billing period. Payment is charged to your Apple ID account at confirmation of purchase.
You may cancel your subscription at any time through your Apple ID account settings. Cancellation takes effect at the end of the current billing period; you will not receive a refund for the unused portion of the period.
One-time credit purchases ("Boosters") are non-refundable once consumed. Unused credits do not expire as long as your account remains active. Credits are non-transferable and have no cash value.
We reserve the right to change subscription pricing. You will be notified of any price changes in advance and can cancel before the new price takes effect.
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
THE APP IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND.
WE ARE NOT LIABLE FOR INTELLECTUAL PROPERTY INFRINGEMENT CLAIMS BROUGHT AGAINST YOU. IF YOU USE THE APP TO MIMIC A COPYRIGHTED ARTIST AND GET SUED, YOU AGREE THAT AI PRACTICA FOUNDRY IS NOT LIABLE.
OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE LAST 12 MONTHS.
You agree to defend, indemnify, and hold harmless AI Practica Foundry from and against any claims, damages, costs, and expenses (including attorney's fees) arising from:
Your violation of copyright laws (e.g., uploading content you didn't have the rights to).
Your use of the Generations (e.g., if you sell an AI image and get sued).
Your violation of these Terms.
We respect the intellectual property rights of others. If you believe that your work has been uploaded to the App in a way that constitutes copyright infringement, please contact our Copyright Agent at:

These Terms shall be governed by the laws of Illinois. Any dispute shall be resolved through binding arbitration in accordance with Illinois rules.
Both parties acknowledge and agree that Apple Inc., and Apple's subsidiaries, are third-party beneficiaries of these Terms, and that upon the user's acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against the user as a third-party beneficiary thereof. Maintenance and support for the App is provided solely by AI Practica Foundry. Apple has no warranty obligations with respect to the App. Apple is not responsible for addressing any claims by you or any third party relating to the App or your use of the App.

AI Practica Foundry LLC ("we," "our," or "us") operates the Ditto Mimi mobile application (the "App"). We respect your privacy and are committed to protecting the intellectual property and personal data you trust to our AI tools.
This policy describes how we collect, use, and handle your information when you use our service.
We built Ditto Mimi to respect the ownership of your creative work. Our architecture is designed to minimize data retention:
Transient Processing: When you upload source artwork or writing samples ("Inputs"), they are processed in transient memory solely to extract the "Style Profile" (the mathematical or textual description of the style).
No Permanent Source Storage: Once the analysis is complete, we immediately discard the original source files from our processing servers. We do not build a permanent database of your original uploaded artwork.
You Own the Profile: The resulting Style Profile (the description used to generate new content) is stored securely in your account, but you retain full control to delete it at any time.
Account Information: If you create an account, we may collect your email address or authentication ID (via Apple/Google Sign-In).
Style Profiles: We store the generated text descriptions and prompts that define your styles so you can reuse them.
Support Inquiries: If you contact us via email, we keep a record of that correspondence.
Usage Data: Anonymous metrics on how the App is used (e.g., "5 styles generated today") to help us improve performance.
Device Information: Device type, OS version, and unique identifiers (for subscription validation).
To protect the integrity of the platform and enforce our Terms of Service regarding copyright, we collect and retain immutable metadata for every generation request:
IP Address & Timestamp: To verify the origin and time of the request.
Content Hash (SHA-256): We generate a unique cryptographic fingerprint of the content you upload. We do not store your original files. This hash allows us to mathematically prove whether a specific file was uploaded by you in the event of a copyright dispute or legal claim, without us ever having to retain the private image itself.
We use your data strictly to:
Provide the Service: Processing your inputs to generate style descriptions and new content.
Maintain Security: Using the audit logs (Hashes/IPs) to detect abuse, prevent "deepfake" creation, and enforce copyright policies.
Verify Subscriptions: ensuring you have access to paid features.
We do NOT use your private uploads to train our public foundation models. Your style is yours; we do not feed it into a global model for other users to access.
We share data with trusted third-party infrastructure providers solely to operate the App:
Google Gemini (Google Cloud): Used as the AI engine to analyze images and generate text/images. Data sent to the API is used for generation only and is not used to train Google's foundation models (Enterprise data privacy standards apply).
Vercel: Hosts our serverless backend code.
Supabase: Securely stores your Style Profiles (text) and our Security Audit Logs.
Apple & Google: Process all payments. We do not see or store your credit card details.
We implement enterprise-grade security measures:
Encryption: All data is encrypted in transit (TLS/SSL) and at rest (in the Supabase database).
Row Level Security (RLS): Our database uses strict policies to ensure you can only access your own Style Profiles.
Server-Side Hashing: Our audit trail is generated on our secure servers, ensuring the integrity of our legal records.
Access & Correction: You can view your saved Style Profiles within the App.
Deletion: You may delete a Style Profile or your entire account at any time within the App settings.
Note: While your Account Data and Style Profiles will be deleted, we may retain the Security Audit Logs (Hashes and IPs) indefinitely for legal defense and safety purposes, as permitted by law (GDPR "Legitimate Interest")
You acknowledge and agree that AI Practica Foundry maintains an immutable audit log of all transactions to protect the integrity of the Service. We record the IP address, timestamp, and a cryptographic hash of all uploaded content. This data may be used as evidence in the event of a dispute, copyright claim, or violation of these Terms to prove the origin and nature of the content you processed.
The App is not intended for users under the age of 18. We do not knowingly collect personal data from children. If we discover a user is under 18, we will delete their account and data immediately.
We may update this Privacy Policy from time to time. We will notify you of any changes by updating the "Last Updated" date at the top of this policy.
